Renton Civic Theatre Rental Agreement 1 16:37 4/22/2022           CAG-22-137 Insurance Initial:_____ A Certificate of Insurance and Endorsement, naming Renton Civic Theatre a Primary and Non- contributory Additional Insured, must be submitted and approved by RCT 15 days prior to first booking date of contract. (See Appendix 1) Terms and Conditions This document is the complete and full agreement between the parties. If a provision of this agreement is held to be unenforceable, the other provisions will remain in effect. If possible, the offending provision will be modified to the slightest degree necessary to make it enforceable, remaining as close as is possible to the parties’ original intent for the provision. If not possible, the offending provision will be stricken. Payments Initial:_____ Agreement Initial:_____ Bookings require a 30% deposit of the total amount due upon signing. A processing fee of 3% will be charged for payments made by credit or debit cards. If checks are returned for cancellation, insufficient funds, closed accounts, or for any other reason, the Client will be charged $50. Unless special arrangements are mutually agreed to in writing, complete payment is due on (or before) the first day of rental. This contract represents an estimate based on the Event Plan the Client submitted. Actual usage will be billed post event, and billed/refunded accordingly using rates listed above. Clients are responsible for the prompt and full payment of all fees and charges, including those billed after the event reflecting any unexpected additional charges for usage, cleaning, repairs, disposal, replacement of lost items, and/or time overages. Late payments are subject to a charge of 5% late fee per month (or the maximum allowed by law) plus all collection fees (including reasonable attorney’s fees). Cancellation / Refund Policies Initial:_____ One half (50%) of the Deposit is non-refundable. Cancellations made less than thirty (30) days before event: No Refund. No refunds will be given for client cancellations due to inclement weather. Productions may require a production meeting and/or sound check with the lead technician prior to the event. Clients who waive or refuse a production meeting and/or sound check are not eligible for a discount or partial refund for any technical difficulties. In the event of overpayment, Renton Civic Theatre will refund the amount appropriate to actual usage as referenced in the Payments Section. Taxes Initial:_____ The Client may be subject to taxation associated with this Agreement. This includes, but is not limited to, sales taxes and a 5% City of Renton paid admission tax. The Client is responsible for paying all taxes. Renton Civic Theatre will not pay any taxes associated with your event. Booked Times Initial:_____ Rental times include all set-up and clean-up. The call times for RCT staff are generally 30-minutes before the booked time, and the calls usually extend to 30-minutes after each booking’s scheduled end. Some events may require more set-up or strike time. For bookings that (1) start or stop outside RCT’s ordinary operating hours (0600 – 2359) or (2) occur on federally-recognized holidays, additional charges may apply (rates for unusual hours are 1-1/2 times the usual rates). Additional fees ($100 to book, and possible pass through charges for last minute staff hires) apply for bookings with less than 49-hours advance notice. Renton Civic Theatre Rental Agreement Agreement Body Please print in duplex mode. 2 16:374/22/2022           Non-discrimination Initial:_____ Client reserves the right to refuse services to any persons or organizations that discriminate or have a history of discrimination on the basis of sex, race, religion or sexual orientation. Food / Drinks Initial:_____ Client will not allow anyone to take food or drinks into the auditorium. If you serve or offer food, you are responsible for knowing and following relevant regulations and safety standards for food storage, handling, and processing. If required, you will obtain required permits, credentials, and otherwise meet your legal and safety obligations. Only Renton Civic Theatre staff may handle, sell or serve alcohol. Consumable Supplies Initial:_____ Client must supply all consumable supplies. These include, but are not limited to, AA batteries, recordable media, plates, napkins, and cutlery. Staffing Initial:_____ At least one RCT staff memeber must be present at every event. This is generally, although not always, a House Manager. Events that use RCT equipment (lights, audio, etc.) a RCT technical staff member must be present. Only RCT-qualified persons may adjust, control, or attach to RCT gear. Persons intending to operate RCT equipment must be qualified by RCT prior to the event. Media Initial:______ Client takes full responsibility for electronic media delivery in a format a Windows 10 operating system will recognize, or will supply their own media playback device that will interface with Renton Civic Theatre's systems (typically a 3.5mm stero jack, or a usb port, and/or DisplayPort/VGA for video). Client agrees to have all electronic media delivered to Renton Civic Theatre with at least a three business day window before the contracted day for testing and troubleshooting. Client must deliver files cue-ready. This means formatted, named and/or imbedded in another program (PowerPoint is common) such that one cue leads into another in a logical and efficient way. RCT prefers portable hard disk drives for files of all sizes. In the event of transfer via the internet: the items must be completely downloaded by RCT with at least a five business day lead time, and RCT makes no guarantee of receipt via the internet until confirmed. Restoration Initial:_____ Clients will leave the facility - including the auditorium - in the same condition as when they arrived. Any lighting equipment or fixtures that have been repositioned or altered shall be restored to the House Plot. The cost of any additional cleaning, repairs or restorations will be charged to the Client. Clients are responsible for all lost property. Clients are encouraged to help reset the building in whatever capacity the House Manager deems acceptable (usually trash cleanup, de- decorating, chair/table breakdown, etc...). Rights Initial:_____ Client warrants that all presented or used materials in their presentation or performance will have pre-paid and unencumbered all needed clearances, licenses, permits, releases, permissions, rights and related documents. Client will be responsible for acquiring any additional rights or releases required for recording, distributing or broadcasting the performance if necessary. The use of any type of open flame is prohibited. Onstage smoking, when required in the production, will be permitted on a case-by-case basis, and will require a dedicated Fire Safety Officer. It is unlawful in the State of Washington to smoke anywhere within 25 feet of any public entrance to a public building. Licensees will not allow use of unglued glitter in the theatre. Extra charges for glitter clean-up will apply. Other than service animals, pets require special written permission of the Theatre Manager. Bicycles may not be parked in the theatre or near the entrance railings. No lighter than air toys or decorations (usually balloons, and hereafter refered to as 'balloons' collectively) are allowed in the auditorium. The fee for loose balloons is $50/balloon. Storage Initial:_____ Clients may not store items ('storage' is defined as leaving items at Renton Civic Theatre outside of contract start and end dates) at Renton Civic Theatre without special written permission of Theatre Manager. Leftover food and drinks may be disposed of by RCT after Client use. RCT may dispose of any item left more than 10-days. Cli ll d di lStrike Schedule Initial:______ Strikes' are when a client is required to clear the stage, backstage and dressing rooms of their (including but not limited to) props, costumes, and sets - hearafter refered to as 'gear' to open required area for another client. Renton Civic Theatre does not guarantee a strike schedule without contract line items. Clients should be prepared to 'full strike' after any rental session. 'Full Strikes' are when a client must remove their gear from the stage proper, and leave the dressing rooms in a state they are comfortable with others using in a limited capacity (makeup, bathroom, staging area, etc...). Generally an area of the backstage can be cordoned off to allow for an individual client's gear to be kept between rental dates in the same contract. Renton Civic Theatre assumes no responsibility for gear. The undersigned hereby certifies that the information in the agreement is correct and makes application to Renton Civic Theatre for use of the facilities described above and in attached Appendices. The undersigned: • Attests that he/she has the authority to make this agreement for the Licensee; • Agrees to exercise the utmost care in the use of the listed premises and property; and • Warrants that the Licensee will to use only the listed facilities and amenities, and will return them to their original condition and configuration; • Guarantees payment for any and all charges including, but not limited to, cancelation, rental, and cleaning fees. Will insure that Renton Civic Theatre and all and each of its agents, employees, contractors, corporate officers, and other related entities will be protected in every context from and free from any and all liability resulting from or associated with this Agreement. We require a copy of Certificate of Insurance meeting the following industry standards: - $1,000,000 in Commercial General Liability, with $2,000,000 in the aggregate; - $1,000,000 in Auto Liability (if a vehicle will be used in performance of work. This includes delivery of products to worksite); - $1,000,000 in Excess Liability (if required in contract; can be in tandem with Commercial General Liability coverage); and - $1,000,000 in Professional Liability (if required in contract) The Certificate should: - Name the Renton Civic Theatre as an Additional Insured on the policy; Have its cancellation clause include a notification to Renton Civic Theatre of any cancelation: “Should any of the above described policies be cancelled before the expiration date thereof, notice will be delivered in accordance with the policy provisions.” - Include descriptive text of the event in the “Description of Operations” box; and - Name the certificate holder as: Renton Civic Theatre 507 South 3rd St Renton, Washington. 98057 Please provide us with: - The endorsement page(s) from the policy evidencing Primary and Non-contributory insurance coverage; and Proof of Workers’ Compensation coverage.
