6043CITYOFRENTON,WASHINGTONORDINANCENO.6043ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,AMENDINGSUBSECTIONS4-1-190.G.4AND4-1-190.G.6OFTHERENTONMUNICIPALCODE,REVISINGCOLLECTIONOFIMPACTFEESREGULATIONS,PROVIDINGFORSEVERABILITY,ANDESTABLISHINGANEFFECTIVEDATE.WHEREAS,thepurposeofimpactfeesistohavenewgrowthpayaproportionalamountoftheimpactithasontheCityinregardstotransportation,parks,fireandemergencyservices,andschools;andWHEREAS,theimpactfeecodesectionallowsforacredittonewusersofvacantbuildingsuponwhichpreviousimpactfeeshavebeenpaid;andWHEREAS,atsomepointintimetheuseofavacantbuildingeffectivelybecomesanewuseforwhichnocreditshouldbeprovided;andWHEREAS,in2019theCityadoptedatieredapproachtothecreditforwhenthecreditwouldexpire;andWHEREAS,implementationandtrackingthetieredapproachwasdifficult;andWHEREAS,asimplifiedstraightforwardapproachwillfacilitateimprovedimplementation;andWHEREAS,thismatterwasdulyreferredtothePlanningCommissionforinvestigationandstudy,andthematterwasconsideredbythePlanningCommission;andWHEREAS,pursuanttoRCW36.70A.106,onMay3,2021,theCitynotifiedtheStateofWashingtonofitsintenttoadoptamendmentstoitsdevelopmentregulations;and1 ORDINANCENO.6043WHEREAS,thePlanningCommissionheldapublicheatingonMay19,2021,consideredallrelevantmatters,andheardallpartiesinsupportoropposition,andsubsequentlyforwardedarecommendationtotheCityCouncil;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.AllportionsoftheRentonMunicipalCodeinthisordinancenotshowninstrikethroughandunderlineeditsremainineffectandunchanged.SECTIONII.Subsections4-1-190.G.4and4-1-190.G.6oftheRentonMunicipalCodeareamendedasshownbelow.Allotherprovisionsin4-1-190.Gremainineffectandunchanged.G.COLLECTIONOFIMPACTFEES:1.Transportation,Parks,andFireImpactFees:a.Applicability:TheCityshallcollectimpactfees,basedontheratesintheFeeSchedule,fromanyapplicantseekingdevelopmentapprovalfromtheCityforanydevelopmentactivitywithintheCity,whensuchdevelopmentactivityrequirestheissuanceofabuildingpermitorapermitforachangeinuse,andcreatesademandforadditionalpublicfacilities.b.TransportationandParksBasisandAmount:MaximumallowableimpactfeesfortransportationandparksareestablishedbytheapplicableRateStudy.TheratestobechargedbytheCityarelistedintheFeeSchedule.c.FireImpactFeeBasisandAmount:ThemaximumallowablefeesshallbebasedonthefirecapitalfacilitiesplanandtheratestudydevelopedbytheRRFA,approvedbyitsBoard,andadoptedbytheCityaspartofthecapital2 ORDINANCENO.6043facilitieselementoftheCity’sComprehensivePlanandasafireimpactfeeRateStudy.TheratestobechargedarelistedintheFeeSchedule.2.SchoolImpactFees:a.Applicability:TheCityshallcollectimpactfees,basedontheratesintheFeeSchedule,fromallapplicantsseekingdevelopmentapprovalfromtheCityforanyresidentialdevelopmentactivityinthatportionoftheCitylocatedwithineachrespectiveschooldistrict’sboundaries.b.BasisandAmount:ThemaximumallowablefeesshallbebasedonaschoolcapitalfacilitiesplandevelopedbytheappropriateschooldistrictandapprovedbytheSchoolBoard,andadoptedbyreferencebytheCityaspartofthecapitalfacilitieselementoftheCity’sComprehensivePlan.TheratestobechargedarelistedintheFeeSchedule.c.AdjustmentbyCouncil:TheCouncilmayadjustthefees,asitseesfit,totakeintoaccountlocalconditionssuchas,butnotlimitedto,pricedifferentialsthroughouteachrespectiveschooldistrictinthecostofnewhousing,schooloccupancylevels,andthepercentofeachschooldistrict’scapitalfacilitiesbudget,whichwillbeexpendedlocally.d.ClassificationbyDwellingType:Separatefeesshallbecalculatedforsinglefamilyandmulti-familydwellings,andseparatestudentgenerationratesmustbedeterminedbyeachschooldistrictforeachtypeofdwelling.ForpurposesofthisSection,mobilehomesshallbetreatedassinglefamilydwellings;duplexesandaccessorydwellingunitsshallbetreatedasmulti-familydwellings.3 ORDINANCENO.6043e.CreditforTaxContributions:TheformulainAttachmentAtoOrdinance4808providesacreditfortheanticipatedtaxcontributionsthatwouldbemadebythedevelopmentbasedonhistoricallevelsofvotersupportforbondissuesinaschooldistrict.3.ChangesinUseorTenancy:Whenanimpactfeeappliestoachangeofusepermit,theimpactfeeshallbetheapplicableimpactfeeforthelandusecategoryofthenewuse,lessanyimpactfeepreviouslypaidforthelandusecategoryoftheprioruse.IfthepriorusepaidimpactfeesbasedonanIndependentFeeCalculationthatwasapprovedbytheCity,thenewuseshallpaybasedonthenewlandusecategory,lesstheimpactfeepaidbytheprioruseidentifiedintheIndependentFeeCalculation.Forpurposesofthisprovision,achangeofuseshouldbereviewedbasedonthelandusecategoryprovidedintheRateStudythatbestcapturesthebroaderuseofthepropertyunderdevelopment.Changesinuseortenancy,ifconsistentwiththegeneralcharacterofthebuildingorbuildingaggregations(i.e.,“industrialpark,”or“specialtyretail”)shouldnotbeconsideredachangeinusethatissubjecttoanimpactfee.Further,minorchangesintenanciesthatareconsistentwiththegeneralcharacteroftheincludedstructure,building,orprevioususeshouldnotbeconsideredchangesinusesubjecttoanimpactfee.Ifnoimpactfeewaspaidfortheprioruse,theimpactfeeforthenewuseshallbereducedbyanamountequaltothecurrentimpactfeeratefortheprioruse.Vacantbuildingsshallbeassessedasifinthemostrecent4 ORDINANCENO.6043legallyestablisheduseasshownonalocallyownedbusinesslicenseordevelopmentpermitdocuments.4.VacantStructuresorBuildings:Thereisnotalimitonthenumberofyearsasinglefamilydwellingunitisvacanttobeeligibletouseanimpactfeededuction.AfterDecember31,2020,thefollowingapplies:a.Whenanexistingstructureorbuildingorportionthereofhasbeenvacantforlessthantwethree(3)yearsandsix(6)months,theimpactfeeshallbetheapplicableimpactfeeforthelandusecategoryofthenewuse,lessanyimpactfeepreviouslypaidforthelandusecategoryoftheprioruse.i.Ifnoimpactfeewaspaidfortheprioruse,theimpactfeeforthenewuseshallbereducedbyanamountequaltothecurrentimpactfeeratefortheprioruse.b.Whenanexistingstructureorbuildingorportionthereofhasbeenvacantformorethantwo(2)yearsandsix(6)months,butlessthanfive(5)years,theimpactfeeshallbetheapplicableimpactfeeofthenewuse,lessfiftypercent(50%)oftheamountpaidforthelandusecategoryoftheprioruse.i.Ifnoimpactfeewaspaidfortheprioruse,theimpactfeeforthenewuseshallbereducedbyanamountequaltofiftypercent(50%)ofthecurrentimpactfeeratefortheprioruse.e—Whenanexistingstructureorbuildingorportionthereofhasbeenvacantforaperiodoffi.te_three_(53)yearsormore,theimpactfeeshallbetheapplicableimpactfeeforthelanduseofthenewcategory;thereshallnotbea5 ORDINANCENO.6043deductionoftheimpactfeethatwasorwasnotpreviouslypaidforthelandusecategoryoftheprioruse.5.MixedUse:Formixedusedevelopments,impactfeesshallbeimposedfortheproportionateshareofeachlanduse,basedontheapplicablemeasurementintheimpactfeeratesintheCityofRentonFeeSchedule.6.TimingofAssessmentandCollection:Impactfeesshallbedeterminedandpaidatthetimethecompleteapplicationforabuildingpermitorapermitforachangeinuseissubmittedusingtheimpactfeesthenineffect.ImpactfeesshallbedueandpayablebeforeatthetimeofissuanceofabuildingpermitorpermitforachangeofuseisissuedbytheCity.7.DocumentationofCreditRequired:Feepayersallowedcreditspriortothesubmittalofthecompletebuildingpermitapplicationoranapplicationforapermitforachangeofuseshallsubmit,alongwiththecompleteapplication,acopyoftheletterpreparedbytheAdministrator,schooldistrictsuperintendent,orRRFAofficialsettingforththedollaramountofthecreditallowed.Impactfees,asdeterminedaftertheapplicationofanycredits,shallbecollectedfromthefeepayernolaterthanthetimeabuildingpermitorpermitforachangeofuseisissued.8.DeferralforSubdivisions,ShortSubdivisions,andPlannedUnitDevelopments:Anapplicantforresidentialsubdivision,shortsubdivision,orplannedunitdevelopmentmaydeferpaymentofimpactfeesforallofthedwellingunitstobecreatedinthedevelopmentuntiltheearlierofthetimeof6 ORDINANCENO.6043closingofthefirstsaleofasingledetacheddwellingunit,condominiumunit,oramulti-familyresidentialbuildingoreighteen(1$)monthsaftertheissuanceoftheoriginalbuildingpermit,butonlyifbeforerecordingthesubdivisionorshortsubdivision,theapplicant:a.SubmitstotheAdministratorasignedandnotarizeddeferredimpactfeeapplicationandacknowledgementform,whichincludesthelegaldescription,taxaccountnumber,andaddressofeachindividualinthedevelopment;b.Recordsattheapplicant’sexpenseacovenantandlienthatcomplieswiththerequirementsofsubsectionsG9bithroughviiofthisSection;andc.Paystheapplicablenonrefundableadministrativefee.9.DeferralforSingleFamily,Condominium,andMulti-FamilyDwellings:Abuildingpermitapplicantmaydeferpaymentofimpactfeesforasingledetacheddwellingunit,condominiumunit,orallofthedwellingunitsinamultifamilyresidentialbuildinguntiltheearlierofthetimeofclosingofthefirstsaleofasingledetacheddwellingunit,acondominiumunitoramulti-familyresidentialbuildingoreighteen(1$)monthsafterissuanceoftheoriginalbuildingpermit,butonlyifbeforeissuanceofthebuildingpermit,theapplicant:a.SubmitstotheAdministratorasignedandnotarizeddeferredimpactfeeapplicationandacknowledgementformforeachsingledetacheddwellingunit,condominiumunitorallofthedwellingunitsinamulti-familyresidentialbuildingforwhichtheapplicantwishestodeferpaymentoftheimpactfees;and7 ORDINANCENO.6043b.Recordsattheapplicant’sexpenseacovenantandlienintheamountofthedeferredimpactfee(s)andthatincludesthelegaldescription,taxaccountnumber,andaddressofthepropertythat:i.RequirespaymentoftheimpactfeestotheCityattheearlierofthetimeofclosingofthefirstsaleoreighteen(18)monthsafterissuanceoftheoriginalbuildingpermit;andii.Providesthatiftheimpactfeesarepaidthroughescrowatclosingofsale,intheabsenceofanagreementbetweenthebuyerandthesellertothecontrary,theimpactfeesshallbepaidfromtheseller’sproceeds;andiii.Providesthatthesellerbearsstrictliabilityforthepaymentoftheimpactfees;andiv.Requiresthesellerorseller’sagentofpropertysubjecttothecovenantandlientoprovidewrittendisclosureofthecovenantandlientoapurchaserorprospectivepurchaser.DisclosureofthecovenantmustincludetheamountofimpactfeespayableandthatthefeesaretobepaidtotheCitynolaterthantheclosingdate;andv.Makestheapplicantlegallyliableforpaymentoftheimpactfeesifthefeesarenotpaidbytheearlierofthetimeofclosingofthefirstsaleoreighteen(18)monthsafterthebuildingpermithasbeenissued;andvi.Issignedbyallownersofthepropertyaslistedonacurrenttitlereport,withallsignaturesacknowledgedasrequiredforadeed;and$ ORDINANCENO.6043vii.Isjuniorandsubordinatetoonemortgageforthepurposeofconstructionuponthesamerealpropertygrantedbythepersonwhoappliedforthedeferralofimpactfees.10.PaymentMethods:Paymentofimpactfeesdeferredunderthissubsectionshallbemadebycash,escrowcompanycheck,cashier’scheckorcertifiedcheck.11.LienRelease:Uponreceiptofpaymentofimpactfeesdeferredunderthissubsection,theCityshallexecutealienreleaseforeachsingledetacheddwellingunit,condominiumunit,ormulti-familyresidentialbuildingforwhichtheimpactfeeshavebeenreceived.Thepropertyowneratthetimeofthereleaseshallberesponsibleforrecordingthelienrelease.12.ForeclosurebyCity:Ifimpactfeesarenotpaid,inaccordancewiththeprovisionsofthissubsection,theCitymayinstituteforeclosureproceedingsinaccordancewithchapter61.12RCW.13.ForeclosurebyaSchoolDistrict:IftheCitydoesnotinstituteforeclosureproceedingsforunpaidschoolimpactfeeswithinfortyfive(45)daysafterreceivingnoticefromaschooldistrictrequestingthatitdoso,thedistrictmayinstituteforeclosureproceedingswithrespecttounpaidimpactfees.14.RequiredPriortoBuildingPermitIssuance:TheDepartmentshallnotissuetherequiredbuildingpermitorthepermitforthechangeofuseuntiltheimpactfeeshavebeenpaidorthesignedandnotarizeddeferredimpactfee9 ORDINANCENO.6043applicationandacknowledgementformanddeferralfeehavebeenreceivedandacceptedbytheCity.15.NumberofDeferralsLimited:Eachapplicantforasinglefamilybuildingpermit,inaccordancewithhisorhercontractorregistrationnumberorotheruniqueidentificationnumber,isentitledtoannuallyreceivedeferralsunderthissubsectionforthefirsttwenty(20)singlefamilybuildingpermitsissuedbytheCitytothatapplicant.SECTIONIII.Ifanysection,subsection,sentence,clause,phraseorworkofthisordinanceshouldbeheldtobeinvalidorunconstitutionalbyacourtorcompetentjurisdiction,suchinvalidityorunconstitutionalitythereofshallnotaffecttheconstitutionalityofanyothersection,subsection,sentence,clause,phraseorwordofthisordinance.SECTIONIV.CompletelanduseapplicationsthathavebeensubmittedbetweenDecember1andDecember31,2021,shallbepermittedtoclaimimpactfeecreditsbasedonthetimeframesastheyexistpriortotheadoptionofthisordinanceandarenotsubjecttothenewthree-yeartimeframeforcreditsasamendedinthisordinance.SECTIONV.Thisordinanceshallbeinfullforceandeffectfive(5)daysafterpublicationofasummaryofthisordinanceintheCity’sofficialnewspaper.Thesummaryshallconsistofthisordinance’stitle.PASSEDBYTHECITYCOUNCILthis;3thdayofDecember,2021.Jason7th,Cilerk10
