Pasco : We have reviewed your letters regarding the above-referenced subdivision violation. We have previously discussed with the City Attorney the problem of violations of the State subdivision provisions as described in RCW-58 .17. We have also specifically discussed Section 58 .17 .210 , which does not release the burden from either the purchaser or seller related to subdivision violations . The section specifically states that "Each purchaser or transferee may recover his damages from any person , firm, corporation , or agent selling or transferring land in violation of this chapter . " It is the Attorney 's opinion that this is a civil matter between the buyer and seller of properties divided in violation of the State requirements . The City is not in a position to issue any permits until such time as the subdivision violation is rectified. Should you have further questions, please do not hesitate to contact me . Councilman Perry presented a resolution for reading as prepared by the City Attorney at Perry' s request, placing burden of cost for the health services onto the County without direct contribution by the cities, with copies to State Legislators and Association of Washington Cities. The request is for approval of a reclassification of 15,000 square feet of property (within a larger ownership) from GS-1 to R-1. 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, is uncontested, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance has been issued for the subject proposal by Gordon Y. Ericksen, responsible official. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development and no adverse comment was expressed. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. 7. Exhibit #2, King County Assessor's Map, indicates that the subject site is a separate tax lot contiguous to a larger lot of the same ownership. If the subject site was created prior to the effective date of the Subdivision Ordinance, a short plat is required to create the subject site. 8. Exhibit #2 also indicates an apparent 30-foot easement along the northern boundary of the site in conjunction with the existing 30-foot right-of-way for N.E. 6th Street. A title search is being conducted to resolve the status of the 30-foot strip of property. 9. Two single family residences are proposed on the site (two lots of about 7500 square feet each exclusive of the 30-foot strip) . Therefore, a short plat will be required per Chapter 11, Subdivision Ordinance. 10. Single family development north of N.E. 6th Street is predominantly of lot sizes less than 7500 square feet. Development south of N.E. 6th Street is fairly sparse and rural in pattern. 11. The Comprehensive Plan Land Use Map indicates the site to be Single Family Residential (Section 4-3014. (B) ) . Testimony was not provided as to whether or not this site was considered in any previous land use analysis (Section 4-3014. (A) ) . 12. Development of the President Park subdivision north of the site and across N.E. 6th Street is zoned S-1. Under S-1 zoning (Section 4-707) the minimum lot size is 40,000 square feet, except that 7200 square foot lots are permitted if utilities are available (Sections 4-707. (1) and 4-706) . The density of President Park approaches 7200 square foot lots (Section 4-3014. (C) ) . CONCLUSIONS: 1. The proposed reclassification conforms to the Comprehensive Plan (Section 4-3014. (B) ) . Coordination is accomplished of the undeveloped property south of N.E. 6th Street (Summary, page 9, Comprehensive Plan, Renton Urban Area, July, 1965) . This represents an orderly growth pattern (Objective No. 1, page 17, Comprehensive Plan, Land Use Report, July, 1965) , and effective land use control (Ibid, Objective No. 4) . The land will be used in its ". . .highest and best use. . . " while being in the best interest of the community (Ibid, Objective No. 6, page 18) . 2. The President Park subdivision of 'a density similar to R-1 and the presence of utilities on Union Avenue N.E. affect the property (Section 4-3014. (C) ) in terms of pressure for denser development than 35,000 square feet per lot (GS-1) . A review of the Zoning Map indicates other sites have been similarly reclassified. 3. A short plat is necessary to divide the subject site into two lots. Depending on the outcome of the title search, the apparent 30-foot easement should become part of N.E. 6th Street to form a normal city street. This should be included in the short plat. In addition, if the subject site was not divided from the larger property prior to the effective date of the Subdivision Ordinance, the, short plat should include all of the contiguous property of single ownership. PLANNING DEPARTMENT The Planning Department. staff report was received by the REPORT: Examiner on April 26, 1978. • • PUBLIC HEARING: After reviewing the•Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the • Examiner conducted a public hearing on the subject as follows: The hearing was opened on May 2, 1978 at 9:40 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported ,that the Hearing Examiner had received arid reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. The applicant was not in attendance at the hearing. Michael Smith, Planning Department, reviewed Exhibit #1, and entered the following additional exhibits into the record: • Exhibit #2: King County Assessor's Map Exhibit #3: Plot Plan The Examiner asked for testimony in support of the application. Responding was: George A. Pasco 1900 N.E. 16th Street Renton, WA 98055 Mr. Pasco indicated that he was testifying for the applicant at the hearing. He advised that a title search is currently in process to establish the original purpose of the 30-foot easement recommended for dedication to the city and which he felt may have been established •for future street widening purposes. He advised that the matter would be resolved prior to submittal of the subsequent short plat application to the city. Mr. Smith reported that the Planning Department had also been researching the matter of the easement with the title company and noted that all information would be included with the'short plat application. • The Examiner asked Mr. Smith if the size of the property specified in Exhibit #1 of 15;000 square feet was a net or gross figure and whether it included the 30-foot easement. Mr. Smith indicated' that it was a net computation and excluded the easement. The Examiner noted that' the subject site appeared to be part of a larger parcel which has not yet been subdivided and it should be stipulated in the rezone that subdivision from the larger parcel could occur in the subsequent short plat hearing. Mr. Smith • agreed, that such subdivision would be a requirement unless the applicant could demonstrate that the subject site was subdivided from the larger parcel prior to adoption of the Subdivision Ordinance. ' • The Examiner asked for further comments. Since there were none, the hearing on File No. R-154-78 was closed by the Examiner at 9:55 a.m. R-154-78 Page Three property to the Planning Department. The proposed rezone is consistent with the Comprehensive Plan which designates the site and vicinity as single family resi - dential . 2 .
