APPLICABLE SECTIONS OF THE COMPREHENSIVE PLAN: 1. Land Use Element - Residential Single Family 2. Housing Element G. DEPARTMENT ANALYSIS: 1. Project Description/Background The applicant proposes to subdivide a 30,500 sq. ft. parcel into four (4) lots intended for single family residences. The lot sizes range from 6,921 sq. ft. to 9,271 sq. ft. An existing house and garage on the site would be removed. The proposed lots would be accessed from a private street constructed off Hoquiam Place NE. The private street access includes a hammerhead turnaround at its terminus. 2. Environmental Review Not applicable. Short plats are exempt from SEPA Environmental Review (except when located on lands covered by water or sensitive areas) pursuant to WAC 197-11-800(6)(a). 3._ Compliance with ERC Conditions Not applicable. 4. Staff Review Comments Representatives from various city departments have reviewed the application materials to identify and address issues raised by the proposed development. These comments are contained in the official file, and the essence of the comments has been incorporated into the appropriate sections of this report and the Departmental Recommendation at the end of the report. 5. Consistency Short Plat Criteria Approval of a plat is based upon several factors. The following short plat criteria have been established to assist decision makers in the review of the plat: a) Compliance with the Comprehensive Plan Designation The site is designated Residential Single Family (RSF) on the Comprehensive Plan Land Use Map. The RSF designation is intended to promote and enhance single family neighborhoods. The proposal is consistent with the RSF designation in that it would provide for future construction of single family homes and would promote goals of infill development. The proposed density of 5.71 dwelling units per acre (du/ac) is consistent with the density range of 5 to 8 du/ac specified by policy for the RSF designation. shpltrpt.doc City of Renton P/B/PW Department Administrative Land Use Action KYLE 11 SHORT PLAT LUA-99-101, SHPL-A REPORT DATE:AUGUST 13, 1999,REVISED OCTOBER 8, 1999 Page 4 of 8 b) Compliance with the Underlying Zoning Designation The subject site is zoned Residential-8 DU/AC (R-8) on the City of Renton Zoning Map. The proposal would allow for 4 single family residences on separate lots. Single family residences are a primary permitted use in the R-8 zone. The minimum lot size permitted in the R-8 zone is 4,500 square feet. The proposed lots range in size from 6,921 square feet to 9,271 square feet. The allowable density range within the R-8 zone is a minimum of 5 and a maximum of 8 dwelling units per net acre. The proposed short plat would have a net density of 5.71 dwelling units per acre, meeting density requirements of the R-8 zone. There are no subtractions from the gross site area for purposes of calculating density. The R-8 zone requires a minimum 50 foot lot width for interior lots and a 60 foot lot width for corner lots. There is a minimum lot depth of 65 feet. All of the proposed lots comply with the lot dimension requirements of the R-8 zone. c) Compliance with Subdivision Regulations Streets: No new public streets would be created with the short plat. The proposed lots would be accessed from a private street constructed off Hoquiam Place NE. The proposed short plat is expected to generate additional traffic on the local street system. To mitigate for project impacts, staff recommends that the applicant be required to pay a traffic mitigation fee of $75 per average daily trip generated by the project. The proposal is expected to generate 9.55 average daily trips per new single family residence. The traffic mitigation fee for the short plat is estimated to total $2,148.75. Blocks: No new blocks would be created with the proposed short plat. Lots: The size, shape, orientation, and arrangement of the proposed lots comply with the requirements of the Subdivision Regulations and the development standards of the R-8 zone. The building envelopes, or the area available for construction with respect to setback requirements, are of an adequate size and shape for standard residential construction. Proposed lot lines would cross the existing house and garage on the property. The applicant has stated plans to remove the house and garage. The applicant should demolish or remove the existing house and garage prior to recording the short plat. d) Reasonableness of Proposed Boundaries Access: City Street Standards allow private streets to access a maximum of 6 lots, with no more than 4 of the lots landlocked or not abutting a public right-of-way. The proposal complies with this standard. The private street is required as a 26 foot wide easement, improved with a 20 foot pavement width. The proposal complies with this standard. The applicant should create a homeowners association or record maintenance agreement to maintain the private street and other common improvements on the site. Topography: The site topography is irregular, with short steeper man-made slopes in the northwest and southwest corners of the site. Rockery walls may be required on Lot 2 and Lot 4. The proposed private road may result in grades exceeding 8%. Details of grading for the street were not submitted with the short plat application. If the private street exceeds an 8% slope, the applicant would require approval of the shpltrpt.doc City of Renton P/B/PW Department Administrative Land Use Action KYLE II SHORT PLAT LUA-99-101, SHPL-A REPORT DATE:AUGUST 13, 1999,REVISED OCTOBER 8, 1999 Page 5 of 8 Board of Public Works. Street grades exceeding 15% are not permitted due to emergency access requirements. Driveways exceeding 8% are required to provide slotted drains at the lower end with positive drainage discharge to restrict runoff from entering the garage/residence or crossing any public sidewalk. Driveways exceeding 15% are only permitted with variance approval from the Board of Adjustments (RMC 4-4-0801:6a). Prior to issuance of construction permits, the applicant should submit a grading plan or street profile to ascertain the grades of the private street and driveways. The applicant would require approval of the Board of Public Works if the private street exceeds an 8% slope. Relationship to Existing Uses: The subject site is surrounded by a single family residential development. The proposed lot sizes are generally consistent with lots in the area, particularly those created by recent subdivisions. Comprehensive Plan policies encourage infill development and the zoning code was changed in 1993 to implement this policy by allowing for the development of smaller lots than the existing land use pattern. e) Availability and Impact on Public Services (Timeliness) Police and Fire: Police and Fire Department staff indicate they have sufficient resources to serve the proposed lots, subject to the condition that the applicant provide for code-required improvements and mitigation fees. A Fire Mitigation Fee of $488 per new single family structure would be required prior to the recording of the short plat. Recreation: The proposal does not provide for common on-site recreation areas for future residents. The proposal is expected to increase demands on existing and future parks and recreation facilities within the City of Renton. A Parks Mitigation Fee of $530.76 per new single family lot would be required prior to the recording of the short plat. Schools: The proposed short plat is estimated to generate approximately 1 to 2 school age children, considering a factor of 0.44 children per single family residence. This is not expected to impact school district facilities. Storm Water: A brief drainage narrative was submitted with the short plat application. Plan Review staff indicates that no detention, water quality features or developed drainage system would be required for the proposed short plat. The applicant has submitted a letter dated October 8, 1999 addressing staff concerns about stormwater flows going down the private road and potential drainage impacts on Lot 4, the lowest lot topographically. The letter states that the applicant will construct the road with an inverted crown and locate a catch basin at the bottom of the road. The catch basin will be connected to a rock lined infiltration pit. The applicant notes the soils on the site have adequate drainage characteristics for the infiltration pit. The applicant's proposal should adequately mitigate potential drainage problems on Lot 4. Water and Sanitary Sewer Utilities: Adequate sewer and water utilities are available to the site to serve the proposed short plat. System Development Charges would be assessed for each new lot created by the short plat. shpltrpt.doc City of Renton P/B/PW Department Administrative Land Use Action KYLE II SHORT PLAT LUA-99-101, SHPL-A REPORT DATE:AUGUST 13, 1999,REVISED OCTOBER 8, 1999 Page 6 of 8 H. Grady Way Renton, WA 98055 SUBJECT: Kyle II Short Rat Project No. LUA-99-101, SHPL-A Dear Peter: I am writing in response to staff concerns about stormwater drainage for the Kyle II Short Plat that I am proposing. The main concern is over stormwater flows going down the private road and potential drainage impacts on Lot 4, the lowest lot. I had proposed to crown the road to spread runoff over the road edge, but apparently this does not satisfy staff concerns. Therefore, I will construct the road with an inverted crown and locate a catch basin at the bottom of the road. The catch basin will be connected to a rock lined infiltration pit. The soils on the site have adequate drainage for the infiltration pit to function. If you have any other concerns or suggestions please let me know. These include a gas pipeline easement over the west 10 feet of the subject property(per King County Rec.No. 5333935), an underground communication lines easement over the westerly 40 feet(per King County Rec.No. 8012310522),an electric underground easement over the westerly 40 feet(per King County Rec.No. 8101070482), a joint use of well agreement(per King County Rec.No. 4171000), and an easements, access and development agreement(per King County Rec.No. 8812090774 and amended by King County Rec.No. 9110031457). Some of these aforementioned easements fall within the building setback areas of proposed Lots 1 and 4. If these easements can be released, proceed with the release process with the private parties involved. If not, resolve the matter as is necessary. The indexing information on Sheet 1 of 2 is incorrect. The correct quarter section is the SE '/a. The following comments apply to the final short plat submittal: Note the City of Renton land use action number(LUA-99-101-SHPL)and the city's land record number(LND-20-0252)on the drawing in the spaces provided. Tie to the City of Renton Survey Control Network. The geometry will be checked when the ties have been made. Provide the short plat and lot closure calculations. \\TS SERVER\SYS2\COMMONW:\FILE.SYS\LND\20\0252\RV990712.DOC July 12, 1999 Page 2 On the final short plat submittal, remove all references to trees, topog lines, utility facilities and other items not directly impacting the subdivision. These items are only necessary for preliminary short plat approval. The only City of Renton official who signs short plat submittals is the Administrator of Planning/Building/Public Works. The approval block and signature line for the Transportation Systems Manager should be removed. The"DEDICATION"block noted is more suited to a long plat than a short plat and is incomplete as shown. See the attachment for a"Declaration"block that is a better fit for this short plat. Indicate what has been, or is to be, set at the corners of the proposed lots. Note the name of the plat to the east of the subject property, and also note if the property to the south is platted(give name and lot number)or unplatted. Note that if there are restrictive covenants, agreements or easements to others(City of Renton, etc.) as part of this subdivision, they can be recorded concurrently with the short plat. The short plat and the associated document(s)are to be given to the Project Manager as a package. The short plat shall have the first recording number. The recording number(s)for the associated document(s)need to be referenced on the short plat drawing in the appropriate location(s). Note discrepancies between bearings and distances of record and those measured or calculated. The addresses for the proposed lots will be provided by the city as soon as possible. When available, note said addresses on the drawing. Because the subject property falls within Zone 2 of the Aquifer Protection Area, note the Aquifer Protection Notice on the drawing. See the attachment. If new easements(the private road)are shown for the benefit of future owners of the proposed lots, then include the following statement, juxtaposed to the subject easement: "Area for private(water, sewer, utilities, access, etc.)easement."Remove the portion of the existing statement that says, "TO BE CREATED UPON RECORDING OF THIS DOCUMENT." Since the new lots created via this short plat are under common ownership at the time of recording, there can be no easement until such time as ownership of one of the lots is conveyed to another via a conveyance document. The conveying document needs to include a statement about the together with and/or subject to specific easement rights. Also, add the following Declaration of Covenant language on the face of the subject drawing, if the previous paragraph applies: DECLARATION OF COVENANT: The owner of the land embraced within this short plat, in return for the benefit to accrue from this subdivision, by signing hereon covenants and agrees to convey the beneficial interest in the new easement shown on this short plat to any and all future purchasers of the lots, or of any subdivisions thereof This covenant shall run with the land as shown on this short plat. July 12, 1999 Page 3 If the city is requiring a road maintenance agreement for the 26' ingress/egress and utilities easement, it can be noted on the face of the short plat drawing. See the attachment. Comments for the Project Manager: Note, in particular, the comments in the first two paragraphs of this memo. Resolve with the applicant as necessary. Fee Review Comments: The Fee Review Sheet for the preliminary short plat review is provided for your use and information. i VY . r -t_r LEGEND :11 -- — nJ NT AS Fc*) RIGHT-OF—WAY _ b' wimpx_ i "x" r- g Ls rlse• c 19' GRAPHIC SCALE 1 '=50 ' - ---_ esumminim I 50 0 100 lli 48.00' FOUND MON AIENT • d IN RA Y C SERWTt--1PU 11- BASIS OF BEARINGS: OF I ED h ST.Nv& PER PLAT OF "EARLINGTON VE. (ALSO KNOWN AS LOT 3, CITY OF RENTON LOT LINE ADJUSTMENT NO. LLA-006-88, RECORDED UNDER RECORDING NUMBER 8805269019. ) • CHICAGO TITLE INSURANCE COMPANY KYLE II SHORT PLAT PROJECT NARRATIVE The project site is zoned Residential-8 DU/AC (R-8). The neighborhood surrounding the site is also zoned R-8 and consists entirely of single-family residences. There are a variety of lot sizes in the immediate area of the site. Most of the recently developed lots are approximately 5,000 to 7,000 square feet in size. The Kyle II Short Plat site is a total 32,900 square feet. The proposal is to create 4 lots for the future construction of single family residences. The 4 lots would result in a density of 5.30 dwelling units per acre. There is sufficient lot area for construction of standard residences considering yard setback requirements. The proposed lot sizes are as follows: Lot 1 - 9,297 sq. ft. Lot 2 - 6,921 sq. ft. Lot 3 - 6,976 sq. ft. Lot 4 - 9,706 sq. ft. The lots would be accessed off a private street off Hoquiam Place NE. The private street access is shown as a 26 foot wide access and utility easement. There is an existing residence and garage on the site, both of which would be removed to allow development of the individual lots. The site topography is irregular, with short steeper man-made slopes in the northeast and southwest corners of the property. This may require a rockery wall on Lot 2 and Lot 4. The private road access would be graded to be less than a 15% slope. It is understood that Board of Public Works approval will be necessary for street slopes greater than 8%. There are no significant trees on the site. Sewer and water utilities are available to the site off Hoquiam Place NE. Construction Mitigation Plan 1. Proposed Construction Dates: Summer 1999. 2. Hours of Operation: 7 a.m. to 5 p.m. or up to the maximum allowable hours as approved by the City. 3. Proposed Transportation Routes: NE Sunset Blvd. to Field Place NE to NE 17th Street, or as directed by the City. 4. Measures to Minimize dust, Noise, Traffic, etc.: Erosion and sedimentation control plan will be implemented during construction phases. Best Management Practices (BMPs) will be used. *The development of the site may require the removal of all treqs indicated on the short plat plan. if possible, the trees will be retained. The property is located in the SE 1/4 of Section 3, Township 23 North, Range 5 East, W.M. The parcel size is 32,900 square feet. There is an existing single- family residence and garage on the site which will be removed for the proposed development. The short plat will create four new lots on the site. The City of Renton Aquifer Protection Zone Classification map indicates that this parcel is within Zone 2. Domestic water and sanitary sewer are available to the site. Site Description The existing soil type is classified as Alderwood (AgC) series soil by the United States Department of Agriculture, Soil Conservation Service in the"King County Soil Survey." This soil type is characterized as a gravely sandy loam, with moderate rapid permeability in the surface layer and subsoil and very slow in the substratum. Alderwood soils are classified into Hydrologic Group "C", having a slow rate of water transmission and infiltration. The site has variable topography, with short steeper man-made slopes in the northeast and southwest corners of the property. This may require a rockery wall on Lot 2 and Lot 4. The private road access would be graded to be less than a 15% slope. There are no significant trees on the site. Storm Drainage Analysis During a field inspection of the site there were no indications of water courses, standing water, or flooding. Existing runoff patterns are dispersed and there are no signs of significant drainage patterns or scouring of channels on the site. There is no piped storm drain conveyance system adjacent to the site for connection. Storm drainage improvements for the development will be provided as required by the 1990 King County Surface Water Design Manual, as adopted by the City of Renton. The Alderwood soils on the site have a low permeability and infiltration rate. However, the short plat would convert only a small area of the site to impervious surfaces. The created impervious surfaces would be limited to roofs and driveways of residences and to the paved private street. Lot improvements will include individual downspout infiltration systems. The private street will be crowned for positive drainage. It is anticipated that the high degree of pervious, vegetated surfacing remaining on the lots will allow for sufficient infiltration area. The street improvements will be installed without exceeding the 0.5 cfs threshold for the 100 year/24 hour design storm. On-site detention would only be required if this threshold is exceeded. If an on-site detention system is required it would be released downstream in a manner similar to the existing drainage pattern. Water quality treatment of stormwater or biofiltration is also not anticipated because the project will create less than 5,000 square feet of impervious surface used by vehicles. When this site is fully developed, it is anticipated that storm runoff flows will not significantly impact any surrounding property. Temporary erosion and sedimentation controls will be designed and implemented during the construction phase of the project. (a Washington Corporation) hereinafter "Henderson" CARL AND JUNE RIGTRUP, (husband and wife) hereinafter "Rigtrup" and ROBERT ALLEN AND BETH T. BARTH, (husband and wife) hereinafter "Barth'. The City of Renton is relying upon this agreement in conjunction with their review and approval of the Summerwind project and related improvements. Accordingly, they are a third party beneficiary to this agreement. RECITALS A) Henderson is the developer of a project known as Summerwind Division III thru VI, a copy of the proposed preliminary plat and legal description are attached hereto as Exhibit "A". B) Rigtrup is the owner of property legally described in r- Exhibit "B". G C) Barth is the owner of the property legally described in Exhibit "C". rD) Rigtrup and Barth currently access their properties via a Z; gravel road fronting on SR900 (Sunset Highway). The gravel road Cfl encroaches upon the Henderson property. E) In conjunction with the development of the Summerwind Project, Henderson will be making improvement3 to SR900 (Sunset Highway) which will require slope easements from Barth. Henderson will also be developing a public road currently shown as Hoquiam Ave NE, on Exhibit "A", which could provide a better access to the Rigtrup and Barth properties. F) In order for Barth to gain access to Hoquiam Ave NE it is necessary for Rigtrup to grant to Barth an easement for ingress, egress and utilities over the south 30' of the Rigtrup parcel. G) It is the desire of Rigtrup and Barth to abandon their access to Sunset Avenue and provide for legal access to Hoquiam Avenue at such time as Henderson provides a public street adjacent to the Rigtrup parcel. H) The parties hereto intend this agreement to be binding as of the date all parties execute this agreement. The agreement is to become effective as of the date that Henderson provides a completed public street to the proposed easement road. That date (herein after the "Effective Date") will be the date that Henderson has both recorded the final plat containing the road - adjacent to the Rigtrup property (Summerwind Division V/Hoquiam Ave NE) and had the road improvements completed to City of Renton standards and accepted for one year maintenance by the City of Renton. NOW THEREFORE, in consideration of the mutual promises and covenants, the receipt and sufficiency of which is hereby acknowledged the parties hereto agree as of the Effective Date as follows: 1) Henderson agrees to install improvements to a public road adjacent to the Rigtruo's property in accordance with the proposed preliminary plat as it will be approved by the City of Renton and further in accordance with engineering plans and specifications to be approved by the City of Renton. 2) Henderson agrees to permanently black access to sunset Highway (except for emergency access if request by the City) . 3) Henderson agrees that upon completion of improvements that Barth will have a minimum driveway of Ten feet (10' ) on the South side of their carport. 4) Rigtrup and Barth unconditionally and irrevocably release, tJ relinquish and permanently abandon the right to access SR900 (Sunset Highway) directly via the Barth property. 5) Rigtrup unconditionally and irrevocably releases, relinquishes and permanently abandons the right of ingress and egress over the West portion of the Barth property. 6) Rigtrup grants to Barth an easement for ingress and egress and utilities in the form of Exhibit "D", attached hereto, together with a similar easement over such additional lands along the west 20 feet of Rigtrup's property as are necessary to provide a minimum 20' frontage of the easement on the public street. 7) Henderson agrees to pay the cost of relocating a 20' gravel road within the easement provided for in paragraph 4 above which must provide reasonable ingress and egress from the Barth property to a public street in accordance with Exhibit E. Rigtrup and Barth hereby irrevocably release, relinquish and permanently abandon any prescriptive rights and/or right of adverse possession they may have against Henderson by virtue of the fact that the existing gravel road meanders over the Henderson property. Barth agrees to dedicate to City of Renton along his frontage of SR900 for the tr Cr purpose of constructing a sidewalk, improved road width and associated rock walls, in accordance with Exhibit F. O p8) In conjunction with the improvements to be constructed on SR900, it is anticipated that Henderson will construct a rock wall along the South side of Barth's property. Adjacent to the wall, OD Henderson agrees to build a 6' cedar fence. (0 9) Barth hereby grants to Henderson, City of Renton, and the State of Washington, slope easements as may be required along the frontage of SR900 (Sunset Highway) necessary to install the improvements required by the City of Renton in conjunction with the development of Summerwind. 10) The obligation of Henderson to perform pursuant to this agreement is conditioned upon his receipt of preliminary plat approval and approved plans and specifications from the City of Renton subject to such conditions as are acceptable to Henderson in its sole opinion. 11) This agreement constitutes the entire agreement between the parties hereto concerning the subject herein, and there are no other covenants, . agreements, promises, terms, provisions, conditions, undertakings or understandings, either oral or written, between the parties hereto concerning the subject matter of this agreement, other than those herein set forth. No subsequent alteration, amendment, change, deletion or addition to this agreement shall be binding upon the parties hereto unless in writing and signed by all parties hereto. 12) All of the provisions of this agreement are hereby made binding upon their personal representative, heirs, successors or assigns of all parties hereto. 13) Time is of the essence of this agreement. 14) If any provision hereof, for any reason, is unenforceable or inapplicable, the other provisions hereof shall remain in full force and effect in the same manner as if such unenforceable or inapplicable provision had never been contained herein. 15) This agreement may be executed in any number of counterparts, each of which, for all purposes, shall be deemed to be an original and all of which are identical. i6) This agreement shall be construed under, and in accordance with, the laws of the State of Washington. 17) The parties hereto acknowledge that each party understands, has reviewed and approved this agreement and that the normal rule of construction to the effect that any ambiguities are to be resolved against the drafting party shall not be employed in STATE OF WASHINGTON COUNTY OF KING On this qik day of , A.D. 190' , before me the undersigned, a Notary Public in and for the State of Washington, duly commissioned and sworn personally appeared Charles L.
