6046CITYOFRENTON,WASHINGTONORDINANCENO.6046ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,AMENDINGSUBSECTIONS4-4-080.A.7AND4-4-0$0.F.10.d,SECTION4-9-030,ANDTHEDEFINITIONOF“DWELLINGUNIT,ACCESSORY”INSECTION4-11-040OFTHERENTONMUNICIPALCODE,AMENDINGACCESSORYDWELLINGUNIT(ADU)REGULATIONS,PROVIDINGFORSEVERABILITY,ANDESTABLISHINGANEFFECTIVEDATE.WHEREAS,thismatterwasdulyreferredtothePlanningCommissionforinvestigationandstudy,andthematterwasconsideredbythePlanningCommission;andWHEREAS,pursuanttoRCW36.70A.106,onJuly30,2021,theCitynotifiedtheStateofWashingtonofitsintenttoadoptamendmentstoitsdevelopmentregulations;andWHEREAS,thePlanningCommissionheldapublichearingonAugust18,2021,consideredallrelevantmatters,andheardallpartiesinsupportoropposition,andsubsequentlyforwardedarecommendationtotheCityCouncil;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.AllportionsoftheRentonMunicipalCodeinthisordinancenotshowninstrikethroughandunderlineeditsremainineffectandunchanged.SECTIONII.Subsection4-2-080.A.7oftheRentonMunicipalCodeisamendedasfollows:7.Accessorydwellingunits(ADUs)maybeallowedasanaccessoryusetoadetachedsingle-familydwellingoraprincipalbuildingactivelyoperatedwithanon-residentialusebyareligiousinstitutionorsocialserviceorganization.ADUs1 ORDINANCENO.6046shallbeconsistentwiththearchitecturalcharacteroftheprimaryresidentialstructure.UnlessowneroccupancyisnotrequiredasaresultoftheeConditionali+UsepPermitprocess(seeRMC4-9-030.H),priortotheissuanceofbuildingpermitsthepropertyownershall(a)fileanaffidavitwiththeCityaffirmingthattheownerwillliveonsite,occupyingtheprimarydwellingorADU;and(b)recordanoticeonthepropertytitlethattheownerwilloccupythesite,andbearingthenotarizedsignatureofallpropertyownerslistedonthepropertytitlea.n4includingandwhichincludesataminimum:thelegaldescriptionoftheproperty,acopyoftheapprovedsite/floorplan,andtheapplicabilityoftherestrictionsandlimitationsregardingADUsinRMCTitleIV.WhenADUsareproposedasaccessoryusestonon-residentialuses,thefollowingshallapply:a.AllproposalsshallrequiteaConditionalUsePermit(seeRMC4-9-030.i)priortobuildingpermitissuance.b.ThemaximumnumberofADUsaccessorytoanallowednonresidentialuseshallnotexceedamaximumofthree(3)units.AggregateADUsizeislimitedtothreethousand(3,000)squarefeetandonethousand(1,000)squarefeetperunit.c.ExceptforwhenanADUlocationisproposedintherearyardoftheprincipalbuilding,thesetbackrequirementadoptedforsingle-familyresidentialdevelopmentshallapply.2 ORDINANCENO.6046d.Ifaprimaryresidentialstructureispresentorproposed,ADUdevelopmentshalladheretoRMC4-2-110.C.SECTIONIII.Therowentitled“Accessorydwellingunit”inResidentialUsesOutsideofCenterDowntownZoneinsubsection4-4-080.F.10.doftheRentonMunicipalCodeisamendedasshownintheexcerptof4-4-080.F.10.d,below.Allotherprovisionsin4-4-080.F.10.dremainineffectandunchanged.RESIDENTIALUSESOUTSIDEOFCENTERDOWNTOWNZONE:AccessoryWhenaccessorytoasingle-familyresidence,1perunitisrequired.Adwellingunit:maximumof2perunitisallowed.ADUsaccessorytonon-residentialusesareexemptfromadditionalparkingwhencurrentparkingcapacityexceedstheminimumparkingrequirementfortheprimaryuse,otherwise1perunitisrequired.ADUslocatedwithin1/4mileofamasstransitfacility,asdefinedinRMC4-2-080,shallbeexemptfromoff-streetparkingrequirements.SECTIONIV.Section4-9-030oftheRentonMunicipalCodeisamendedtoaddanewsubsection4-9-030.1,toreadasshownbelow.Thesubsectioncurrentlycodifiedas4-9-030.1shallbere-letteredas4-9-030.Jandthesubsectioncurrentlycodifiedas4-9-030.Jshallbere-letteredas4-9-030.K,respectively.Allotherprovisionsin4-9-030shallremainineffectandunchanged.I.DECISIONCRITERIA—ACCESSORYDWELLINGUNIT(ADU)ANDNON-RESIDENTIALUSESInadditiontothecriteriainsubsectionDofthisSection,DecisionCriteria,thefollowingcriteriainsubsections1.1through1.2ofthisSectionapplytotheuseofADUswhenaccessorytoaprincipalbuildingactivelyoperatedwithanon-residentialusebyareligiousinstitutionorsocialserviceorganization.3 ORDINANCENO.6046Ifthepropertyownerisunableorunwillingtofulfilltherequirementsbelow,orifachangeofuseisproposedthatwouldresultinnonconformity,thentheownerwillremovethosefeaturesoftheaccessorydwellingunitthatmakeitadwellingunit;asdeterminedbytheAdministrator.1.Affordability:ADUsmustbereservedforincome-restrictedaffordablehousing,asdefinedbyRMC4-11-010,Definitions,A.Theaffordablehousingdevelopmentmustbeusedexclusivelyforaffordablehousingpurposesforatleastfifty(50)yearsorthelifeofthedevelopment.2.Notice(s)onPropertyTitle:Theapplicant/propertyownershallberequiredtorecordthefollowingnoticesonthepropertytitle:a.Summarydetailingthetermsoftheaffordabilityrequirement,asdirectedbytheAdministrator.b.Compliancewithallapplicablefairhousingregulationsandantidiscriminationlaws,includingbutnotlimitedtothefederalFairHousingActandWashingtonStateHumanRightsCommissionregulations,andtenantprotectionordinancesshallbefollowed.SECTIONV.Thedefinitionof“DwellingUnit,Accessory”insection4-11-040oftheRentonMunicipalCodeisamendedasshownbelow.Allotherdefinitionsin4-11-040remainineffectandunchanged.DWELLINGUNIT,ACCESSORY:Anindependentsubordinatedwellingunitthatislocatedonthesamelot,butnotwithin,eitherasingle-familydwellingora4
