6041CITYOFRENTON,WASHINGTONORDINANCENO.6041ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,AMENDINGSUBSECTIONS4-8-120.CAND4-9-065.0.1OFTHERENTONMUNICIPALCODE,AMENDINGBONUSDENSITYANNUALREPORTINGREQUIREMENTS,PROVIDINGFORSEVERABILITY,ANDESTABLISHINGANEFFECTIVEDATE.WHEREAS,thismatterwasdulyreferredtothePlanningCommissionforinvestigationandstudy,andthematterwasconsideredbythePlanningCommission;andWHEREAS,thePlanningCommissionheldapublichearingonFebruary17,2021,consideredallrelevantmatters,andheardallpartiesinsupportoropposition,andsubsequentlyforwardedarecommendationtotheCityCouncil;andWHEREAS,pursuanttoRCW36.70A.106,onApril27,2021,theCitynotifiedtheStateofWashingtonofitsintenttoadoptamendmentstoitsdevelopmentregulations;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.AllportionsoftheRentonMunicipalCodeinthisordinancenotshowninstrikethroughandunderlineeditsremainineffectandunchanged.SECTIONII.4-8-120.CoftheRentonMunicipalCodeisamendedtoaddanewrowinalphabeticalordertitled,“DocumentationofAffordableHousingExperience&3rdPartyReporting,”withthetitlefollowedbyasuperscript“12,”allasshownintheexcerptofRMC4-8-120.CinAttachmentA.Insuchnewrow,an“X”shallbeplacedinthecolumnsassociatedwith“MasterSitePlan(Overall),”MasterSitePlan(IndividualPhases),”“Plat,Preliminary/BindingSitePlan,”“PUD,Preliminary,”“ShortPlat,Preliminary,”and“SitePlanReview.”Additionally,anewfootnotenumbered12isaddedinsequentialordertoTable4-8-120.CLegend,asshowninthe1 ORDINANCENO.6041excerptof4-8-120.CinAttachmentA.Allotherprovisionsin4-8-120.Cincludingallexistingrowsremaininfullforceandeffect.SECTIONII.Subsection4-9-065.D.1oftheRentonMunicipalCodeisamendedasshownbelow.Allotherprovisionsin4-9-065.Dremainineffectandunchanged.D.BONUSALLOWANCESANDREVIEWCRITERIA:1.AffordableHousing:AtaratioofQonebonusmarket-ratedwellingunitmaybegrantedforeachaffordabledwellingunitconstructedonsite,bonusmarket-ratedwellingunitsmaybegranted7uptothemaximumbonusdensityallowedpursuanttosubsectionD3ofthisSection,MaximumBonusUnitsLprovidedtheminimumnumberrequiredhasbeensatisfied.Affordabledwellingunitsshallconformtothefollowingstandards:a.MinimumNumber:Allprojectsmustconstructatleasttwo(2)affordabledwellingunits.Projectsthatare30unitsorgreatershallconstructatleasttenpercent(10%)ofthetotalunitsintheprojectasaffordable.ab.Duration:AnagreementinaformapprovedbytheCitymustberecordedwiththeKingCountyRecorder’sOfficerequiringaffordablehousingunitsprovidedunderthisSectionremainaffordablehousingforfifty(50)yearsorthelifeofthedevelopment,whicheverisless.Thisagreementshallbeacovenantrunningwiththeland,bindingontheassigns,heirsandsuccessorsoftheapplicanttothesatisfactionoftheCityAttorney.2 ORDINANCENO.6041c.AffordableHousingIncomeLevels:DwellingunitsconditionedasaffordableunderthisSectionshallconformtothedefinitionof“affordablehousing”pursuanttoRMC4-11-010,DefinitionsA.Gd.AffordableUnitConditions:Affordablehousingunitsshallbeprovidedinarangeofsizesandwithfeaturescomparabletomarket-rateunits.Thelow-incomeunitsshallbedistributedthroughoutthedevelopmentandhavesubstantiallythesamefunctionalityastheotherunitsinthedevelopment.e.AnnualReporting:Withinthirty(30)daysafterthefirstanniversaryofissuanceoftheproject’sCertificateofOccupancyandeachyearthereafterforfifty(50)years,theapplicant/ownershallfileanannualreportwiththeAdministrator.ThereportshallcontainsuchinformationastheAdministratormaydeemnecessaryoruseful,andshallataminimumincludethefollowinginformation:i.AcertificationthattheprojecthasbeenincompliancewiththeaffordablehousingrequirementsofthisSectionsincethedatetheCityissuedtheproject’sCertificateofOccupancyandthattheprolectcontinuestobeincompliancewiththerequirementsofthisSection;ii.Abreakdownofthenumberandspecifichousingunitssoldorrentedduringthetwelve(12)monthsendingwiththeanniversarydate,asapplicable,tomeettheaffordablehousingrequirementsofthisSection;3 ORDINANCENO.6041iii.Thetotalsaleorrentalamountofeachaffordablehousingunitforhouseholdssoldorrentedduringthetwelve(12)monthsendingwiththeanniversarydate,asapplicable;iv.Theincomeofeachpurchaserorrenter(atthetimeofpurchaseorrental)ofanaffordablehousingunit,asapplicable;andv.Documentationthatathird-partyentityhasmonitoredtheproiect’scompliancewiththeaffordablehousingrequirementsofthisSection,asapplicable.2.AssistedLivingFacilities:Thedevelopmentshallsatisfythedefinitionof“assistedlivingfacility”pursuanttoRMC4-11-010,DefinitionsA.3.MaximumBonusUnits:Thefollowingtableprovidesthemaximumdensitythatmaybegrantedinapplicablezonesforconformancewitheithertheaffordablehousingorassistedlivingfacilityprovisions:a.AffordableHousingSubjectZonesMaximumDensityCD,UC,CV,30%abovemaximumCO.COR,R-densityordensityallowed14,andRMFviaconditionalusepermitb.AssistedLivingFacilitiesSubjectZonesMaximumDensityRMF,CV,CD,50%abovemaximumCO,COR,anddensityUCR-1,R-10,andUpto18dwellingunitsperR-14netacre4
