HomeMy WebLinkAboutORD 6051CITYOFRENTON,WASHINGTONORDINANCENO.6051ANORDINANCEOFTHECITYOFRENTON,WASHINGTONAMENDINGSUBSECTIONS4-1-210.B.1OAND4-1-210.C.1OOFTHERENTONMUNICIPALCODE,BYEXTENDINGTHEWAIVEROFCERTAINDEVELOPMENTANDMITIGATIONFEES,PROVIDINGFORSEVERABILITY,ANDESTABLISHINGANEFFECTIVEDATE.WHEREAS,onAugust27,2001,theRentonCityCouncilpassedOrdinanceNo.4913(codifiedinRMC4-1-210.B)toallowcertaindevelopmentandmitigationfeesforhousingthatisforsaletobewaivedtoencouragenewowner-occupiedhousinginDowntownRenton;andWHEREAS,onFebruary1,2010,theCityCouncilpassedOrdinanceNo.5524(codifiedinRMC4-1-210.B)toallowcertaindevelopmentandmitigationfeesforhousingthatisforsaletobewaivedtoencouragenewowner-occupiedhousingintheSunsetArea;andWHEREAS,onAugust1,2011,theCityCouncilpassedOrdinanceNo.5617(codifiedinRMC4-1-210.C)toallowcertaindevelopmentandmitigationfeesforrentalhousingtobewaivedtoencouragenewmulti-familyrentalhousingintheSunsetArea;andWHEREAS,onDecember10,2018,theCitypassedOrdinanceNo.5912tomodifythewaiverofcertaindevelopmentandmitigationfeestorequireowner-occupiedhousingtodesignateandsellatleastfiftypercent(50%)oftotalhousingunitsforaffordablehousingforhouseholdsatorbeloweightypercent(80%)medianincomewithremaininghousingunitsasaffordablehousingforhouseholdsatorbelowonehundredandtwentypercent(120%)ofmedianincomeandrentalhousingtodesignateandrentonehundredpercent(100%)ofthehousingunitsasaffordablehousingforhouseholdsatorbelowsixtypercent(60%)ofmedianincome;and1 ORDINANCENO.6051WHEREAS,thesedevelopmentandmitigationfeewaiverswillsunsetonDecember31,2021,unlessextendedbyCityCouncilaction;andWHEREAS,theprovisionsofSubsection4-1-210.B,Owner-OccupiedHousingIncentive,andSubsection4-1-210.C,RentalHousingIncentive,havebeensuccessfulinencouragingincreasedresidentialopportunitiesandinstimulatingnewconstructionofowner-occupiedandmulti-familyhousinginDowntownRentonandtheSunsetArea;andWHEREAS,theAdministrationbelievesthatthewaivedfeeshousingincentiveshouldbeusedasatooltoencouragemoreaffordablehousingintheCity;andWHEREAS,theCityseekstoamendRMC4-1-210.B.10and4-1-210.C.10toextend,asmodified,thedevelopmentandmitigationfeewaiverstoencouragethedevelopmentofadditionalnewaffordablehousingineligiblezonesthroughouttheCity;andWHEREAS,thismatterwasdulyreferredtothePlanningCommissionforinvestigationandstudy,andthematterwasconsideredbythePlanningCommission;andWHEREAS,pursuanttoRCW36.70A.106,onOctober20,2021,theCitynotifiedtheStateofWashingtonofitsintenttoadoptamendmentstoitsdevelopmentregulationsandrequestedexpeditedreview;andWHEREAS,thePlanningCommissionheldapublichearingonNovember17,2021consideredallrelevantmatters,andheardallpartiesinsupportoropposition,andsubsequentlyforwardedarecommendationtotheCityCouncil;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:2 ORDINANCENO.6051SECTIONI.AllportionsoftheRentonMunicipalCodeinthisordinancenotshowninstrikethroughandunderlineeditsremainineffectandunchanged.SECTIONII.Subsection4-1-210.B.10oftheRentonMunicipalCodeisamendedasshownbelow.Allotherprovisionsin4-1-210remainineffectandunchanged,exceptasspecifiedinSECTIONIIIofthisordinance.10.Sunset:TheCitywillacceptapplicationsforwaivedfeesunderthissubsectionBuntilcloseofbusinessonDecember31,20212024,SECTIONIII.Subsection4-1-210.C.10oftheRentonMunicipalCodeisamendedasshownbelow.Allotherprovisionsin4-1-210remainineffectandunchanged,exceptasspecifiedinSECTIONIIofthisordinance.10.Sunset:TheCitywillacceptapplicationsforwaivedfeesunderthissubsectionCuntilcloseofbusinessonDecember31,20212024,unlessextendedbyCityCouncilaction.SECTIONIV.Ifanysection,subsection,sentence,clause,phraseorworkofthisordinanceshouldbeheldtobeinvalidorunconstitutionalbyacourtorcompetentjurisdiction,suchinvalidityorunconstitutionalitythereofshallnotaffecttheconstitutionalityofanyothersection,subsection,sentence,cause,phraseorwordofthisordinance.SECTIONV.Thisordinanceshallbeinfullforceandeffectfive(5)daysafterpublicationofasummaryofthisordinanceintheCity’sofficialnewspaper.Thesummaryshallconsistofthisordinance’stitle.3 ORDINANCENO.6051PASSEDBYTHECITYCOUNCILthis13thdayofDecember,2021.Jasy7A.5eth,ctyClerkAPPROVEDBYTHEMAYORthis13thdayofDecember,2021.Approvedastoform:ShaneMoloney,CityAttorneyDateofPublication:12/16/2021(Summary)ORD:2195:11/4/21AçIavoneMayor4
