6044CITYOFRENTON,WASHINGTONORDINANCENO.6044ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,AMENDINGSUBSECTIONS4-2-120.A,4-2-120.C.15,AND4-2-120.C.16OFTHERENTONMUNICIPALCODE,CLARIFYINGSETBACKREQUIREMENTSFORFRONTYARDSANDSECONDARYFRONTYARDSWITHINTHECOMMERCIALNEIGHBORHOOD(CN),CENTERVILLAGE(CV),ANDCOMMERCIALARTERIAL(CA)ZONES,PROVIDINGFORSEVERABILITY,ANDESTABUSHINGANEFFECTIVEDATE.WHEREAS,thepurposeoftheproposedcodeamendmentistoreviseRMC4-2-120.A,DevelopmentStandardsforCommercialZoningDesignations,toclarifythesetbackrequirementsforfrontyardsandsecondaryfrontyardswithintheCommercialNeighborhood(CN),CenterVillage(CV),andCommercialArterial(CA)zones;andWHEREAS,currentregulationsallowboththefrontyardandsecondaryfrontyardsetbackswithintheCN,CV,andCAzonestobereducedtozerofeet(0’)throughthesiteplanreviewprocess,providedblankwallsarenotlocatedwithinthereducedsetback;andWHEREAS,withthisOrdinance,theCityseekstoreviseRMC4-2-120.A,DevelopmentStandardsforCommercialZoningDesignations,torevisethesetbackrequirementsforfrontyardsandsecondaryfrontyardswithintheCN,CV,andCAzonesbyamendingtheprovisionthatallowsthesetbacktobereducedtozerofeet(0’)throughthesiteplanreviewprocesstoincludecriteriaforapproval;andWHEREAS,thismatterwasdulyreferredtothePlanningCommissionforinvestigationandstudy,andthematterwasconsideredbythePlanningCommission;andWHEREAS,pursuanttoRCW36.70A.106,onMay3,2021,theCitynotifiedtheStateofWashingtonofitsintenttoadoptamendmentstoitsdevelopmentregulations;and1 ORDINANCENO.6044WHEREAS,thePlanningCommissionheldapublichearingonMay19,2021,consideredallrelevantmatters,andheardallpartiesinsupportoropposition,andsubsequentlyforwardedarecommendationtotheCityCouncil;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.AllportionsoftheRentonMunicipalCodeinthisordinancenotshowninstrikethroughandunderlineeditsremainineffectandunchanged.SECTIONII.Setbacksinsubsection4-2-120.AoftheRentonMunicipalCodeisamendedasshownonAttachmentA.Allotherprovisionsin4-2-120.Aremainineffectandunchanged.SECTIONIII.Subsections4-2-120.C.15and4-2-120.C.16oftheRentonMunicipalCodeareamendedasshownbelow.Allotherprovisionsin4-2-120.Cshallremainineffectandunchanged.15.MaximumSetback:a.Themaximumsetbackmaybemodifiedthroughthesiteplanreviewprocessiftheapplicantcandemonstratethattheproposeddevelopmentmeetsthefollowingcriteria:i.OrientsdevelopmenttothepedestrianthroughmeasuressuchmeasuresasprovidingpedestrianwalkwaysbeyondthoserequiredbytheRentonMunicipalCode(RMC),encouragingpedestrianamenitiesLandsupportingalternativestosingle-occupantvehicle(SOV)transportation;and2 ORDINANCENO.6044ii.Createsalow-scalestreetscapethroughmeasuressuchmeasuresasfosteringdistinctivearchitectureandmitigatingthevisualdominanceofextensiveandunbrokenparkingalongthestreetfront;andiii.Promotessafetyandvisibilitythroughmeasuressuchmeasuresasdiscouragingthecreationofhiddenspaces,minimizingconflictbetweenpedestrianandvehicletraffic,andensuringadequatesetbackstoaccommodaterequiredparkingand/oraccessthatcouldnotbeprovidedotherwise.b.Alternatively,themaximumsetbackrequirementmaybemodifiediftheapplicantcandemonstratethatthecriteriainsubsection15.atheprecedingcriteriacannotbemetbyaddressingthefollowingcriteriabelow.However,allthosecriteriafromsubsection15.athatcanbemetshallbeaddressedinthesitedevelopmentplan.i.Duetofactorsincludingbutnotlimitedtotheuniquesitedesignrequirementsorphysicalsiteconstraintssuchascriticalareasorutilityeasements,themaximumsetbackcannotbemet;orii.Oneormoreoftheabovecriteriawouldnotbefurtheredorwouldbeimpairedbycompliancewiththemaximumsetback;oriii.Anyfunctionoftheusewhichservesthepublichealth,safetyorwelfarewouldbemateriallyimpairedbytherequiredsetback.16.Reserved.MinimumSetback:3 ORDINANCENO.6044a.TheminimumsetbackmaybemodifiedthroughthesiteplanreviewprocessifitcanbedemonstratedtotheAdministrator’ssatisfactionthatthefollowingcriteriaaremet:i.Theperceivedscaleoftheproposedstructurethatiscreatedbythereducedsetbackiscompatiblewiththeabuttingstructuresandthesurroundingneighborhood;andii.TherequiredstreetfrontagelandscapingidentifiedinRMC4-4-070F.1isincreasedtofifteenfeet(15’)alongallpublicstreetfrontageswiththeexceptionofwalkways,driveways,programmedpedestrianplazas,andtheareaofreducedsetback;andiii.Enhancedlandscaping,suchasincreasedcalipersizeoftrees,increasedcontainersizeofshrubs,and/orincreasedquantityordiversityofplantings,isprovidedwithinthepublicright-of-wayonthestreetfrontageabuttingthereducedsetback;andiv.Theprojectincludesapublicartinstallation,subjecttoreviewandapproval,withaminimummonetaryvalueofonepercent(1%)oftheassessedvalueoftheproposedstructure,orwhentheAdministratordeterminesthatitisimpracticaltoinstallpublicartonsite,paymentofafee-in-lieumaybeapprovedinanamountofmoneyapproximatingonepercent(1%)oftheassessedvalueoftheproposedstructure;andv.Thedesignoftheproposedstructurecomplieswithallofthefollowingrequirements:4 ORDINANCENO.6044(a)Backofhousefacilitiessuchaswalk-infreezers,bathrooms,breakrooms,storagerooms,orotherroomsthatdonotcontainwindows,arenotlocatedalonganybuildingfacadethatfrontsapublicstreet;and(b)Floortoceilingtransparentwindowsareprovidedforatleastfiftypercent(50%)ofthegroundfloorbuildingfacadethatfrontsareducedsetback;and(c)Theproposedstructureincludesdesignfeaturessuchasstep-backsofupperlevels,changesinroofplane,andchangesinroofform/slopeinamannerthatservestoreducetheapparentbulkoftheproposedstructure;and(d)Canopiesorsimilardesignfeaturesareprovidedalonganybuildingfacadethatfrontsapublicstreet,withemphasisprovidedtotheprimaryentry;and(e)Structuredparkingisnotlocatedalonganybuildingfacadethatfrontsareducedsetback.b.Alternatively,theminimumsetbackmaybemodifiedthroughthesiteplanreviewprocessifitcanbedemonstratedtotheAdministrator’ssatisfactionthatthereducedsetbackwouldresultintheprotectionandpreservationofPriorityOnetrees,asidentifiedinRMC4-4-130.H.1.b,thatwouldotherwisenotpracticablyberetainedwithoutreductionoftheminimumsetback.SECTIONIV.Ifanysection,subsection,sentence,clause,phraseorworkofthisordinanceshouldbeheldtobeinvalidorunconstitutionalbyacourtorcompetentjurisdiction,5
