WHEREAS, the City desires to use certain property of the owner for the purpose of installing a sidewalk including constructing, repairing and maintaining associated with the Downtown Circulation Phase 1 Project ("Project"); NOW, THEREFORE, in con sideratior; of the rnutua! �ov�nants contained herein and other valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the undersigned owners hereby grant to the City, or its assigns, subject to the conditions hereafter set forth, a permanent nonexclusive easement over and through the property of the Owner at 1000 S. 2"d St., Renton, WA 98057 ("Property") for construction, repairing and maintaining the public sidewalk. The easement area is depicted on the map attached hereto as Exhibit B and further described in Exhibit A, attached hereto. 1. General Provisions. This easement is granted and accepted subject to the following conditions: 1.1 That, in constructing the aforesaid improvements, the City shall do no unnecessary injury to any trees, shrubs, lawns, buildings, fences, or appurtenances within the property; and shall restore the surface of the ground to the same condition in vvhich it was before the start of the improvements as near as such restoration can be made; 1.2 That, upon completion of any repair or maintenance work, the City shall leave the premises substantially the same as it was on the day work commenced; SWE E���^�' "��.� �IOT REQUIafG� �`a}r;�~Lt�{18 ��Of1 �� �� 1 {4f " Qf1� 1.2 That, upon completion of any repair or maintenance work, the City shall leave the premises substantially the same as it was on the day work commenced; 1.3 That the City shall indemnify, defend and hold harmless owners from any claim or damage which might arise as a result of the work performed; 1.4 That the owners shall not obstruct the easement premises in any manner that will prevent or interfere with the use of the easement for the purposes identified herein, or allow any third party to obstruct the premises in a manner that will prevent or interfere with use of the easement for the purposes identified here. 1.5 That it is understood by the Grantor and Grantee that the approximately forty three (43) square feet of Sidewalk Easement area described in Exhibit A, and depicted in Exhibit B, may contain petroleum hydrocarbons. If it is discovered during construction of the Downtown Circulation Phase I Project or any other excavation work with respect to the Sidewalk Easement area that the Sidewalk Easement area is contaminated with petroleum hydrocarbons or other contaminants, Grantee shall hold Grantor, and US Bank, and their respective successors and assigns harmless from any costs the City incurs to remediate the Sidewalk Easement area. There are no third party beneficiaries to this hold harmless agreement and this agreement shall not be read to obligate Grantee to clean up any contamination beyond what it would otherwise be required to do as the owner of the affected property. 1.6 This agreement and all of the terms, conditions, rights and obligations herein contained shall be binding upon the parties hereto, their successors, lessees and assigns.
