HomeMy WebLinkAboutORD 6045CITYOFRENTON,WASHINGTONORDINANCENO.6045ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,AMENDINGSUBSECTION4-3-100.B.1.aOFTHERENTONMUNICIPALCODE,CLARIFYINGTHATCONVERSIONOFANONRESIDENTIALUSETOARESIDENTIALUSEISSUBJECTTOURBANDESIGNREGULATIONS,PROVIDINGFORSEVERABILITY,ANDESTABLISHINGANEFFECTIVEDATE.WHEREAS,thismatterwasdulyreferredtothePlanningCommissionforinvestigationandstudy,andthematterwasconsideredbythePlanningCommission;andWHEREAS,pursuanttoRCW36.70A.106,onMay3,2021,theCitynotifiedtheStateofWashingtonofitsintenttoadoptamendmentstoitsdevelopmentregulations;andWHEREAS,thePlanningCommissionheldapublichearingonMay19,2021,consideredallrelevantmatters,andheardallpartiesinsupportoropposition,andsubsequentlyforwardedarecommendationtotheCityCouncil;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.AllportionsoftheRentonMunicipalCodeinthisordinancenotshowninstrikethroughandunderlineeditsremainineffectandunchanged.SECTIONII.Subsection4-3-100.B.1.aoftheRentonMunicipalCodeisamendedasshownbelow.Allotherprovisionsin4-3-100.Bremainineffectandunchanged.B.APPLICABILITYANDCONFLICTS:1.Applicability:a.ThefollowingdevelopmentactivitiesshallberequiredtocomplywiththeprovisionsofthisSection:1 ORDINANCENO.6045i.Allsubdivisionsincludingshortplats;ii.Allnewstructures;iii.Conversionofvacantland(e.g.,toparkingorstoragelots);iv.Conversionofaresidentialusetoanonresidentialuse,ortheconversionofanonresidentialusetoaresidentialuse;v.Alterations,enlargements,and/orrestorationsofnonconformingstructurespursuanttoRMC4-10-050,NonconformingStructures;vi.Exteriormodificationssuchasfacadechanges,windows,awnings,signage,etc.,shallcomplywiththedesignrequirementsforthenewportionofthestructure,sign,orsiteimprovement.b.AnyoftheactivitieslistedinsubsectionBiaofthisSectionandoccurringinthefollowingoverlayareasorzonesshallberequiredtocomplywiththeprovisionsofthisSection:i.District‘A’:AllareaszonedCenterDowntown(CD).ii.District‘B’:AllareaszonedResidentialMulti-Family(RMF),andassistedlivingandconvalescentcenterswithintheResourceConservation(RC),Residential-i(R-1),Residential-4(R-4),Residential-6(R-6),Residential-8(R-8),Residential-lO(R-10),Residential-14(R-i4),andResidentialManufacturedHomePark(RMH)Zones.iii.District‘C’AllareaszonedUrbanCenter(UC)orCommercialOfficeResidential(COR).2 ORDINANCENO.6045iv.District‘D’:AllareaszonedCenterVillage(CV),CommercialArterial(CA),CommercialNeighborhood(CN),orCommercialOffice(CD),exceptforthosepropertiesincludedintheAutomallDistrictandusedforsmallvehiclesalesorasecondaryuseidentifiedinRMC4-3-040C1,UsesPermittedintheRentonAutomallDistrict.2.Conflicts:WherethereareconflictsbetweenthedesignrequirementsinsubsectionEofthisSectionandothersectionsoftheRentonMunicipalCode,theregulationsofthisSectionshallprevail.SECTIONIII.Ifanysection,subsection,sentence,clause,phraseorworkofthisordinanceshouldbeheldtobeinvalidorunconstitutionalbyacourtorcompetentjurisdiction,suchinvalidityorunconstitutionalitythereofshallnotaffecttheconstitutionalityofanyothersection,subsection,sentence,clause,phraseorwordofthisordinance.SECTIONIV.Thisordinanceshallbeinfullforceandeffectfive(5)daysafterpublicationofasummaryofthisordinanceintheCity’sofficialnewspaper.Thesummaryshallconsistofthisordinance’stitle.PASSEDBYTHECITYCOUNCILthis13thdayofDecember,2021.Jaso/A.SethityClerkAPPROVEDBYTHEMAYORthis;3thdayofDecember,2021.CArrvone,Mayor ORDINANCENO.6045Approvedastoform:ShaneMoloney,CityAttorneyDateofPublication:12/16/2021(Summary)ORD:2183:10/20/214
