HomeMy WebLinkAboutORD 6033CITYOFRENTON,WASHINGTONORDINANCENO.6033ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,REPEALINGANDREPLACINGCHAPTER2-7OFTHERENTONMUNICIPALCODE,ESTABLISHINGTHERENTONEQUITYCOMMISSION,PROVIDINGFORSEVERABILITY,ANDESTABLISHINGANEFFECTIVEDATE.WHEREAStheCityofRentonestablishedanAdvisoryCommissiononDiversitytoaddressgeneralpracticesofdiscrimination;andWHEREAS,ithasbeendeterminedthattheAdvisoryCommissiononDiversitydoesnotmeetthefullneedsforequityandinclusionintheCity;andWHEREAS,theCityhasundertakenayear-longefforttoidentifyhowtoimproveequityandinclusioninameaningfulandon-goingwayincludingholding11meetingswithcommunitymembersreflectingthediversityofRentontoseektheirinput;andWHEREAS,theCityproposestheformationofanEquityCommissiontoaddressthefullneedsofequityandinclusioninalignmentwiththeRentonMissionandBusinessPlan;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.AllportionsoftheRentonMunicipalCodeinthisordinancenotshowninstrikethroughandunderlineeditsremainineffectandunchanged.SECTIONII.Chapter2-7oftheRentonMunicipalCodeisrepealedinitsentiretyandreplacedasshownonExhibitA,attachedheretoandincorporatedbythisreference.SECTIONIII.Ifanysection,subsection,sentence,clause,phraseorworkofthisordinanceshouldbeheldtobeinvalidorunconstitutionalbyacourtorcompetentjurisdiction,1 ORDINANCE NO. 6033 such invalidity or unconstitutionality thereof shall not affect the constitutionality of any other section, subsection, sentence, clause, phrase or word of this ordinance. SECTION IV. This ordinance shall be in full force and effect thirty {30) days after publication of a summary of this ordinance in the City's official newspaper. ORDINANCENO.6033CHAPTER7RENTONEQUITYCOMMISSIONSECTION:2-7-1:DeclarationofPolicy2-7-2:CreationofRentonEquityCommission2-7-3:DutiesandPowersOfCommission2-7-4:AppointmentandMembers2-7-5Compensation2-7-6SelectionProcess2-7-7:AppointmentofSubcommittees2-7-8:Investigations,PublicHearings,AndResearch2-7-9:Procedure,Meetings,AndInterpretation2-7-10:CityCouncilReview2-7-1DECLARATIONOFPOLICY:TheCityCouncilherewithfindsthatallformsofprejudiceandthegeneralpracticeofdiscriminationagainstanyindividual,group,ororganizationbyreasonofrace,color,creed,nationalorigin,age,sex,genderidentityandexpression,thepresenceofanysensory,mentalorphysicaldisability,ormaritalstatushaveadetrimentaleffectonthepublicwelfareandwellbeing.ToeliminatesuchprejudiceanddiscriminationaninstrumentalityshouldbeestablishedthroughwhichtheemployeesandofficialsoftheCitymayobtainadviceandassistanceusingtheRentonEquityLenstoidentifyandaddressinequitiesinordertoeliminateracial,economic,andsocialbarriersidentifiedinCityprograms,servicesandpolicies.TheCityCouncilfurtherfindsthatitwouldbeintheinterestsofallcitizensoftheCityofRentontoincludeinitsMissionandBusinessPlantheimportanceofbuildinganinclusive,informed,andhate-freecitywithequitableoutcomesforallinsupportofsocial,economic,andracialjustice.Wheneverawordisusedherein,thedefinitiongiventothatwordshallbethatofRCW49.60.040(Definitions)whichisincorporatedhereinasiffullysetforth.4 ORDINANCENO.60332-7-2CREATIONOFRENTONEQUITYCOMMISSION:ThereisherebycreatedtheRentonEquityCommissioninfurtheranceofthegoalsidentifiedintheDeclarationofPolicy.2-7-3DUTIESANDPOWERSOFCOMMISSION:DutiesandpowersoftheRentonEquityCommissionareintendedtoadvanceequityandinclusioninsupportoftheCity’sgoaltobuildaninclusive,informed,andhate-freecitywithequitableoutcomesforallinsupportofsocial,economic,andracialjustice.TheRentonEquityCommissionshallhavethepoweranddutyto:A.AtrequestofCitystafforofficials,reviewCitypractices,policies,orproceduresundertheirauthoritytoproviderecommendationstotherequestor.B.RentonEquityCommissionrecommendationswillbebasedonanalysisofhoworwhetherthepractice,policy,orproceduremaytendtocreateorsupportinequity,includingwhatcommunityorcommunitiesmaybeimpacted,andhowthoseimpactsmayemerge.C.RentonEquityCommissionrecommendationswill,totheextentpossible,providespecificactionstoresolvetheidentifiedinequities.D.TheRentonEquityCommissionwillprovideanannualreporttotheCouncilongoals,outcomes,andrecommendationsforfuturegoalstobeincludedinthereportdescribedinSection2-7-10(CityCouncilReview).TheCommissionwillprovideanannualreporttotheCouncilongoals,outcomes,andrecommendationsforfuturegoals,tobeincludedinthereportdescribedinSection2-7-10(CityCouncilReview).5 ORDINANCENO.6033E.Withinthefirstsix(6)monthsofformation,theRentonEquityCommissionshalldevelopaMission,Vision,andBy-LawsincludingelectionsofofficersasneededtofurthermanageitsoperationsaccordingtothetermsofthisChapter.2-7-4APPOINTMENT,TERM,ANDMEMBERSHIP:TheRentonEquityCommissionwillconsistofnine(9)membersappointedbytheMayor,andconfirmedbyCityCouncilasfollows:A.Atthetimeofinitialappointment,three(3)membersshallbeappointedforone(1)year;three(3)membershailbeappointedfortwo(2)years;three(3)membersshallbeappointedforthree(3)years.Attheexpirationoftheinitialterm,three(3)membersshallbeappointedeachyearforthree(3)-yearterms.B.TermsshallbefromJanuary1oftheappointmentyear,throughDecember31ofthetermexpirationyear.C.MembershipshouldreflectthediversityoftheCityincludingbutnotlimitedtoethnicity,race,age,gender,faith,genderidentityandexpression,andprofession.DuetothesizeoftheRentonEquityCommission,itisunderstoodthatitispossiblethatnoteverygroupmayberepresented.D.Membersshall,fromthetimeoftheirappointmentandconfirmationthroughtheirterm,bearesidentof,orbusinessownerin,theCityofRentonandabletoattendmeetingsasnecessary.iftheynolongerresideorhaveabusinessinRenton,theyforfeittheirmembershipintheRentonEquityCommissionasofthedateoftheirmove.E.Applicantsforappointmentshallhaveademonstratedcommitmenttoequity.6 ORDINANCENO.6033F.Atleastonemembershallbea“youth”memberbetweentheagesofeighteen(18)andtwenty-five(25)atthetimethememberisconfirmedintheirappointment.G.NosittingCityCouncilmembershallbeamemberoftheRentonEquityCommission;ifaRentonEquityCommissionmemberiselectedorappointedtoCityCouncil,theyshallforfeittheirmembershipontheRentonEquityCommissioneffectiveatthedateoftheirswearing-inasaCityCouncilmember.NothinginthissectionisintendedtodiscourageformerCityCouncilmembersfromapplyingforappointmentsolongastheymeetotherappointmentrequirements.H.NocurrentCityemployeeorconsultantshallbeamemberoftheRentonEquityCommission;ifaRentonEquityCommissionmemberbecomesemployedorcontractedbytheCity,theyshallforfeittheirmembershipontheRentonEquityCommissioneffectiveontheirfirstdayofemploymentorcontractwiththeCity.NothinginthesectionisintendedtodiscourageformerCityemployeesorconsultantsfromapplyingforappointmentsolongastheymeetotherappointmentrequirements.I.AmajorityofthemembersappointedandconfirmedshallconstituteaquorumforthepurposeofconductingthebusinessoftheRentonEquityCommission.2-7-5COMPENSATION:InalignmentwithotherCityboards/commissions/committees,therewillbenocompensationforservingontheRentonEquityCommission2-7-6APPOINTMENTPROCESS:TheMayorshalldevelopandpostaprocedurebywhichinterestedRentonresidentsorbusinessownersmayapplyformembershipontheRentonEquityCommission.Theprocedureshallinclude,ataminimum:7 ORDINANCENO.6033A.Publicnoticecallingforapplicants;andB.Provisionforinterviewprotocolsforallapplicants.2-7-7APPOINTMENTOFSUBCOMMITTEES:AmajorityofthemembersoftheRentonEquityCommissionmaynamesuchsubcommitteeorsubcommittees,asinitsjudgment,willaidineffectuatingthepurposeofthisChapterandmayempoweranysuchsubcommitteetoreviewpolicies,practices,andproceduresandadvisethefullRentonEquityCommissionregardingitsfindingsonequityissuesfortheRentonEquityCommissiontotakeactionwithinthepurviewofthisChapter.2-7-9PROCEDUREANDMEETINGS:TheprovisionsofthisChaptershallbeconstruedfortheaccomplishmentofthepurposessetforthinthisChapter.Nothingcontainedhereinshallbedeemedtoamend,repeal,ormodifyanyoftheprovisionsofanycivilrightslaworanyotherlawofthefederalorstategovernment,oranyotherprovisionsofthisCoderelatingtodiscriminationbecauseofrace,color,creed,nationalorigin,age,sex,sexualorientation,thepresenceofanysensory,mentalorphysicaldisability,ormaritalstatusasdefinedinthisChapter.A.RentonEquityCommissionmemberswillreceivetrainingonhowtousetheRentonEquityLens,andforcompliancewiththeOpenPublicMeetingsActandthePublicRecordsActwithinninety(90)daysoftheirappointmentonconfirmation,andeverytwo(2)yearsthereafter.B.ACitystaffpersonwillbeassignedaspartoftheirregulardutiestoprovideadministrativesupporttotheRentonEquityCommission.1.AdministrativesupportwillincludebutnotbelimitedtoretainingrecordsasrequiredunderRCW42.56(PublicRecordsAct),ensuringcompliancewithRCW42.30(OpenPublic8 ORDINANCENO.6033MeetingsAct),andprovidingcoordinationasneededwithotherCitystafftoprovidepolicies,procedures,practicestotheRentonEquityCommissionandtofacilitatepresentationsonmaterialstotheRentonEquityCommission.2.ThestaffpersonwillensurethatCitySubjectMatterExpertsareavailabletobriefCommissionmembersonitemspertinenttothepractice,policy,orprocedureunderreview.3.ThestaffpersonwillalsopreparerecommendationsoftheRentonEquityCommissionforpresentationtoCitystaffand/orelectedofficials.C.Membersmay,fromtimetotime,participatein“townhall”orsimilarmeetingsopentothepublic,inordertohelpanalyzeandproviderecommendationsonpolicy,procedures,andpractices.Anysuchmeetingswillbereviewedforcompliancewithapplicablepublictransparencyandrecordsretentionrequirements.D.TheRentonEquityCommissionmayrequestinformationasneededfromothercommunitygroupsincluding,butnotlimitedto,theMayor’sInclusionTaskforce,LatinoForum,Vietnamese/ChineseForum,AfricanAmericanPastoralGroup,RentonPoliceAdvisoryCommittee,etc.E.Memberswhohavemorethanthree(3)unexcusedabsencesmayberemovedbyactionoftheMayor.2-7-10CITYCOUNCILREVIEW:TheRentonEquityCommissionshallsubmituntotheCityCouncil,byJanuary31stofeachyear,asummaryofallactionstakenbytheRentonEquityCommission,includinganalysisofpolicies,programs,services,andproceduresandrecommendationstherefrom,duringtheprecedingyear9 ORDINANCENO.6033sothattheCityCouncilmayfullyreviewthemannerinwhichtheRentonEquityCommissionhasimplementedandenforcedtheprovisionsofthisChapter.10
