RECOMMENDATION: Approve With Conditions FINDINGS, CONCLUSIONS & RECOMMENDATION Having reviewed the record documents in this matter, staff now makes and enters the following: FINDINGS: 1. The applicant, Wendall Woodall, filed a request for approval of a 16 lot Final Plat. 2. The yellow file containing all staff reports, the State Environmental Policy Act (SEPA) documentation and other pertinent materials was entered into the record as Exhibit No. 1. 3. The Environmental Review Committee (ERC), the City's responsible official, issued a Determination of Non-Significance-Mitigated on November 28, 2000, for the subject proposal. 4. The subject proposal was reviewed by all departments with an interest in the matter. 5. The subject site is located at Edmonds Ave NE and NE 12' Street. The new plat is located in the NE% Section 8, Twn. 23N., Rge. 5E. 6. The subject site is a 1.78-acre parcel. 7. The Preliminary Plat received City of Renton Council approval on February 26, 2001. 8. The site has a R-10 (Single Family) land use zoning, with the adoption of Ordinance 4404 enacted in June 1993. 9. The Final Plat complies with both the Zoning Code and the Comprehensive Plan. Page 2 10. The Preliminary Plat was subject to a number of conditions as a result of both environmental review and plat,review. The applicant has complied with the conditions imposed by the ERC: 1) The applibant stated that the recommendations of the Geotechnical Engineering Study dated September 27th 2000 and October 13th 2000 (amended)were followed. 2) The applicant has stated that clearing and grading was limited to the dry months. 3) Applicant has stated that a qualified geologist observed the installation of all erosion control and sedimentation control measures. 4) The Traffic Mitigation fees will be paid prior to recording of the plat. 5) The Fire Mitigation fees will be paid prior to recording the plat. 6) The Parks Mitigation fees will be paid prior to recording the plat. 11. In addition, the applicant has complied with the conditions imposed as a result of Preliminary Plat: 1) Applicant complied with the above noted ERC conditions. 2) Applicant has constructed the retaining wall in accordance with approved construction plans. 3) Applicant has stated that a guardrail is not needed because the retaining wall was constructed away from the existing sidewalk. 4) Applicant has stated a Maintenance Agreement will be in place and shown on the face of the plat in lieu of a homeowner's association. 5) Applicant has included a Declaration of Covenant note on the face of the plat that conveys the beneficial interest in the easements shown on the plat for future owners. 6) Applicant has dedicated a 25-foot radius at the corner of NE 12th Street and Edmonds Ave NE. 7) Applicant has stated that both internal road entrances were redesigned to reduce grade. CONCLUSIONS: The Final Plat generally appears to satisfy the conditions imposed by the preliminary plat process and therefore should be approved by the City Council. RECOMME DATION: The City Council should approve the Final Plat with the following conditions: 1) All plat improvements shall be either constructed or deferred to the satisfaction of City staff prior to the recording of the plat. 2) All fees shall be paid prior to the recording of the plat. 3) Erosion control and site stabilization requirements shall continue to be in place at the site.
