HomeMy WebLinkAboutORD 6061CITYOFRENTON,WASHINGTONORDINANCENO.6061ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,DECLARINGAMORATORIUMONLANDUSE,BUILDINGPERMIT,ANDBUSINESSLICENSEAPPLICATIONSFORBATTERYENERGYSTORAGESYSTEMS;SETTINGFORTHFINDINGSOFFACTINSUPPORTOFSAIDMORATORIUM;PROVIDINGFORSEVERABILITY;DECLARINGANEMERGENCY;ANDESTABLISHINGANIMMEDIATEEFFECTIVEDATE.WHEREAS,theCityofRentonhasadoptedaComprehensivePlanandzoningregulationspursuanttotheGrowthManagementActthatauthorizelandusesandactivitieswithintheCity;andWHEREAS,aBatteryEnergyStorageSystem(“BESS”)isnotanauthorizedorpermittedusepursuanttotheCity’sComprehensivePlanandzoningregulations;andWHEREAS,theCityCouncilseekstounderstandanyimpactsanddetermineappropriatezoninganddevelopmentstandardsforsuchsystems;andWHEREAS,City’sCommunityandEconomicDevelopmentDepartment(CED)regularlyundertakesworkprogramstoproposeamendmentstoTitleIVoftheRentonMunicipalCodefRMC);andWHEREAS,theCityseeksadequatetimetocompletesaidworkprogram;andWHEREAS,theCityCouncilhasdeterminedthatthereisaneedforamoratoriumonacceptinganylanduseapplication,buildingpermitapplication,orbusinesslicenseapplicationforBESS;andWHEREAS,theCityCouncilwillholdapublichearingwithinsixty(60)daysofthepassageofthisordinance;1 ORDINANCENO.6061NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.TheaboverecitalsareadoptedasfindingsoffactinsupportofthemoratoriumsadoptedhereinpursuanttoRCW35A.63.220andRCW36.70A.390,andarefoundtobetrueandcorrectinallrespects.SECTIONII.TheCityCouncilherebydeclaresamoratoriumuponthesubmissionoracceptanceofanylanduseapplication,buildingpermitapplication,orbusinesslicenseapplicationforBESS;andSECTIONIII.Thismoratoriumshallnotapplytoanycompleteandacceptedlanduseapplications,buildingpermitapplications,orbusinesslicenseapplicationsforBESS;andSECTIONIV.ThemoratoriumimposedhereinshallbeineffectuntilOctober18,2022,unlessendedearlierbysubsequentCityCouncilaction,orunlesssubsequentlyextendedbytheCityCouncilpursuanttostatelaw.SECTIONV.Apublichearingshallbescheduledandheldwithinsixty(60)daysofthepassageofthisordinance.SECTIONVI.Ifanysection,subsection,sentence,clause,phrase,orworkofthisordinanceshouldbeheldtobeinvalidorunconstitutionalbyacourtorcompetentjurisdiction,suchinvalidityorunconstitutionalitythereofshallnotaffecttheconstitutionalityofanyothersection,subsection,sentence,clause,phraseorwordofthisordinance.SECTIONVII.TheCityCouncildeclaresanemergencyfortheprotectionofthepublicwelfareandtoenablethepurposeandintentofthisordinancetobeaccomplished.ThisordinanceshalltakeeffectimmediatelywhenpassedbytheCityCouncil.TheCityClerkshall2 ORDINANCENO.6061causetobepublishedasummaryofthisordinanceintheCity’sofficialnewspaper.Thesummaryshallconsistofthisordinance’stitle.PASSEDBYTHECITYCOUNCILthis18thdayofApril,2022.JasonAeth,CityierkAPPROVEDBYTHEMAYORthis18thdayofApril,2022ApprovedastoforShaneMoloney,CityAttorneyDateofPublication:4/21/2022(summary)ORD—CED:2215:4/13/22Arma,Mayor3
