RECOMMENDATION: • • Hearing Examiner: Recommend approval. • PLANNING DEPARTMENT The Planning Department staff report_ was received by the REPORT: Examiner on April 12, 1978. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on April 18, 1978 at 9:00 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were sworn. • It was reported that the Hearing Examiner and 'the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. The Examiner referenced Section 4-3014 of Chapter 30, Code of General Ordinances of the City of Renton relating to the "Land Use Hearing Examiner," and asked the applicant to address the relationship of his request with the three specific findings required to allow recommendation for rezone during his subsequent testimony. Michael Smith, Planning-Department, reviewed Exhibit #1, and entered the following additional exhibits into the record: Exhibit #2: King County Assessor's Map • Exhibit #3: Site Map ' • The Examiner asked .the applicant if he concurred in Exhibit #1. Responding was: Jack Stewart 926 Kirkland Avenue N.E. Renton, WA 98055 • Mr. 'Stewart indicated his concurrence, and reviewed public services currently available to the site. The Examiner noted that according to the Planning Department, the last area-wide land use analysis of the property was accomplished in 1976, and asked the • applicant to review the applicability of the subject request to the three specific findings the Examiner must make in approval of a rezone. Mr. Stewart had no additional comments. • The Examiner asked for testimony in support or opposition to the request. There was no response. He asked Mr. Smith for the specific date of the last area-wide land use analysis for the subject property. Mr. Smith advised that although the date of November, 1976, was approximate, he would verify the exact date with Planning Department records. In response to the Examiner's inquiry regarding setback requirements, Mr. Smith reported that existing development on the site constituted a non-conforming use, but future development would require compliance with existing City of Renton regulations. He noted that a business zone requires setbacks only when abutting a residential zone but a 20-foot setback is• required from a primary state highway, i.e. Sunset Boulevard N.E. He also advised that although parking provisions were adequate for existing uses on the site, any future development may require additional, upgraded parking space.' . The: Examiner inquired if. the G zoned property to the west of the subject site contained a single family residence. Mr. Stewart responded that it was his understanding that the . • I • R-146-76 Page Two owner intended to request a rezone in the near future. The Examiner asked Mr. Smith for final comments. Mr. Smith indicated that Exhibit #1 would remain as submitted, but he concurred with the Examiner's comments regarding conformance to city regulations for any future development on the site. The Examiner asked for further comments. Since there were none, the hearing on File No. R-146-78 was closed at 9:30 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request is for reclassification of approximately one-half acre from G (General) to B-1 (Business District) . 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, (is uncontested) , and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance has been issued for the subject proposal by Gordon Y. Ericksen, responsible official. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development and no adverse comment was expressed. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. 7. Existing buildings appear not to be totally compatible with the required setbacks of Section 4-711 (B-1) and 4-729 (G) of Title IV, Ordinance No. 1628, Code of General Ordinances (Exhibit #3) . The other requirements of Section 4-711 seem to be met. In any case, the existing buildings which violate these requirements would become nonconforming per Section 4-726. (B) . 8. Prior to annexation in 1974, the property was zoned business (King County) . Retail uses were contained in existing buildings on the property. 9. The last area land use analysis (March 4, 1977) considered the specific property and determined the potential use to be Commercial (Section 4-3014. (A) ) . 10. A designation of Commercial is given to the site on the Comprehensive Plan Land Use Map (Section 4-3014. (B) ) . 11. Since the previous land use analysis a significant rezone occurred on the southwest corner of Sunset Boulevard N.E. and Duvall Avenue N.E. A retail complex is under construction on this property (Section 4-3014. (C) ) . Upgrading and installation of utilities affecting the subject site have occurred and will occur as a result of this development. CONCLUSIONS: 1. The proposal conforms to the Comprehensive Plan (Section 4-3014. (B)) . Transition from the existing commercial uses to adjacent single family properties (Objective No. 1, page 17, Land Use Report, Comprehensive Plan) can be accomplished on abutting properties. 2. Sufficient consideration of the proposal appears to have been given during the previous land use analysis. The proposal conforms to this analysis (Comprehensive Plan Land Use Map) . 3. Development of the retail complex directly south and across Sunset Boulevard N.E. from the subject site sufficiently impacts the site to substantiate the request (Section 4-3014. (C) ) . 4. Impacts upon properties adjacent to the site should be minimized. Land uses and structures remain unchanged. Only the zoning has been affected, in essence, by conversion from King County to Renton B-1 zoning. I / ' ..
