SUMMARY OF REQUEST: The applicant requests approval of a proposed rezone from P-1 to B-1 to allow the construction and/or extension of commercial uses. SUMMARY OF Planning Department: Approval subject to conditions. RECOMMENDATION: Hearing Examiner: Approval. PLANNING DEPARTMENT The Planning Department staff report was received by the REPORT: Examiner on April 26, 1978. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on May 2, 1978 at 9:00 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. There was no representation by the applicant at the hearing. Michael Smith, Planning Department, reviewed Exhibit #1, and entered the following additional exhibits into the record: Exhibit #2: King County Assessor's Map Exhibit #3: Conceptual Site Plan (Unapproved by staff) Mr. Smith added a recommendation as a condition of approval that all departments of the City of Renton affected by the subject proposal be allowed to review and approve a final detailed site plan for allPdevelopment or redevelopment of the subject site. He stated that Exhibit #3 as submitted did not meet requirements of the city and noted that the architect responsible for the plan was no longer employed by the applicant. Mr. Smith confirmed the Examiner's inquiry regarding the location of the City Attorney's law offices at the southeast corner of the subject site designated on Exhibit #3, and the Examiner disclosed that no contact regarding the application had occurred with the attorney or would occur in the future. The Examiner asked Mr. Smith if the recommendation for departmental review of the specific site plan would normally occur during the building permit process. Mr. Smith responded affirmatively. The Examiner asked for testimony in support or opposition to the request. There was no response. The Examiner asked Mr. Smith for additions, corrections or modifications to Exhibit #1. Mr. Smith indicated that the Planning Department report would remain as submitted and the recommendation for approval confined strictly to rezoning aspects of the application and not site approval. The Examiner reported that in order to give the applicant an opportunity to respond to recommendations contained in Exhibit #1, he would close the public hearing with the stipulation that the applicant would be contacted in writing for the purpose of requesting additional input regarding the Planning Department report and also the status of Exhibit #3, Conceptual Site Plan, and all correspondence would be included with the Examiner's final report and recommendation on the matter. There was no objection to the Examiner's proposal. ' l M R-152-78 Page Two The Examiner asked for further comments. Since there were none, the hearing on File No. R-122-78 was closed at 9:22 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request is for approval of a reclassification of 12,670 square feet from P-1 to B-1. 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, (is uncontested) , and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance has been issued for the subject proposal by Gordon Y. Ericksen, responsible official. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development and no adverse comment was expressed. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. 7. The proposal (Exhibit #3) has not been evaluated for compatibility with the required setbacks, lot coverage and height requirements of Section 4-711 (B-1) of Title IV, Ordinance No. 1628, Code of General Ordinances. 8. Testimony was not provided as to whether or not the site was considered during any previous area land use analysis (Section 4-3014. (A) ) . The Comprehensive Plan Land Use Map indicates the property to potentially be Commercial (B-1) (Section 4-3014. (B) ) . 9. Property due east of the site was rezoned from P-1 to B-1 in 1961. 10. The site abuts (on the west) B-1 zoned property developed in commercial uses responding to Rainier Avenue South. East of the site is the Renton Senior High School, zoned P-1. 11. Per Exhibit #2, the property was part of the Black River bed. CONCLUSIONS: 1. The proposal conforms to the Comprehensive Plan (Section 4-3014. (B) ) . The Land Use Map indicates that property west of Lake Avenue S. should be Commercial. This would produce ". . .coordinated development of undeveloped areas." (Summary, page 9, Comprehensive Plan, Renton Urban Area, July, 1965) . B-1 would not constitute an intrusion into other districts (Objective No. 1, page 17, Comprehensive Plan, Land Use Report, July, 1965) . Employment opportunities would be provided (Ibid, Objective No. 3) . Effective land use control would occur (Ibid, Objective No. 4) . The ". . .best interest of the community. . . " would be served and the attractiveness of the community will probably be enhanced (Ibid, Objective No. 6, page 18) . 2. The zoning of B-1 for the property may or may not have been considered at a previous area land use analysis (Section 4-3014. (A) ) . 3. Past rezone activity in the vicinity indicates that the area previously zoned P-1 for school related uses may be too large. Some of the P-1 property has been rezoned and developed into commercial uses. This affects any past rationale for P-1 zoning for the site (Section 4-3014. (C) ) . 4. A rezone to B-1 should be approved. Circumstances surrounding the site do not indicate that any special conditions need to be attached to the rezone. RECOMMENDATION: Based upon the record, testimony, findings and conclusions, it is the Examiner's recommendation that the City Council approve the reclassification from P-1 to B-1.
