HomeMy WebLinkAboutContractAGREEMENTONTRANSFEROFWATERSERVICEBETWEENTHECITYOFRENTONANDKINGCOUNTYWATERDISTRICT#90THISAGREEMENTisenteredinto this/_dayof__________,2022,byandbetweentheCITYOFRENTON,aWashingtonmunicipalcorporation,hereinafterreferredtoas“City”andKINGCOUNTYWATERDISTRICT#90,aWashingtonmunicipalcorporation,hereinafterreferredtoas “District”,1.1WHEREAS,DistrictandCityaretheownersandoperatorsofwatersystemsinKingCounty,Washington.TheDistrict’scorporateboundaryoverlapsand/orisadjacenttoCity’scorporateboundary,and1.2WHEREAS,Districtcurrentlyprovideswaterservicebya4-inchsteelwatermainand8-inchsteelwatermaintothefollowingfiveproperties,hereinafterreferredtoasthe“Properties,”withinitscorporateboundariesattheaddresseslistedbelowandasshownonExhibitA:1.4519NE10thSt(KingCountyTaxParcelID1023059075);2.4531NE10thSt(KingCountyTaxParcelID1023059168);3.4637NE10thSt(KingCountyTaxParcelID1023059112);4.1051ChelanAveNE(KingCountyTaxParcelID1023059133);5.1155DuvallAveNE(KingCountyTaxParcelID1023059378),and1.3WHEREAS,theDistrict’ssteelwatermainsareover60yearsoldand attheendoftheirusefullife,areinneedofreplacement,and1.4WHEREAS,theDistrict’ssteelwatermainsareinconflict withproposedstormdrain andfrontageimprovementsandadjacentsitedevelopment,and1.5WHEREAS,theCityprovideswaterservicewithinitsserviceboundariesasestablishedwithintheCity’sComprehensiveWaterSystemPlanandhasanexisting10-inchductileironwatermainwithinNE10thSt,anexisting16-inchductileironwatermainwithinDuvall AveNE,andexisting8-inchwatermainwithinChelanAveNE,and1.6WHEREAS,theCityandtheDistrictbelievethatitwouldbeinthebestinterestoftheDistrict,City,andthePropertiestotransferwaterservicetoCity.TheCityisagreeabletoprovidingwaterservicePage-1CAG-22-149 tothePropertiesthatarewithintheCity’swaterserviceboundaryidentifiedwithintheCity’sWaterSystemPlan,and1.7WHEREAS,DistrictandCityareauthorizedbyChapter39.34RCWtoenterintointer-localagreementsforjointaction.Inconsiderationofthe termsandconditionscontainedherein,thepartiesnowagreeasfollows:2.1TheDistrictagreestotransfertotheCity,waterservicetotheProperties.InconsiderationoftheDistrict’stransferoftheProperties,theCityshallacceptandprovidewaterservicetotheProperties.TheCityshallinstallnewservicelaterals,makeserviceconnectionstoCitywatermains, andprovidenewwatermeters.TheDistrictshallmakeextensionsoftheprivateserviceconnectionstoaccommodateconnectiontothenewwatermeters.2.2TheCityagreestowaivetheWaterSystemDevelopmentChargeforeachProperty.The DistrictwillreimbursetheCityfortimecostandmaterialsperratesestablishedundertheCityofRentonFeeScheduletocomplete theworkidentifiedwithinthisAgreement.2.3ThepartiesagreetocooperatetoeffectthepurposeofthisAgreementandtoexecuteanyfurtheragreementsordocumentsrequiredforsuchcustomertransfer.TheDistrictwillprovidetheowners/residentsofthePropertieswithamailednoticeregardingtheproposedchangeofwaterpurveyorfromtheDistricttotheCityatleast45daysbeforethedateofsuchtransfer.ThenoticeshallprovideinformationastothemeetingdatebeforetheDistrict’sBoardofCommissionerswhereowners/residentswillhaveanopportunitytocommentonthetransfer.2.4EachpartyshallapprovethisAgreementbyappropriateresolutionorordinanceand providetheotherpartywithacertifiedcopyofthesame.ThisAgreementshalltakeeffectuponitsapprovalbytheCity’sCityCouncilandtheDistrict’sBoard ofCommissioners.EachpartyrepresentstotheotherthatithasthefullpowerandauthoritytoenterintothisAgreement.ThisAgreementmaynotbeterminatedinwholeorpartbyeitherpartiesortheirsuccessorsininterest.CITYOFRENTONATfESTArmondoPavone,MayorJasonSeth,CityClerkDateApprovedastoLegalFormShaneMoloney,CityAttorneyPage-25-4-2022Approved by Cheryl Beyer via 3/22/2022 KINGCOUNTYWATERDISTRICT4190A1TESTDarceyPØrs,GeneralManager4LZ/DateApprovedastoLegalFormPatrick,rDistrorneyPage-3 EXHIBITATransferofServices-KCWD9OtoCityofRentonI..—CityofRentonwatermain—KingCountyWaterDistrictNo.90watermainPropertiestobetransferred(5)flPropertiespurchasedbyRentonSchoolDistrictforproposedRentonElementary#16
