Project Description/Background: The applicant, Classic Homes, is requesting approval of two administrative variances from the maxinj um building lot coverage requirements within the Residential Multi-Family-Infill (RM-I) zone (section 4-2-110F). The subject lots are located at 402 and 410 Taylor Avenue NW. The site is bounded by Taylor Avenue NW on the west and two similar duplex structures on the east. Development standards of the RM-I zone limit the maximum building lot coverage to 35%. The building lot coverage is calculated by taking the proposed building envelope and dividing it into the existing lot area. In this case, both lots are 4,000 square feet and the proposed duplex building envelopes are 1,600 square feet, which equates to a building lot coverage of 40% (1,600 sf / 4,000 sf = 40%). Therefore, the applicant is proposing an increase in the maximum building lot coverage of 35% to 40%to accommodate the proposed duplexes. The variance proposal would maintain the required setbacks of 20 feet in the front yard, 15 feet in the rear yard and 5 feet for the side yards. In addition, the height of the structures is proposed to be approximately 25 feet above finished grade, which is below the maximum building height allowed in the RM-I zone (35 feet). Findings 1) Request: The Applicant, Classic Homes, has requested approval for an administrative variance from the maximum building lot coverage in the RM-I zone (section 4-2-110F) for the properties located at 402 and 410 Taylor Avenue NW. A building lot coverage of 40% is being requested. 2) Administrative Variance: The applicant's administrative variance submittal materials comply with the requirements necessary to process a variance. The applicant's site plan and other project drawings are entered as Exhibits No. 1 through 7. 3) Existing Land Use: Land uses surrounding the subject site include: North: Commercial; South: Multi family residential; East Commercial and multi-family residential; and West: Multi family residential and single family residential. 4) Zoning: The site is located in the Residential Multi-Family-Infill (RM-I) zone. The development standards for this zone require a 20-foot front yard setback, 15-foot rear yard setback, and a 5-foot side yard along a street setback. Maximum lot coverage is 35% and the maximum permitted building height is 35 feet. 4) Topography: The topography of the site is relatively flat. 5) Lot and Building Size: The lots are 4,000 square foot in size. The applicant has designed two duplex building, totaling 3,200 gross square feet each. The building footprint is 1,600 square feet, which results in a building lot coverage of 40%. 6) CONSISTENCY WITH VARIANCE CRITERIA Sction 4-9-2508.5.a. lists 4 criteria that the Zoning Administrator is asked to consider, along with all other relevant information, in making a decision on an Administrative Variance application. These include the following: The Zoning Administrator shall have authority to grant an administrative variance upon making a determination, in writing, that the conditions specified below have been found to exist: a. That the applicant suffers undue hardship and the variance is necessary because of special circumstances applicable to subject property, including size, shape, topography, location or surroundings of the subject property, and the strict application of the Zoning Code is found to deprive subject property owner of rights and privileges enjoyed by other property owners in the vicinity and under identical zone classification: The applicant contends that special circumstances do exist as the existing properties are only 4,000 square feet each, which is exceptionally small for lots that have been zoned multi-family residential. However, in this case the applicant is requesting a 40% building lot coverage, which is still below the maximum allowed lot coverage in a single family zone. Finally, the applicant concludes that the remaining development regulations (i.e. setbacks and structure height) are not being varied from and the proposed duplex structures would be in compliance with all other prescribed development standards associated with the zone the subject lots are located in. As the applicant appropriately notes, the lots in question are smaller in lot area, which does create a hardship for applicants attempting to maximize the development potential for lots that are zoned multi-family. Therefore, staff does recognize that special circumstances do exist with respect to this variance application. Furthermore, the applicant has indicated that each unit would be approximately 1,600 square feet in size, which is not excessive and does not require any additional development standard variances. Finally in staff's opinion, a reduction in the building footprint would only take away from the appearance of the proposed units, which may result in less aesthetically p easing duplex structures. b. Tat the granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which subject property is situated: The granting of the variance would not be materially detrimental to the public welfare. Instead, the granting of this variance would be beneficial to the public as the proposed improvements to the subject lots would enhance the existing improvements that are currently located in the vicinity of the proposal. Specifically, the subject lots are located west of existing duplexes, south of a commercial storage lot, and east and north of apartment complexes; therefore, the additional two duplex structures would not be detrimental to the existing multi-family neighborhood. In addition, while the maximum building lot coverage would be increased by 5%; the proposed structures would meet all other required setbacks a1d height regulations. Therefore, staff does not anticipate additional impacts to surrounding properties with the granting of this variance. c. hat approval shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity and zone in Which the subject property is situated: The existing multi-family projects located in the vicinity of this proposal were constructed in 1970's and 1980's, of which, the development standards have changed over time. Nevertheless, some of the surrounding multi-family buildings appear to exceed the maximum building lot coverage currently allowed by City code. Therefore, the granting of this variance to increase the maximum building lot coverage to 40% would not constitute a grant of special privilege that other properties in the immediate vicinity don't already share. d. As all other setback and building height standards are being met with the proposed duplex structures; therefore, staff considers the proposal to be the minimum necessary in order to provide a three- bedroom unit with attached garages. E. Conclusions 1. The subject lots are located at 402 and 410 Taylor Avenue NW, within the Residential Multi-Family-Infill (RM-I) zoning designation. 2. The RM-I zone limits the maximum building lot coverage to 35% of the total lot area (section 4-2-110F). The applicant is proposing an increase in this requirement to 40%. 3. The proposal is consistent with the established variance criteria as discussed in the body of the Staff Report. F. The applicant suffers undue hardship and the variance is necessary because of special circumstances applicable to the subject property. The existing lot is only forty feet by one hundred feet in size,very small for a property zoned RM-I. (4000 square feet) The development standards allow a duplex to be built on any legal lot of record. Appropriate setbacks must be maintained and access and parking provided per code. In order to build a reasonable sized and usable unit of 11600 square feet including parking in a garage,the lot coverage maximum must be exceeded. The applicant did not create the small lot. It has been in existence for many years. Strict application of the development standards will deprive the applicant of rights enjoyed by others in the area. Even single family lots of this size allow 50% lot coverage. A single-family house on a lot of this size could be 600 square feet larger than this duplex. b. Granting of this variance will not be materially detrimental to the area. Duplexes are to the east of this property,to the south and west are apartments and to the north is a commercial storage area. c. Granting of this variance will not be a special privilege inconsistent with other properties in the same zone. Most other apartment developments in the area are allowed to exceed 35%lot coverage. d. The current zoning of the site and surrounding area is RM-I.The current use of the site is vacant. The property is nearly flat and drains generally from west to east.The property slopes from west to east. 1 Street paving and drainage exist on Taylor Ave NW. Water mains exist in Taylor Ave also.A Fire Hydrant was recently installed in front of these two lots. A small amount of materials will be moved on site during construction of the duplexes. No trees will be removed as part of this application. i Each lot is 4000 square feet.The development standards only allow 35%lot coverage in the RM-I zone without special approval by the Hearing Examiner. Classic Homes wishes to build a reasonable sized duplex with a 1600 square foot footprint.The footprint of 1600 square feet totals 40%lot coverage,5% over the 35%allowed. Since an application for a permit for a duplex does not go to the Hearing Examiner we are applying for this administrative variance which is allowed by code.
