PUBLIC HEARING: After reviewing the Development Services Report, examining available information on file with the application, field checking the property and surrounding area;the Examiner conducted a public hearing on the subject as follows: MINUTES The following minutes are a summary of the August 25, 1998 hearing. The legal record is recorded on tape. The hearing opened on Tuesday,August 25, 1998, at 10:10 a.m. in the Council Chambers on the seventh floor of the Renton City Hall. Parties wishing to testify were affirmed by the Examiner. King County seeks a conditional use permit to renovate and expand a maintenance and maintenance annex building which are located on the south central portion of the King County Reclamation Plant property. As a result of previously enlarging the King County Maintenance Building Addition File No.: LUA-98-116,CU-H August 31, 1998 Page 2 treatment plant,there is a need for increased maintenance and operations day room areas. The existing maintenance building is approximately 19,070 square feet and it is proposed to be enlarged by 375 square feet to expand the day room. The maintenance building annex is 6,890 square feet and it would be expanded by 430 square feet to enlarge the operations room. These buildings are northwest of the settling tanks. In addition a canopy would be constructed at the west end of the maintenance annex building to protect electric carts on the site. There is also a second canopy at the employee shelter that would be provided in the vicinity of the fueling station. Both canopy shelter areas are already paved. The applicant is also proposing renovations to the buildings' HVAC,plumbing and electrical systems. The subject proposal would not expand the capacity or operations of the reclamation plant,nor would it result in additional employment. Therefore,there is no additional parking proposed. King County Department of Natural Resources Waste Water Treatment Division issued a SEPA addendum to the Final Environmental Impact Statement on May 28, 1998. There were no mitigation measures to this proposal. The subject site is located within the Employment Area-Valley(EAV)of the Comprehensive Plan(CP). There are no EAV policies which directly pertain to this plant or to the subject proposal. The utilities elements support recognition and continuation of the existing facility and encourage coordination between the regional waste water agency and the City. The subject site is zoned P-1 (Public Use)and public utility facilities are permitted with approval of a conditional use permit. This proposal meets the setback and height requirements of the P-1 zone. The proposed expansions are relatively insignificant to the size of the existing buildings on site,are located on the interior of the property,and would not be visible outside the site. There would be no noise or light glare impacts associated with the expansion of the day rooms or operations rooms. There is no landscaping proposed as part of this project; however,Metro has a master landscape plan which they are proceeding with at this time. Staff would recommend approval of the maintenance building additions with no conditions of approval. Joe Fernandes,King County, 1200 Monster Road SW,Renton,Washington 98055,applicant representative herein,responded that most of the perimeter portion of the landscaping plan has been implemented. At the present time there is a liquid stream improvement contract which will be completed in August of 1999. The internal landscaping plan is proposed to begin with construction in October of 1999, and will take approximately one year to complete. The Examiner called for further testimony regarding this project. There was no one else wishing to speak,and no further comments from staff. The hearing closed at 10:25 a.m. FINDINGS.CONCLUSIONS&DECISION Having reviewed the record in this matter,the Examiner now makes and enters the following: FINDINGS: 1. The applicant,King County,by Joe Fernandes,filed a request for approval of a Conditional Use Permit to enlarge two existing buildings as well as add a canopy to one of those existing buildings and a separate canopy and shelter to a third location in the P-i (Public/QuasiPublic)zone. There was no opposition from the public regarding the subject proposal. 6. The subject site is located at 1200 Monster Road SW. There are three sites. The maintenance and maintenance annex buildings are located in the southwest quadrant of the site. They are located generally west of the circular tanks on the much larger King County Reclamation Plant site(formerly known as the Metro Renton Sewage Treatment Plant). The fueling station located slightly south of the other buildings will be the site of the additional improvements. 7. The entire plant is approximately 95 acres. 8. The applicant proposes adding approximately 375 square feet to the existing maintenance building's existing 19,070 square feet. The addition will be added to the western end of the building. 9. The applicant proposes adding 430 square feet to the existing maintenance annex building. It will be added to the south facade. A canopy would be added to the western edge of the building. 10. The final additions will be located at the fueling station. A canopy will be added as well as an employee shelter. 11. All of the improvements will add approximately 800 square feet of additional impervious surface. The storm drainage system will be able to accommodate any additional storm water. An approximately 3,000 square foot area would be paved for use as a driveway and delivery area. 12. The subject site was annexed to the City with a series of separate actions over a course of approximately 18 years. See Ordinances 1745, 1764, 1928 and 4040. 13. The subject site is currently zoned P-1. While the City has been working to eliminate the P-1 zone and convert properties so classified to more appropriate zones matching other surrounding uses,this site has not been reviewed yet. The current P-1 zone requires any use or expansion to have a conditional use permit. 14. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of employment generating uses,but does not mandate such development without consideration of other policies of the Plan. The Comprehensive Plan also recognizes the need to provide both local and regional utilities. 15. These expansions will not expand plant capacity and will not create any additional employment. They are strictly adjunct maintenance facilities brought about by the previous plant expansions. 16. The applicant has landscaped portions of the site. No additional landscaping is currently proposed. The applicant will be working to implement the overall landscaping plan in the next two years. The applicant for a Conditional Use Permit must demonstrate that the use is in the public interest,will not impair the health, safety or welfare of the general public and is in compliance with the criteria found in Section 4-31-36(C)which provides in part that: a. The proposal generally conforms with the Comprehensive Plan; b. There is a general community need for the proposed use at the proposed location; c. There will be no undue impacts on adjacent property; d. The proposed use is compatible in scale with the adjacent residential uses, if any; e. Parking,unless otherwise permitted,will not occur in the required yards; f. Traffic and pedestrian circulation will be safe and adequate for the proposed project; g. Noise, light and glare will not cause an adverse affect on neighboring property; h. Landscaping shall be sufficient to buffer the use from rights-of-way and neighboring property where appropriate; and i. Adequate public services are available to serve the proposal. The requested conditional use appears justified. 2. The addition of these three or four modest additions will not create any noticeable changes to the plant from those located outside of the complex. These additions will help the current utility operate in an efficient manner and permit appropriate maintenance operations at the complex. The Comprehensive Plan permits utilities in this area. 3. There is a community need for utilities and associated buildings and structures. The proposed changes are relatively minor when looking at the full 95 acre site. If they help the plant function appropriately to its current capacity,there is a justified need for them. 4. As noted,the various modifications are all located in the interior of the plant and will not be visible. They should not have any appreciable impact on the public or nearby properties. 5. All of the additions or changes are low-rise in nature. The low profile will be in scale with surrounding uses. There should be minimal impact on any uses and none on any residential uses. 6. The proposed use will not generate any long term traffic or parking impacts. There will be no increase in the employee population. 7. Except for short term construction noises,there should be no impacts from the use. 8. The proposed use should not create any impacts on public services. Land Use Element - Employment Area-Valley 2. Land Use Element - Public Facilities 3. Utilities Element G. DEPARTMENT ANALYSIS: 1. PROJECT DESCRIPTION/BACKGROUND King County proposes to expand and renovate the Maintenance and Maintenance Annex buildings located on the south portion of the King County Reclamation Plant property. As a result of previously enlarging the treatment plant there is a need for increased space for maintenance operations and day room areas. The existing 19,070 s.f. Maintenance Building is proposed to be enlarged by 375 s.f. to expand the employee day room. The Maintenance Building Annex is 6,890 s.f. and it would be expanded by approximately 430 s.f. to enlarge the operations room and day room. In addition, a canopy would be constructed at the west end of the building to protect electric carts from the elements. A second canopy and employee shelter would be provided in the vicinity of the fueling station. Both areas where the canopies and shelter are proposed are already paved. With the improvements of both buildings, impervious surfaces would be increased by approximately 800 square feet. Renovations of the buildings would include replacing the HVAC, and plumbing and electrical systems. The subject proposal would not expand the capacity or operations of the Reclamation Plant. The expansions of the existing buildings would not result in additional employment and therefore no additional parking is proposed. ENVIRONMENTAL REVIEW King County Department of Natural Resources, Wastewater Treatment Division, as lead agency, issued a SEPA Addendum to the Final Supplemental Environmental Impact Statement for the Metro Plant At Renton Phase Ill Enlargement on May 28, 1998. There is no comment/appeal period for addenda. 3 COMPLIANCE WITH ERC MITIGATION MEASURES Not applicable. 4. STAFF REVIEW COMMENTS Representatives from various city departments have reviewed the application materials to identify and address site plan issues from the proposed development. These comments are contained in the official file, and the essence of the comments has been incorporated into the appropriate sections of this report and the Departmental Recommendation at the end of the report. 5. CONSISTENCY WITH CONDITIONAL USE CRITERIA Section 4-31-36 lists 11 criteria that the Hearing Examiner is asked to consider, along with all other relevant information, in making a decision on a Conditional Use application. These include the following: (5A) CONSISTENCY WITH THE COMP. PLAN, ZONING CODE& OTHER ORDINANCES: The proposed use shall be compatible with the general purpose, goals, objectives and standard of the Comprehensive Plan, the Zoning Ordinance and any other plan, program, map or ordinance of the City of Renton. (1) COMPREHENSIVE PLAN LAND USE ELEMENT The subject site is located within the Employment Area-Valley (EAV) Comprehensive Plan designation. There are no EAV policies which pertain to the King County Reclamation Plant or the subject proposal. The subject proposal would not expand the capacity or operations of the Reclamation plant. The Utilities Element includes policies which generally support continuation of the Reclamation Plant operation: Policy U-33. Recognize and continue to allow utility facilities that may have regional significance to located within the City, consistent with the goals and policies of the City of Renton Comprehensive Plan. Policy U-61. Coordinate with the regional wastewater agency and adjacent jurisdictions in the planning and maintenance of regional wastewater systems in and near the City. Public utility facilities are permitted with approval of a conditional use permit. The third enlargement of the Reclamation Plant was approved in 1991. The subject proposal requires a conditional use permit because the code does not have a threshold to allow for expansion of projects allowed under previously approved conditional use permits. Accessory uses in separate buildings also require a conditional use permit. (3) DEVELOPMENT STANDARDS: (a) SIZE OF USE: The P-1 zone has no standard or limitation related to the size of a use. (b) SETBACKS: The Maintenance and Maintenance Annex Buildings are located in the interior of the Reclamation Plant property and therefore required setbacks from property lines would be maintained with the proposed expansions. (c) HEIGHT: The P-1 zone allows a maximum building height of 50 feet. The existing buildings are approximately 12 feet in height and the height would not be expanded with the proposed additions. (d) LOT COVERAGE: No standard listed in P-1 zone. (e) LANDSCAPING: There are no standards listed in the P-1 zone. There is a master landscape plan that was previously approved for the entire King County Reclamation Plant site. (5B) COMMUNITY NEED: There shall be a community need for the proposed use at the proposed location. In the determination of community need, the Hearing Examiner shall consider the following factors, among all other relevant information: (1) THE PROPOSED LOCATION SHALL NOT RESULT IN EITHER THE DETRIMENTAL OVER CONCENTRATION OF A PARTICULAR USE WITHIN THE CITY OR WITHIN THE IMMEDIATE AREA OF THE PROPOSED USE. The proposed building expansions would be insignificant relative to the size of existing buildings and facilities on the site. The building expansions are related to enlarging employee day rooms and would not expand the capacity or operations of the Reclamation Plant. The proposal would not increase the concentration of the existing use within the City or result in a detrimental overconcentration of the particular use on the site. (2) THAT THE PROPOSED LOCATION IS SUITED FOR THE PROPOSED USE. The proposed building expansions are upgrades to existing employee day rooms and therefore the proposed location is suited for the intended use. The buildings are located in the interior of the large Reclamation Plant property. The expansions would not be visible outside the site. The building expansions would not remove existing parking or interfere with circulation or operations of the plant. The following site requirements shall be required: (1) LOT COVERAGE: LOT COVERAGE SHALL CONFORM TO THE REQUIREMENTS OF ZONE IN WHICH THE PROPOSED USE IS TO BE LOCATED. There are no lot coverage standards in the P-1 zone. The proposed building enlargements would be an insignificant expansion relative to the area of existing buildings and operations on the site. (2) YARDS: YARDS SHALL CONFORM TO THE REQUIREMENTS OF THE ZONE IN WHICH THE PROPOSED USE IS TO BE LOCATED. ADDITIONS TO THE STRUCTURE SHALL NOT BE ALLOWED IN ANY REQUIRED YARD. The proposed building expansions comply with the yard/setback requirements of the P-1 zone. (3) HEIGHT: BUILDING AND STRUCTURE HEIGHTS SHALL CONFORM TO THE REQUIREMENTS OF THE ZONE IN WHICH THE PROPOSED USE IS TO BE LOCATED. SPIRES, BELLTOWERS, PUBLIC UTILITY ANTENNAS OR SIMILAR STRUCTURE MAY EXCEED THE HEIGHT REQUIREMENT UPON APPROVAL OF A VARIANCE. BUILDING HEIGHTS SHOULD BE RELATED TO SURROUNDING USED IN ORDER TO ALLOW OPTIMAL SUNLIGHT AND VENTILATION, AND MINIMAL OBSTRUCTION OF VIEWS FROM ADJACENT STRUCTURES. The existing building heights are approximately 12 feet and the heights would not be increased with the subject proposal. There is a 50 foot height limit in the P-1 zone. The buildings are located on the interior of the property and would not obstruct views or sunlight to surrounding buildings. (5D) COMPATIBILITY: The proposed use shall be compatible with the residential scale and character of the neighborhood. (Ord 3599, 1-11-82) The proposed enlargement of buildings would not impact surrounding properties or the neighborhood. There are no residential uses in the vicinity of the site. The subject buildings and proposed expansions are not visible from off-site locations. (5E) PARKING: Parking under the building structure should be encouraged. Lot coverage may be increased to as much as seventy-five percent (75%) of the lot coverage requirement of the zone, in which the proposed use is located, if all parking is provided underground or within the structure. (Ord.3903, 4-22-85) According to the applicant, the proposal does not expand operations of the facility nor generate additional employees. Therefore, no parking is proposed to be added as part of the subject application. The building expansions would not remove any existing parking. HEXRPT.DOG City of Renton P/B/PW Department Preliminary Report to the Hearing Examiner MAINTENANCE BUILDING ADDITION LUA-98-116, CU-H PUBLIC HEARING DATE: AUGUST 25, 1998 Page 7 of 8 (5F) TRAFFIC: Traffic and circulation patterns of vehicles and pedestrians relating to the proposed use and surrounding area shall be reviewed for potential effects on, and to ensure safe movement in the surrounding area. The proposed building expansions would not interfere with existing vehicle or pedestrian circulation on the site. The proposal would not result in additional employees and there would be no increase in trip generation associated with the project. Plan Review staff has not recommended a traffic mitigation fee. (5G) NOISE, GLARE: Potential noise, light and glare impacts shall be evaluated based on the location of the proposed use on the lot and the location of on-site parking areas, outdoor recreational areas and refuse storage areas. Noise levels in the immediate vicinity of the Maintenance Buildings would temporarily increase during construction. There would not be additional noise or light/glare impacts associated with the expansion of the day rooms and operation room. (5H) LANDSCAPING.' Landscaping shall be provided in all areas not occupied by building or paving. The Hearing Examiner may require additional landscaping to buffer adjacent properties from potentially adverse effects of the proposed use. No landscaping is proposed as part of the project. The relatively small expansions of the existing buildings do not trigger any landscape requirements. There is a master landscape plan for the entire Reclamation Plant property. (51) ACCESSORY USES: Accessory uses to conditional uses such as day schools, auditoriums used for social and sport activities, health centers, convents, preschool facilities, convalescent homes and others of a similar nature shall be considered to be separate uses and shall be subject to the provisions of the use district in which they are located. The day rooms and operation room may be considered an accessory use to the overall Reclamation Plant facility. In the P-1 zone, accessory uses in separate buildings are also required to have a conditional use permit. The proposed expansion would not change the existing uses of the buildings. (6J) CONVERSION: No existing building or structure shall be converted to a conditional use unless such building or structure complies, or is brought into compliance, with the provisions of this Chapter. Not applicable to proposal. Approval of a conditional use permit may be conditional upon the provision and/or guarantee by the applicant of necessary public improvements, facilities, utilities, and/or services. The subject site is adequately served by utilities and services. The proposal would not add to demand or impose an undue burden on public improvements, facilities, utilities and services. H. Project Narrative: King County's East Section Reclamation Plant is located at 1200 Monster Road, in Renton. The County owns approximately 95 acres to operate a waste water sewage treatment plant. The Maintenance and Maintenance Annex Buildings which were built over twenty years ago are in need of renovation and upgrade. As a result of enlarging the treatment plant there is a need for increased space for maintenance operations and day room areas. The renovations will include replacing the heating, ventilation, and air conditioning(HVAC) equipment, plumbing and electrical systems, installing new roofing, and upgrading and expanding employee rest and lunch areas(day room). The existing Maintenance Building is proposed to be enlarged by 375 square feet by expanding the day room. The Maintenance Building Annex will be expanded by approximately 430 square feet. This upgrade will enlarge the operations room and day room areas. In addition, a canopy will be constructed at the western end of the building to protect the electric carts from the elements. A second canopy and employee shelter will be provided in the vicinity of the fueling station. Both areas where the canopies and shelter are proposed are already paved. With the improvements of both buildings, impervious surfaces would be increased by approximately 800 square feet. 8. Construction Mitigation Description: Construction of the proposed project will commence in November, 1998 with completion in August, 1999. The majority of work will occur within the envelope's of the buildings. The areas where the enlargement will take place is well graded and will not require hauling off-site. If dust should become a problem, water spraying will be used to control the dust.
