This addendum shall clarify the Contract Documents as follows: Item No. 1 – Specification Section 00 72 00 – General Conditions 1. Revise Section 2.6 to: Builders Risk Insurance: Contractor shall purchase and maintain Builders Risk insurance in the amount of the Contract Sum including all Change Orders for the Work on a replacement cost basis until Substantial Completion. For projects not involving New Building Construction, “Installation Floater” is an acceptable substitute for the Builder’s Risk Insurance. The insurance shall cover the interest of Owner, Contractor, and any Subcontractors, as their interests may appear. DIVISION 00 – PROCUREMENT AND CONTRACTING REQUIREMENTS PHILIP ARNOLD PARK SITE IMPROVEMENTS Section 00 72 00 – General Conditions Contract No. CAG-22-015 Philip Arnold Park Improvements 00 72 00 - 8 of 54 May 26, 2022 2.4 PAYMENT AND PERFORMANCE BONDS Conditions for bonds: Payment and performance bonds for 100% of the Contract Award Amount, plus state sales tax, shall be furnished for the Work, using the City of Renton Contract Bond Form provided. Prior to execution of a Change Order that, cumulatively with previous Change Orders, increases the Contract Award Amount by 15% or more, the Contractor shall provide either new payment and performance bonds for the revised Contract Sum, or riders to the existing payment and performance bonds increasing the amount of the bonds. The Contractor shall likewise provide additional bonds or riders when subsequent Change Orders increase the Contract Sum by 15% or more. No payment or performance bond is required if the Contract Sum is $35,000 or less and Contractor agrees that Owner may, in lieu of the bond, retain 50% of the Contract Sum for the period allowed by RCW 39.08.010. 2.5 ALTERNATIVE SURETY When alternative surety required: Contractor shall promptly furnish payment and performance bonds from an alternative surety as required to protect Owner and persons supplying labor or materials required by the Contract Documents if: A.Owner has a reasonable objection to the surety; or B.Any surety fails to furnish reports on its financial condition if required by Owner. 2.6 BUILDER’S RISK A.Builders Risk Insurance: Contractor shall purchase and maintain Builders Risk insurance in the amount of the Contract Sum including all Change Orders for the Work on a replacement cost basis until Substantial Completion. For projects not involving New Building Construction, “Installation Floater” is an acceptable substitute for the Builder’s Risk Insurance. The insurance shall cover the interest of Owner, Contractor, and any Subcontractors, as their interests may appear. B.Losses covered: Contractor property insurance shall be placed on an “all risk” basis and insure against the perils of fire and extended coverage and physical loss or damage including theft, vandalism, malicious mischief, collapse, false work, temporary buildings, debris removal including demolition occasioned by enforcement of any applicable legal requirements and shall cover reasonable compensation for A/E’s services and expenses required as a result of an insured loss. C.Waiver of subrogation rights: Owner and Contractor waive all subrogation rights against each other, any Subcontractors, A/E, A/E’s sub-consultants, separate contractors described in Section 5.20, if any, and any of their subcontractors, for damages caused by fire or other perils to the extent covered by property insurance obtained pursuant to this section or other property insurance applicable to the Work, except such rights as they have to proceeds of such insurance held by Owner as fiduciary. The policies shall provide such waivers of subrogation by endorsement or otherwise. Bidder’s Question: • Can we have the CAD released for digitizing. The plans will not vectorize. This would make the process much simpler and less costly. Response: • AutoCAD drawings and files will be made available to the contractor at the preconstruction meeting. An updated PDF of the drawings has been uploaded to the city’s website for download at the following link. We have zoomed into the plan drawings at 800% and the linework is showing as vectors/vector compatible. Bidder’s Question: • The plan sheet LS.22 Detail 5 (Picnic Shelter Colum) says “determined by manufacturer”, and Appendix E (Picnic Shelters Plans & Details says “A licensed engineer familiar with soils conditions at the construction site must perform a foundation design? Response: • Per manufacturer Recreation Today, footing/foundation design is included in the engineering drawings they provide. Picnic Shelters. 4. Bidder’s Question: • The length of the boardwalks is not specifically called out. A question from the specified vender is asking for the exact length please. Response: • The length down the center line of the boardwalk is 143.93 linear feet. 5. Bidder’s Question: • Builder’s Risk: Reference: 00 72 00 – Part 2, 2.6 – “Contractor to buy Builder’s Risk Insurance when the project involves substantial new building construction, as determined by the owner”… Question: Will Builder’s Risk coverage be required for this project? Response: • Yes. See Addendum B, Item No. 1 for update to Section 00 72 00, GENERAL CONDITIONS, 2.6 Builder’s Risk 6. Bidder’s Question: • What is the deadline and procedure to file a bid protest? Response: • The City follows RCW 39.04.105 and State Law for bid protests. 7. Bidder’s Question: • In 1.5, Supplemental Conditions, there are MBE/WBE goals listed for Purchased Goods, Purchased Services and Professional Services. Please clarify if these are in addition to, of if they supersede those listed in the General Conditions, 10.11. The percentages do not match up. Response: • These sections provide the voluntary State and Federal goals. The City of Renton encourages Diverse Business Participation and contractors are urged to meet or exceed these goals. No documentation of participation effort is required. 8. Bidder’s Question: • In Sections 32 32 19, 32 33 00 and 32 33 00, Item 1.11 states: Bidders Questions – Philip Arnold Park Site Improvements (CAG-22-015) Page 3 of 6 May 26, 2022 Philip Arnold Park Site Improvements CAG-22-015 Bidder Questions and Response • Please provide clarification on the intent of this provision and how it impacts the manufacturer’s warranties and work required of certified technicians. Response: • The intent is that the general contractor is responsible for the work of their team of subcontractors. It does not impact warranties of fabricators and manufacturers. The work of the general contractor’s team must adhere to the contract documents. 9. Bidder’s Question: • Section 00 20 00 – Bidder’s Qualification Statement, states that the information included in this section must be submitted “as part of this bid”. However, Section 00 42 10, 1.2 -1.4, does not list this section as required as due concurrently with the bid. Please confirm if Section 00 20 00 should be 1) submitted with the bid, or 2) if it is intended to be submitted as part of 00 42 10, 1.5, the Supplemental Bidder information from the apparent low bidder, or 3) if it is not required to be turned in. Response: • Qualifications Statement through Form D is revised and required to be submitted with the bid. • See Addendum B, Items No. 2, 3, and 4 for updates to Sections 00 42 10, 00 80 00, and 00 80 00d. 10. Bidder’s Question: • Are stamped structural drawings available for the boardwalk system according to note 1.5B of the Permatrak specifications (page 6 of the PermaTrak drawings)? Typically the engineer of record for the project will supply the pile designer with the pile locations and loading, which may include dead, live, and seismic loads. These may vary from the suggested values provided by the boardwalk manufacturer. Response: • Stamped engineer drawings are to be provided from the manufacturer in submittal process per 32 33 000.1 Boardwalk, 1.06 Submittals: A.2.a. Shop Drawings, A.2.b. Bidder’s Question: • Is the 1 kip per helical pier lateral force to be applied in both transverse and longitudinal directions to the boardwalk? Typically battered piles (if utilized) are provided in both directions if bracing is required to resist seismic forces, it appears only transverse bracing is shown in the drawings. Response: • Drawings and details were developed with manufacturer. Changes to bracing shown in drawings and details would need to be presented as part of the stamped engineer drawings provided from the manufacturer in submittal process per 32 33 000.1 Boardwalk, 1.06 Submittals. 12. Bidder’s Question: • Can the geotechnical engineer verify if larger diameter (6” or 8”) vertically driven pipe or 8” wide flange piles may be able achieve the minimum lateral capacity (1 kip per pile) in lieu of using a combination of vertical and battered helical piles at each bent? Alternately, can the geotechnical engineer provide allowable passive soil pressures such that a driven pile may be designed to support the 1kip lateral loading per pile? Response: • An ultimate passive resistance of 400 pcf below a depth of 5 feet from existing grade could be used when assessing the use of driven larger diameter pipe or H- piles in lieu of driven pin piles or helical anchors for the boardwalk. Changes to drawings and details that were developed with manufacturer, would need to be presented as part of the stamped engineer drawings provided from the manufacturer in submittal process per 32 33 000.1 Boardwalk, 1.06 Submittals. 13. Bidder’s Question: • The geotechnical engineer’s report provides a helical pile capacity of 9 kips (allowable) and states that 2 piles will be required for each foundation to achieve the boardwalk manufacturer’s stated loading of 17kips per helical pier. It is unclear how a 2-pile configuration can be used with the PermaTrak system. Is a single larger 17k capacity helical pile acceptable in lieu of double piles at each pier? Response: • A single larger 17-kip axial compressive capacity helical pier would be acceptable from the geotechnical perspective in lieu of double helical piers. Bidder’s Question: • Section 00 42 10 – Bid Submittal Checklist, requires submission of item #5 “Deposit or Contract Bond Form” (Form F) at “time of bid submission”. However, our surety will not complete this form until there is a determination of contract award and a final dollar amount provided. Please advise if submission of the Contract Bond Form (F) can be provided post-bid, by low bidder, following Notice of Intent to Award. Response: • Language in Section 00 42 10 states bidder is to complete the Deposit or Contract Form not that Contract Bond Form F is to be submitted with the bid. Contract Bond Form F is to be submitted with the Executed Agreement following Notice of Intent to Award per Section 00 80 00 Forms. 15. Bidder’s Question: • I’ve noticed a scaling error on Drawing Numbers LP.04 thru LP.06. These plan sheets are enlargements of planting areas from Drawing Numbers LP.01 thru LP.03. The scaling on LP.04 thru LP.06 should be 1” = 10’. They currently show 1” = 5’. Response: • The plan enlargements are drawn to 1” = 5’ scale. The scale bar shown under the detail line will be revised to show 1” = 5’ scale and reissued in Addendum C. 16. Bidder’s Question: • I found one symbol that is on planting enlargement details 1 and 2 (part of Alternate 1) on Drawing Number LP.06. See below. I found 19 of these symbols but I don’t see the symbol on either planting schedule. Please confirm what this symbol is representing. Response: • This is a daylily symbol. The plant will be added into the Alternate 1 Plant Schedule on Drawing Number LP.06 and reissued in Addendum C. 17. Bidder’s Question: • It appears that if Alternate 1 is selected, planting enlargements 3 & 4 would not be used as this is where the Scramble is to be installed. Please confirm. Response: • This is correct. 18. Bidder’s Question: • Request to approve DecoColor and Plexipave products as an accepted substitute on Basketball Court Surfacing. Response: • The DecoColor and Plexipave products would be valid products to submit for review as substitution requests during the construction process under the Contract Specification 01 40 10 Product Substitution Request when the contract has been awarded.
