4468CITYOFRENTON,WASHINGTONRESOLUTIONNO.4468ARESOLUTIONOFTHECITYOFRENTON,WASHINGTON,AUTHORIZINGTHEMAYORANDCITYCLERKTOENTERINTOANAGREEMENTBETWEENTHECITYOFRENTONANDKINGCOUNTYWATERDISTRICT#90FORTHETRANSFEROFFIVEDOMESTICWATERSERVICESFROMTHEDISTRICTTOTHECITY.WHEREAS,anagreementisneededforthetransferofwaterserviceforfiveexistingwatercustomersfromKingCountyWaterDistrict#90(“theDistrict”)totheCityofRenton(“theCity”);andWHEREAS,thesubjectpropertiesarewithintheexistingCity’swaterservicearea,thereforethetransferofserviceisconsistentwithCitypracticesandpolicies,theCity’sadoptedWaterSystemPlan,andtheEastKingCountyCoordinatedWaterSystemPlan;andWHEREAS,theCitycanprovidewaterservicetothepropertieswithconnectionstoexistingCitywatermainsinthevicinityoftheproperties;WHEREAS,theDistricthasagreedtoreimbursetheCityforallcostsassociatedwiththeinstallationofthethree¾-inchwaterservicesandtwo1-inchwaterservicespursuanttothecurrentCityofRentonFeeSchedule;andWHEREAS,theCityofRentonhasagreedtowaivetheWaterSystemDevelopmentChargeforeachtransferredproperty;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DORESOLVEASFOLLOWS:SECTIONI.TheMayorandCityClerkareherebyauthorizedtoenterintotheAgreementonTransferofWaterServicewithKingCountyWaterDistrict#90forthetransferof1 1.4519NE10thSt(KingCountyTaxParcelID1023059075);2.4531NE10thSt(KingCountyTaxParcelID102305916$);3.4637NE10thSt(KingCountyTaxParcelID1023059112);4.1051ChelanAveNE(KingCountyTaxParcelID1023059133);5.1155DuvaIlAveNE(KingCountyTaxParcelID1023059378),andr1w-1::AGREEMENTONTRANSFEROFWATERSERVICEBETWEENTHECITYOFRENTONANDKINGCOUNTYWATERDISTRICT#90THISAGREEMENTisenteredintothis—dayof____________,2022,byandbetweentheCITYOFRENTON,aWashingtonmunicipalcorporation,hereinafterreferredtoas“City”andKINGCOUNTYWATERDISTRICT#90,aWashingtonmunicipalcorporation,hereinafterreferredtoas“District”,1.1WHEREAS,DistrictandCityaretheownersandoperatorsofwatersystemsinKingCounty,Washington.TheDistrict’scorporateboundaryoverlapsand/orisadjacenttoCity’scorporateboundary,and1.2WHEREAS,Districtcurrentlyprovideswaterservicebya4-inchsteelwatermainand8-inchsteelwatermaintothefollowingfiveproperties,hereinafterreferredtoasthe“Properties,”withinitscorporateboundariesattheaddresseslistedbelowandasshownonExhibitA:1.3WHEREAS,theDistrict’ssteelwatermainsareover60yearsoldandattheendoftheirusefullife,areinneedofreplacement,and1.4WHEREAS,theDistrict’ssteelwatermainsareinconflictwithproposedstormdrainandfrontageimprovementsandadjacentsitedevelopment,and1.5WHEREAS,theCityprovideswaterservicewithinitsserviceboundariesasestablishedwithintheCity’sComprehensiveWaterSystemPlanandhasanexisting10-inchductileironwatermainwithinNE10thSt,anexisting16-inchductileironwatermainwithinDuvallAveNE,andexisting8-inchwatermainwithinChelanAveNE,and1.6WHEREAS,theCityandtheDistrictbelievethatitwouldbeinthebestinterestoftheDistrict,City,andthePropertiestotransferwaterservicetoCity.TheCityisagreeabletoprovidingwaterservicePage-1 tothePropertiesthatarewithintheCity’swaterserviceboundaryidentifiedwithintheCity’sWaterSystemPlan,and1.7WHEREAS,DistrictandCityareauthorizedbyChapter39.34RCWtoenterintointer-localagreementsforjointaction.Inconsiderationofthetermsandconditionscontainedherein,thepartiesnowagreeasfollows:2.1TheDistrictagreestotransfertotheCity,waterservicetotheProperties.InconsiderationoftheDistrict’stransferoftheProperties,theCityshallacceptandprovidewaterservicetotheProperties.TheCityshallinstallnewservicelaterals,makeserviceconnectionstoCitywatermains,andprovidenewwatermeters.TheDistrictshallmakeextensionsoftheprivateserviceconnectionstoaccommodateconnectiontothenewwatermeters.2.2TheCityagreestowaivetheWaterSystemDevelopmentChargeforeachProperty.TheDistrictwillreimbursetheCityfortimecostandmaterialsperratesestablishedundertheCityofRentonFeeScheduletocompletetheworkidentifiedwithinthisAgreement.2.3ThepartiesagreetocooperatetoeffectthepurposeofthisAgreementandtoexecuteanyfurtheragreementsordocumentsrequiredforsuchcustomertransfer.TheDistrictwillprovidetheowners/residentsofthePropertieswithamailednoticeregardingtheproposedchangeofwaterpurveyorfromtheDistricttotheCityatleast45daysbeforethedateofsuchtransfer.ThenoticeshallprovideinformationastothemeetingdatebeforetheDistrict’sBoardofCommissionerswhereowners/residentswillhaveanopportunitytocommentonthetransfer.2.4EachpartyshallapprovethisAgreementbyappropriateresolutionorordinanceandprovidetheotherpartywithacertifiedcopyofthesame.ThisAgreementshalltakeeffectuponitsapprovalbytheCity’sCityCouncilandtheDistrict’sBoardofCommissioners.EachpartyrepresentstotheotherthatithasthefullpowerandauthoritytoenterintothisAgreement.ThisAgreementmaynotbeterminatedinwholeorpartbyeitherpartiesortheirsuccessorsininterest.CITYOFRENTONATfESTArmondoPavone,MayorJasonSeth,CityClerkDateApprovedastoLegalFormShaneMoloney,CityAttorneyPage-2
