Ladies and Gentlemen:
Our regulatory program utilizes a series of nationwide permits (NWPs) to authorize specific
categories of work that have'minimal impact on the aquatic environment when conducted in
accordance with the permit conditions (Federal Register, January 15, 2002, Vol. 67, No. 10).
Based on the information you provided to us, NWP 3, Maintenance, authorizes your proposal to
repair a float, as depicted on the drawings dated June 18, 1999, and January 2002 (enclosure 1).
The proposed project would occur in Lake Washington at Gene Coulon Park in Renton,
Washington.
In order for this NWP authorization to be valid, you must ensure that the work is performed
in accordance with the terms and conditions of this NWP (enclosure 2) and the following special
condition that the District Engineer has added to ensure that this project would have no more
than a minimal adverse impact on the aquatic environment:
- Any stain, paint, or preservatives to be applied on the components will be completely
dry/cured prior to installation. Creosote and pentachlorophenol preserved wood will not be
used and no material shall enter the waterbody during the removal of decking, etc.
Upon completing the authorized work, you must fill out and return the "Certificate of
Compliance with Department of the Army Permit" form (enclosure 3) to the address indicated on
the form. Your signature on this form is our assurance that the completed work and any required
mitigation was conducted in accordance with the terms and conditions of this NWP, including
any special conditions required by the District Engineer. Completing and returning the
compliance certification form is a requirement of every NWP authorization (see NWP National
General Condition 14).

We have reviewed your project pursuant to the requirements of the Endangered Species Act
(ESA). We have determined that this project will not affect any species listed as threatened or
endangered under the ESA (or a species proposed for such designation. As such, this project
satisfies the requirements of NWP National General Condition 11. We have also reviewed your
project pursuant to the requirements of the Magnuson-Stevens Fishery Conservation and
Management Act, as amended by the Sustainable Fisheries Act of 1996 in regards to Essential
Fish Habitat (EFH). We have determined that the proposed action will not adversely affect EFH
for federally managed fisheries in Washington.
Our verification of this NWP authorization is valid for 2 years from the date of this letter
unless the NWP is modified, reissued, or revoked prior to that date. If the authorized work has
not been completed by that date,please contact us to discuss the status of your authorization.
If this project complies with all terms and conditions of this authorization, you will need no
further authorization from us for the above-described work. However, this authorization does
not obviate your responsibility to obtain all additional authorizations, including State and local
permits that are applicable to your project. Also, we remind you that failure to comply with all
terms and conditions of this NWP authorization, including the above-listed special condition
invalidates your authorization and could result in a violation of Section 10 of the Rivers and
Harbors Act of 1899.
Thank you for your cooperation during the permit process. Your efforts help us protect our
nation's aquatic resources, including wetlands. Please remember to fill out and return the
compliance certification form as soon as you complete the authorized work. A copy of this letter /
without enclosures will be furnished to Jim Starkes, Pentec Environmental, 120 Third Avenue
South, Suite 110, Edmonds, Washington 98020-8411. If you have any questions about this

Dear Gary:
The Renton Sailing Club proposes to repair an existing floating dock located in Gene
Coulon Park on Lake Washington. This assessment addresses the potential effects of this
action on species that may be present in the area and are listed as threatened under the
Endangered Species Act (ESA). Section 7 of the ESA requires that any action by a Federal
Agency is "not likely to jeopardize the continued existence of any [listed] species or result in
the destruction or adverse modification of habitat of such species."
Species of concern include Puget Sound chinook salmon (Oncorhynchus tshawytcha),
which was formally listed on May 24, 1999, by the National Marine Fisheries Service
(NMFS) as threatened under ESA; bull trout (Sa/ve/inus confluentus), listed on December 1,
1999, by the U.S. Fish and Wildlife Service (USFWS), as threatened under ESA; and bald
eagle (Ha/iaeetus/eucocepha/us), also listed as threatened by USFWS under ESA. This
assessment will also address coho salmon (O. kisutch), because it is present in the area and
has been designated by NMFS as a candidate for listing under ESA.
PROPOSED ACTION
Location of Project and Action Areas
The Renton Sailing Club floating dock is located in south Lake Washington, Renton,
Washington, in Section 6, Township 23N, and Range 5E (Figure 1).
The action area is defined as a 1-mile radius around the project area to account for effects
on bald eagles and salmonids (Figure 1).

Existing Facility
The existing floating dock is 18 feet wide, 60 feet long, with a freeboard of approximately 9
inches (low profile for small sailboat haul-outs, typical for sailing club usage). Six timber
pilings, three on each long side, hold the float to the lake bottom (Figure 2). The float is
composed mainly of wood beams, deck planking, and foam flotation units. Deck planking is
made up of 2-inch by 6-inch planks, laid along the length of the float. The secondary cross
members are 3-inch by 8-inch timbers on 36-inch centers and run across the width of the
float. The surrounding edges of the float are a combination of 2-inch by 12-inch lumber
and 4-inch by 8-inch beams.
The primary structural beams consist of four equally spaced, longitudinal beams that run the
length of the float. These beams measured 4 inches by 8 inches by 20 feet. Three of these
beams were placed end to end and connected at the end joints by sister frames. All primary
beams were designed to be underwater continuously due to the low-profile nature of the
float's original design. All of the primary timber beams were creosote coated and thru-
bolted to the secondary cross-members. Over time and because of wave-induced forces,
either the thru-bolts were sheared away or the beams became waterlogged and sank.
Proposed Float Repair
Repairs of the floating dock are proposed by using four 3-1/8 inch by 10-3/4 inch by 60 foot
glu-lam structural beams. The repair would use best management practices (BMPs) in the
replacement of the primary beams. Any drilling of holes or sanding of wood shall be either
vacuumed during the process, to keep wood debris from entering the water column, or
performed on land. The new beams will be coated with a penetrating epoxy coating similar
to the Wood Epoxy Saturation Technique (WEST) system or equal, after all holes are drilled.
Due to the epoxy saturation into the wood, multiple coats will be necessary. All epoxy
coats will be applied on land and allowed to fully cure before moving the finished beams to
the float.
The remaining primary beams will need to be removed. One partial beam is hanging from
the float by a single bolt and any other primary beams remaining will need to be removed
from the float. All wood removed from the float and the water under the float should be
disposed of properly in an upland approved hazardous waste disposal facility.
The remaining thru-bolts will require removal from the cross members. The usage of the
existing thru-bolt holes in the cross-members (to thru-bolt onto the new primary structural
beams), is the best means to repair the float. No new holes will be drilled into any creosote-

treated cross-members to reduce any wood debris from entering the lake water. Proposed
repairs to the float dock will not change the existing overwater footprint and will use existing
pilings. No new pilings will be driven or removed. Fully cured replacement beams will be
carried into position and bolted into place from the float. No divers or barge will be
necessary to conduct proposed repairs.
BIOLOGICAL RESOURCES AT THE FLOATING DOCK
Salmonids
The southern end of Lake Washington is in the migration corridor for chinook salmon and
other salmonid species migrating to and from the Cedar River basin. The littoral zone of
Lake Washington provides habitat for salmonids during their adult upstream migration and
during juvenile rearing and their outmigration. An estimated 40 percent of the Lake
Washington basin wild fall chinook salmon use the Cedar River, and 12 to 25 percent of the
Lake Washington wild coho salmon use the Cedar River (Corps 1997). Bull trout are known
to occur in the upper Cedar watershed; this stock is believed to be adfluvial, meaning that
they spawn in tributaries, migrate to lakes to rear, then return to the tributaries as adults to
spawn (City of Seattle 1998). The bull trout population in this system occurs above the
lower Cedar Falls, which is a natural fish barrier. These bull trout use the Chester Morse
Lake/Masonry Pool system and their tributaries to rear and spawn. No anadromous stock of
this species is believed to occur in the Cedar River system, although it is possible that some
fish inadvertently pass the barrier and end up in the lower reaches of the Cedar River and in
Lake Washington.
Bald Eagle
No bald eagle nests occur within a 1.5-mile radius of the project site (WDFW 1999). The
use of the project site as a foraging ground for bald eagles is limited because the riparian
zone along the lake shore in the vicinity of the project site is void of large trees for bald
eagles to use for perching while feeding.
EFFECTS OF PROPOSED ACTION
Salmonids
The proposed action will not involve significant work in the water. No wading, divers, or
barge will be necessary to conduct proposed repairs. Disturbance to any fish in the vicinity
will be insignificant. Care will be taken that no material enters the water. The application of

water-repellent epoxy on replacement beams will be conducted on land and allowed to fully
cure before installation on the float. Proposed repairs will not change the existing amount
of overwater structure. There is no mechanism by which this project could measurably
impact salmonids, including the species listed as threatened under ESA. Therefore, this
analysis concludes that the project will have no effect on listed salmonids.
Bald Eagle
Activities associated with this project will cause no greater disturbance to bald eagles than
the normal boating and recreational activities associated with Gene Coulon Park. This
analysis concludes that the proposed project will have no effect on bald eagles.
CONCLUSIONS AND SUMMARY
Based on the location and type of work proposed, it is determined that the project will have
no effect on chinook salmon or bull trout. Similarly, the proposed action will not
jeopardize coho salmon, a species proposed for listing, and if coho are listed, the proposed
action will have no effect on coho salmon or their habitat. The proposed project will have
no effect on bald eagles.
