6047CITYOFRENTON,WASHINGTONORDINANCENO.6047ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,AMENDINGSECTiON4-4-040OFTHERENTONMUNICIPALCODE,REVISINGFENCE,HEDGE,ANDRETAININGWALLREGULATIONS,PROVIDINGFORSEVERABILITY,ANDESTABLISHINGANEFFECTIVEDATE.WHEREAS,thesubjectcodesection,RMC4-4-040,Fences,Hedges,AndRetainingWalls,regulatesfences,hedges,andretainingwalls,particularlyinfrontyardsandinyardsabuttingpublicrights-of-way,inordertopromotepublicsafety,maintainorcreatepleasingaesthetics,encouragethefeelingofspaciousnessalongstreets,andreduceconflictinginterestsbetweenabuttingpropertyowners;andWHEREAS,currentregulationscontainconflictswithregardtocodeapplicationanddonotprovidesufficientstandardstomitigateadverseimpactscausedbyfences,hedges,andretainingwalls;andWHEREAS,withthisOrdinance,theCityprimarilyseekstoreviseRMC4-4-040toclarifythatfences,hedges,andretainingwallsareregulatedbyzone,ratherthanbyuse,aswellasensurefences,hedges,andretainingwallswithincommercialandindustrialzonesareconsistentwiththeaestheticobjectivesintendedbythecodesection;andWHEREAS,thisOrdinanceresolvesandnullifiesCodeInterpretation,Cl-154;andWHEREAS,thismatterwasdulyreferredtothePlanningCommissionforinvestigationandstudy,andthematterwasconsideredbythePlanningCommission;andWHEREAS,pursuanttoRCW36.70A.106,onMay3,2021,theCitynotifiedtheStateofWashingtonofitsintenttoadoptamendmentstoitsdevelopmentregulations;and1 ORDINANCENO.6047WHEREAS,thePlanningCommissionheldapublichearingonMay19,2021,consideredallrelevantmatters,andheardallpartiesinsupportoropposition,andsubsequentlyforwardedarecommendationtotheCityCouncil;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.AllportionsoftheRentonMunicipalCodeinthisordinancenotshowninstrikethroughandunderlineeditsremainineffectandunchanged.SECTIONII.Section4-4-040oftheRentonMunicipalCodeisamendedasfollows:4-4-040FENCES,HEDGES,ANDRETAININGWALLS:A.PURPOSE:Theseregulationsareprimarilyintendedtoregulatethematerialandheightoffences,hedges,andretainingwalls,particularlyinfrontyardsandinyardsabuttingpublicrights-of-way,inordertopromotetrafficandpublicsafetyandtomaintainorcreateaestheticallypleasingneighborhoods.Theregulationsarealsointendedtoprovideandmaintainadequatesightdistancesalongpublicrightsofwayatintersections,encouragesafeingressandegressfromindividualproperties,encouragethefeelingofspaciousnessalongneighborhoodstreets,promotecrimepreventionthroughenvironmentaldesign,andreduceconflictinginterestsbetweenabuttingpropertyowners.B.APPLICABILITY:2 ORDINANCENO.60471.NeworReplacementFences,Hedges,andRetainingWalls:ThestandardscontainedinthisSectionshallapplytoallproposalsforneworreplacementfences,hedges,andretainingwalls.12.Exceptions:TheprovisionsandconditionsofthisSectionregulatingheightanddesignoffences,retainingwalls,orbarrierstosurroundandenclosepublicsafetyinstallations,transportationfacilities,waterways,stormdrainagefacilities,schoolgrounds,publicplaygrounds,privateorpublicswimmingpools,andsimilarinstallationsandimprovementsarenotapplicableifrequiredbylaw.3.UrbanSeparatorOverlay:Fences,hedges,andretainingwallswithintheurbanseparatoroverlayarealsosubjecttorequirementsofRMC4-3-110,UrbanSeparatorOverlayRegulations.4.CityMayRequireModification:Whereatrafficvisionhazardiscreatedorexiststhatendangerspedestrianand/orvehicularsafety,theCitymayrequireamodificationtotheheightlimitationsandlocationoffences,hedgesorretainingwallstoincreaseorenhancesafety.45.PermitRequired:a.Fences:Afencetallerthansevenfeet(7’)shallrequireabuildingpermitorawrittenexemptionfromtheBuildingOfficial.b.RetainingWalls:Aretainingwallthatisfourfeet(4’)ortaller,asmeasuredbytheverticaldistancefromthebottomofthefootingtothefinishgradeatthetopofthewall(i.e.,notmeasuredbyexposedretainingwallheight),shallrequireabuildingpermit.Thisdeterminationdoesnotaccountforother3 ORDINANCENO.6047factorsthatmaycauseabuildingpermittoberequiredforaretainingwall(e.g.,theadditionofasurchargeorfence).C.GENERALFENCE,HEDGE,ANDRETAININGWALLSTANDARDS:1.Height—MethodofMeasurement:a.Fences:Theheightshallbemeasuredfromthetopelevationofthetopboardrailorwiretotheground.Incaseswhereawallisusedinsteadofafence,heightshallbemeasuredfromthetopsurfaceofthewalltothegroundonthehighsideofthewall.i.GradeDifferences:Wherethefinishedgradeisadifferentelevationoneithersideofafencetheheightmaybemeasuredfromthesidehavingthehighestelevation.ii.FencesonBerms:Abermshallnotbeconstructedwithafenceonitunlessthetotalheightofthebermplusthefenceislessthanthemaximumheightallowableforthefenceifthebermwerenotpresent.b.Hedges:Theheightshallbemeasuredfromthetopmostportionofvegetationtotheground.HedgesdesignedaspartofstormwaterlowimpactdevelopmentbestmanagementpracticesshallbedesignedconsistentwiththeSurfaceWaterDesignManual,andtheClearVisionAreadefinedinRMC4-11-030,andavoidblockingpublicviewstopublicplaces.c.RetainingWalls:ThestandardsofthisSectionrefertoexposedretainingwallheight,asdefinedinRMC4-11-180,DefinitionsR,whichisthe4 ORDINANCENO.6047verticaldistancemeasurefromthefinishgradeatthebottomofthewall(i.e.,lowersoilgrade)tothefinishgradeatthetopofthewall(i.e.,uppersoilgrade).2.RetainingWallStandards:a.FencesonRetainingWalls:Afenceshallnotbeconstructedontopofaretainingwallunlessthetotalcombinedheightoftheretainingwallandthefencedoesnotexceedtheallowedheightofastandalonefence.i.Exception—Guardrail:IftheBuildingOfficialrequiresaguardrail,thecombinedheightoftheretainingwallandrequiredguardrailshallnotexceedninefeet(9’)inresidentialzones,ortwelvefeet(12’)incommercialandindustrialzones.ii.Exception—FiftyPercent(50%)TransparentFences:Fencesthatprovideatleastfiftypercent(50%)transparency,asviewedperpendicularlytothefaceofthefence,maybealloweddirectlyontopofaretainingwall.However,chainlinkfencingshallnotbeinstalled.Thisexceptionshallnotbeappliedtofrontyardsetbacks,orclearvisionareas,asdefinedbyRMC4-11-030,DefinitionsC.b.FencesandHedgesAdjacenttoRetainingWalls:Fencesorhedgesadjacenttoretainingwallswithacombinedheightthatexceedstheallowedheightofastandaloneretainingwallshallbesetbackbyaminimumoftwofeet(2’);thisareashallbelandscapedasifitwereaterrace.Ifafenceisplacedanydistancewithinthepropertyline,thepropertyownercontinuestoberesponsibleforthepropertyonbothsidesofthefence.5 ORDINANCENO.6047c.Materials:Retainingwallsshallbecomposedofbrick,rock,texturedorpatternedconcrete,orothermasonryproductthatcomplementstheproposedbuildingandsitedevelopment.OthermaterialsmaybeusedwiththeAdministrator’sapproval.U.SetbackfromPublicRights-of-Way:Thereshallbeaminimumthree-foot(3’)landscapedsetbackatthebaseofretainingwallsabuttingpublicrights-of-way.Landscapingshallincludeamixtureofshrubsandgroundcover(treesareoptional)inconformancewiththestandardsofRMC4-4-070H4,PerimeterParkingLotLandscaping.e.Terracing:Terracingistheactofforminghillsideintoanumberoflevelflatareas(terraces)betweenretainingwalls,whichisoftenusedwhenthemaximumheightofasingleretainingwallisinsufficient.Thefollowingstandardsshallapplytoterracedslopes:i.TerraceWidth:Noportionofaretainingwallshallbemeasuredaspartoftheterracewidth.Thewidthofaterraceshallbeequaltotheheightofthetallestabuttingretainingwall;however,theminimumterracewidthshallbetwofeet(2’).Terracewidthshallbemeasuredfromthebackedgeofalowerretainingwalltotheforemostedgeoftheimmediatelysucceedingandhigherretainingwall.ii.TerraceLandscaping:Terracescreatedbetweenretainingwallsshallbepermanentlylandscapedwithamixtureofshrubsandgroundcover(treesareoptional)inconformancewiththestandardsofRMC4-4-070,Landscaping.6 ORDINANCENO.6047LandscapingprovidedinfrontofretainingwallsandwithinterracesshallcontributetoanylandscapingrequiredbyRMC4-4-070F;theAdministratormaygrantexceptionsforrequiredtreesbasedonlandconstraints.-f.Grading:Forlandareathatisnotbetweentwo(2)retainingwalls(i.e.,notaterrace),thelowersoilgrade(i.e.,groundatthebottomofaretainingwall’sexposedsurface)andtheuppersoilgrade(i.e.,groundatthetoparetainingwall)abuttingaretainingwallshallbelevelforahorizontaldistance(measuredperpendicularlytothewall)equalingonefoot(1’)foreveryonefoot(1’)inheightoftheretainingwall.g.Modifications:PursuanttoRMC4-9-250D,ModificationProcedures,theAdministratormaygrantmodificationstothisSection’sretainingwallstandards.Approvalofamodificationspermitmayincludeconditionssuchas,butnotlimitedto,increasedsetbacks,additionallandscaping,arequirementtoterraceorspecificmaterialstobeused.D.STANDARDSFORRESIDENTIALUSESZONES:1.MaximumHeight:Inanyresidentialdistrictzone,themaximumheightofanyfence,hedgeorretainingwallshallbeseventy-twoinches(72”),subjecttofurtherheightlimitationsasspecifiedinthissubsectionD.2.2.HekhtLimitationsforInteriorLots:a.FrontYardSetbacks:rt.riccs,retainingwallsorhedgesshallnotcxccedfortyeightinches(‘18”)inheightwithinthefrontyardsetback.7 ORDINANCENO.6047b.SideYardSetbacks:Fcnccs,retainingwallsorhedgeswithinbothinteriorsidcyardsetbacksandthefrontyardsetbackshallnotexceedfoyeightinches(18”)inheight.Fences,retainingwallsorhedgeswithininteriorsideyardsetbacksandnotwithinthefrontyardsetbackshallnotexceedseventytwoinches(72”)inheight.c.RearYardSetbacks:Fences,retainingwallsorhedgesshallnotexceedseventytwoinches(72”)inheightwithintherearyardsetbackunlesstherearyardabutsapublicorprivatestreet,inwhichcaseitshallnotexceedfoyeightinches(18”).FenceswithinarearyardsetbackabuttingaStreetmaybeuptoSeventytwoinches(72”)inheightifcompliantwithsubsectionD3cofthisScction.ItV4k4,.‘2.HeightLimitationsforCornerLotswithinSetbacks:a.FrontYardSetbacks:Fences,hedges,orretainingwallsshallnotexceedforty-eightinches(48”)inheightwithinanypartofthefrontyardsetback.Innocaseshallafence,hedge,orretainingwallFcnces,retainingwallsorhedges$ ORDINANCENO.6047shallnotexceedforty-twoinches(42’)inheightinanypartoftheclearvisionareaasdefinedbyRMC4-11-030,DefinitionsC.Fences,retainingwalls,orhedgesshallnotexceedfortyeightinches(‘18”)inhcightwithinanypartofthefrontyardsetbackwhenlocatedoutsideofanyclearvisionareaonsaidlot.b.InteriorSideYardSetbacks:Fences,hedges,orretainingwallsFences,retainingwallsorhedgesshallnotexceedseventy-twoinches(72”)inheightwithinanypartoftheinteriorsideyardsetbacktothepointwheretheyintersectthefrontyardsetbackorasecondaryfrontyardsetback,inwhichcasetheyshallbegovernedbytheapplicablelimitationsofthefrontyardorsecondaryfrontyardsetbacks.c.SecondaryFrontYardSetbacks:Fences,hedges,orretainingwallsshallnotexceedforty-eightinches(48”)inheightwithinanypartofthesecondaryfrontyardsetback.Innocaseshallafence,hedge,orretainingwallexceedforty-twoinches(42”)inheightinanypartoftheclearvisionareaasdefinedbyRMC4-11-030,DefinitionsC.Fences,retainingwallsorhedgesshallnotexceedfortytwoinches(42”)inheightwithinanyclearvisionarea,asdefinedbyRMC411030,DefinitionsC,andfortyeightinches(18”)inheightelsewhereinthesecondaryfrontyardsetback.d.RearYardSetbacks:Fences,hedges,orretainingwallsFences,retainingwalls,orhedgesshallnotexceedseventy-twoinches(72”)inheightwithintherearyardsetbackexceptthefence,hedge,orretainingwallorhedgeshallnotexceedforty-eightinches(48”)inheightwheretheyintersectthewidth9 ORDINANCENO.6047ofthcsecondaryfrontyardoriftherearyardofthelotabutsapublicorprivatestreet.1515FrontyardSideyard15’(Typical)alongstreet15(Typical)e.FenceHeightExceptionforSecondaryFrontYardSetbacksandRearYardSetbacksAbuttingaStreetandSideYardsalongaStreet:Fencesoverfortyeightinches(48”)anduptoseventy-twoinches(72’)inheightmaybeinstalledwithinsecondaryfrontyardsetbacksandrearyardsetbacksthatyardsandsideyardsalongabutastreetstrccts,exceptinganyportionwithinafrontyardsetbackorcleatvisionarea,ifallofthefollowingcriteriaaremet:i.Fencingmaterialssuchaswroughtiron,cedarwood,orsimilarshallbeused.Chainlinkfencingisprohibited.ii.Thefenceissetbackatleasteightfeet(8’)fromthesubjectpropertyline.10 ORDINANCENO.6047iii.Withintheminimumeightfeet(8’)fencesetback,irrigatedordrought-tolerantlandscapingthatcomplieswiththestandardsofRMC4-4-070.(l-L.1)(P-Q)shallbeinstalledandcontinuouslymaintainedsothatplantingsprovidetotalcoverageoftheareawithinthree(3)yearsbasedonthefollowingstandards:(a)GroundCover:Eighteen(18)groundcoverplantsperfive(5)linearfeetoflandscapingstrip.(1)Minimumfour:inch(4”)pots.(2)Mulchmustbeconfinedtoareasunderneathplantsandisnotasubstituteforgroundcoverplants.(b)Shrubs:Eight(8)lowshrubsperfive(5)linearfeet.Uptofiftypercent(50%)ofshrubsmaybedeciduous:(1)RequiredLowShrub:Maturesizeunderthreefeet(3’)tall.Minimumsizeatplanting:oneortwo(2)gallonpotorballedandburlappedequivalent.(2)OptionalMediumShrubs:Mediumshrubsmaybeinstalledinplaceofrequiredlowshrubs.Onemediumshrubshallcountastwo(2)lowshrubs.Maturesizefromthreefeet(3’)tosixfeet(6’)tall.Minimumsizeatplanting:two(2)orthree(3)gallonpotorballedandburlappedequivalent.iv.Theplantsshallbeplantedinatriangularpatternwithapproximatelyevenspacing,dependingontheplantmaterial.v.PlantslistedasanuisanceorprohibitedbyKingCountyareprohibitedinrequiredlandscapedareas.11 ORDINANCENO.6047vi.Plantingofahedgeorplantingsthatwillgrowtobecomeahedgeareprohibitedtobewithintherequiredlandscapingareabetweenthepropertylineandfence.vii.Thefinishedfaceofthefenceshallbeorientedtothestreet.viii.Nofence,hedge,orretainingwallshallexceedforty-twoinches(42”)withinanyclearvisionarea,asdefinedbyRMC4-11-030,DefinitionsC.ix.Asanalternativetothesestandards,anapplicantmayapplyforaspecialadministrativefencepermitpersubsection6ofthisSection.43.GateRequired:Residentialfences,retainingwallsorhedgesalongrearlotlinesofinteriorlotsabuttingalleysshallhaveanaccessgatetothealley.54.ElectricandBarbedWireFences:Electricand/orbarbedwirefencesmaybepermittedbyspecialadministrativefencepermitinallresidentialzonesincaseswherelargedomesticanimalsarebeingkept;provided,thatadditionalfencingoranAdministratorapprovedbarrieriserectedalongthepropertylines.E.STANDARDSFORCOMMERCIAL7ANDINDUSTRIALANDOTHERUSESZONES:1.MaximumHeight:Themaximumheightofanyfence,hedgeorretainingwallshallbeeightfeet(8’),subAecttofurtherheightlimitationsasspecifiedinsubsectionE.2,providedthefence,hedge,orretainingwallLocationandMaximumHeight:Amaximumofeightfect(8’)anywhereonthelotprovidedthefence,retainingwallorhedgedoesnotstandinorinfrontofanyrequiredlandscapingorposeatrafficvisionhazard.12 ORDINANCENO.60473.MaterialLimitationsinCommercialZones:Chain-linkfencingwithintheCenterDowntown(CD)Zoneisprohibited.Chain-linkfencingwithinallothercommercialzonesshallbecoatedwithblack,brown,grey,orgreenbondedvinyl.4.Landscaping:Fences,hedges,andretainingwallsshallnotstandinorinfrontofanyrequiredlandscaping.Ifaneworreplacedfenceisproposedwithinfifteenfeet(15’)ofapublicstreetonasitethatisnonconformingwithregardtostreetfrontagelandscapingrequirementsperRMC4-4-070F.1,thesiteshallbebroughtintocompliancewithstreetfrontagelandscapingrequirementspriortofenceinstallation.as.ElectricFences:Electricfencesarepermittedinallindustrialzonesandmaybepermittedbyspecialadministrativefencepermitinallcommercialzones.Allelectricfencesshallbepostedwithpermanentsignsaminimumofthirty-six1515,Si-Figure2.14 ORDINANCENO.6047F.ADMINISTRATIVEREVIEWOFVARIATIONFROMFENCEORHEDGESTANDARDSHEIGHTRESTRICTIONS:Unlessotherwisedeterminedthroughthesiteplanrevieworsubdivisionreviewprocess,aApropertyownerwishingtovarytheheightrestrictionsorplacementofstandardsforafenceorhedgeonalotmaymakesubmitawrittenapplicationtotheDepartmentPlanningDivisionfor—administrativereview-e.fthesituation.Thewrittenapplicationshallincludealetterofjustification,siteplan,andtypicalelevation,togetherwiththecurrentpermitfee.TheDepartment’sstaffshallreviewtheapplicationandprepareawrittendeterminationbaseduponcriterialistedinsubsectionGofthisSection,SpecialAdministrativeFencePermits.Noseparatespecialfencepermitisrequiredforadevelopmentproposalwhichrequiressiteplanrevieworsubdivisionreviewprocess,providedvariationswerepermittedthoughtheseprocesses.G.SPECIALADMINISTRATIVEFENCEPERMITS:1.FencesEligibleforAdminitrativcReviewProcess:Personswishingtohaveoneofthefollowingtypesoffencesmaysubmitaletterofjustification,siteplanandtypicalelevation“-wiucII..permitfeetotheDepartmentofLommunityailuWrIu1TIJL.Development:a.Fencesexceedingfortyeightinches(48”)withinfrontyardorsideyardsalongastreetsetbackbutnotwithinaclearvisionarea;b.FencesorhedgesexceedingvL1ILyLWUinches(72”)andlocatedoutsideofrequiredyardsetbacks;16 ORDINANCENO.6047c.Electricfences;andd.Barbedwirefences.1.EvaluationCriteria:TheAdministratormayapprovetheissuanceofspecialfencepermitsprovidedthatthefollowingobjectivescriteriacanbemet:a.Theproposedfenceimprovestheprivacyandsecurityoftheadjoiningyardspaceorhedgeisnotoutofcharacterwiththesurroundingneighborhood;b.Theproposedfenceorhedgedoesnotdetractfromthequalityoftheresidentialenvironmentbybeingoutofscaleorcreatingvastblankwallsalongpublicroadways;c.Theproposedfenceorhedgecomplementscomplimentstheenvironmentitservesinanaestheticallypleasingmanner;andd.Theproposedfenceorhedgedoesnotpresentahazardtovehicularorpedestriantraffic.32.AcceptableMeasurestoMeetCriteria:Fenceslocatedwithinthefrontorsideand/orrearyardalongastreetsetbackmaybeamaximumofseventytwoinches(72”)inheight,providedtheevaluationcriteriaaremet.Acceptablemeasurestoachievethesecriteriainclude,butarenotlimitedtothefollowing:a.Permanentlandscapingalongthefrontofthefence;b.Qualityfencematerial,suchascedarfencing;c.Modulationofthefence;17
