The official record is recorded on tape. The hearing opened on Tuesday, May 23,2000,at 9:00 a.m. in the Council Chambers on the seventh floor of the Renton City Hall. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit No. 1: Yellow file containing the appeal, Exhibit No.2: Photo Map proof of posting and publication,and other documentation pertinent to the appeal. Exhibit No.3: Series of photographs(4 pages) Parties present: Representing Appellant: Mary Ryan, on behalf of Max Ryan 1325 Shattuck Avenue S Renton,WA 98055 Representing City of Renton Zanetta Fontes,City Attorney Jana Hanson,Development Services Director Dave Christianson 1055 S Grady Way Renton,WA 98055 Max Ryan Appeal of Administrative Determination re Off-Site Deferral of Ryan Short Plat File No.: LUA00-048,AAD June 13,2000 Page 2 The Examiner explained that the appeal was an administrative appeal held pursuant to Ordinance 3071 and was the only administrative review to occur on the matter. The matter may be submitted back to the Examiner for reconsideration if the parties are not satisfied with the decision. He stated that the appellant had the burden of demonstrating that the City's action was erroneous, and would have to show clear and convincing evidence that the City's determination was incorrect. At that point the City could respond, if they chose to do so. Mary Ryan, appellant representative herein,based their position on three different points: (1)other properties with similar situations had recently been granted a deferral; (2) sidewalks in the vicinity were constructed in the 1940's and'are very different from those currently being installed; and(3)providing one affordable housing unit of less than 1,000 square feet. Ms. Ryan presented photographs of a property located on Harrington Avenue NE and 13th which had 1940's era sidewalks and had recently been subdivided and granted a deferral from the City. The deferral was granted even though across the street there were current raised sidewalks in effect near McKnight Middle School. The subject site has no current raised sidewalks nearby. From photographs of the subject site, it was shown that the current vintage sidewalks nearby are little more than slight elevations of the road and are not maintained. There are no sidewalks of any kind at the subject site. Ms.Ryan further stated that there is little if any new housing under 1,000 square feet to provide affordable housing in the area. If appellant is required to put in the street improvements of approximately$20,000.00 for this site,they would probably be unable to provide further affordable housing at another location. Dave Christianson; stated that as a member of the Board of Public Works,he was asked to consider a request for an off-site deferral for the installation of curb,gutters and sidewalk along the frontage of the subject short plat, and that the request was denied. Existing sidewalks in the vicinity were located and described by Mr.. Christianson. He stated that deferrals had been granted previous to this request,but the Board of Public Works had changed its policy. This policy change was due to a concern that the deferral process may make it difficult to get improvements at a later date. Once the lots are subdivided into single family lots,they are exempt from off-site improvement requirements. The denial of the subject deferral was based on the fact that there are existing improvements in the area, it is considered to be a part of the City's missing links sidewalk program, and its proximity to Highlands Elementary School. Since the deferral process which has been used since the late 1980's,the City has processed 44 requests. It has granted three waivers and denied deferrals four times. Of the remaining 37 requests a covenant was granted,but no development has been done to those at this time. Mr. Christianson estimated that the cost of installing curbs, gutters and sidewalks would be about$9,000.00 for this site. Ms. Fontes, in her closing statement, concluded that the Board of Public Works had changed its position on deferrals based on the difficulty of obtaining future development of the sites. As to the issue of providing affordable housing at this time,the expense of improving it at a later time would fall to the new homeowner, who may or may not be aware of the deferral or be able to afford it. The Examiner called for further testimony regarding this appeal. There was no one else wishing to speak. The hearing closed at 9:55 a.m. Max Ryan -- Appeal of Administrative Determination re Off-Site Deferral of Ryan Short Plat File No.: LUA00-048,AAD June 13,2000 Page 3 FINDINGS, CONCLUSIONS &DECISION Having reviewed the record in this matter,the Examiner now makes and enters the following: FINDINGS: 1. The appellant,Max Ryan represented by Mary Ryan, hereinafter appellant,filed an appeal of a decision of the Board of Public Works denying a deferral for curbs,gutters and sidewalks adjacent to appellant's property(File No. LUA-00-014; SHPL-A). 2. The appellant owns property located at 630 Index Avenue NE in the City of Renton. The subject site is a corner lot located on the southeast corner of the "T" intersection of Index Avenue NE and NE 6th Place. (The reader is urged to make the distinction between NE 6th Street, a block south of the subject site and Index Place NE, a block east of the subject site.) 3. The applicant proposes dividing the subject site into two lots to develop a second single family home. The existing home would be located on the southernmost lot. The new lot would be the corner lot with frontage along both Index Avenue NE and NE 6th Place. 4. The appellant has suggested that the new home will be small, and that to make it affordable the minimum improvements would be installed. Therefore,the appellant has applied for a deferral of the requirements to install curbs, gutters and sidewalks along the frontage of the existing lot or along the frontage of the resulting two lots. 5. The appellant has shown that sidewalks do not exist along the sides of the frontage of either Index Avenue NE or NE 6th Place where the subject lots are located. The lots just end and the roadway begins. 6. The appellant has similarly shown that there are other frontages along the north side of NE 6th Street, south of the subject site and along the east side of Index Place NE east of the subject site where no sidewalks or curbs or gutters are installed. 7. Staff has shown that there is an asphalt sidewalk immediately west of Index across from the subject site and another along the north side of NE 6th Place. Similarly,there is a sidewalk on the west side of Index Place NE across from the segment cited by the appellant. 8. Staff also testified that the City has shifted its policies regarding sidewalks, curbs and gutters within the last year. The City now requires sidewalks with new subdivision and infrequently will permit a developer to not install the improvements concurrent with new development. The City has found that it creates safer streets and facilitates pedestrian passage. 9. In the past,the City would accept covenants to install the improvements in the future. In practical terms,this meant sidewalks were either not installed or passed the cost on to new owners who were barely aware they were responsible. In addition,the City has what staff called a"sidewalk program"to fill in missing links. In other words, the City now appears to emphasize installing sidewalks when new development occurs or where safety is at issue such as near schools. City Code requires the installation of sidewalks, etc.,whenever there is new development, even on existing lots except for single family homes. The only time single family development is subject to the improvement standards is when a parcel is subdivided. 11. Since it has adopted this policy,the Board has denied all deferrals. 12. The frontage affected is approximately 225 linear feet and staff has calculated an approximate cost of $9,000.00 for the improvements. CONCLUSIONS: 1. The appellant has the burden of demonstrating that the Board of Public Works' decision was either in error, or was otherwise contrary to law or constitutional provisions, or was arbitrary and capricious (Section 4-8-110 (E)(7)(b). The appellant has failed to demonstrate that the action of the board should be modified or reversed. The decision of the board is affirmed. 2. Arbitrary and capricious action has been defined as willful and unreasoning action in disregard of the facts and circumstances. A decision,when exercised honestly and upon due consideration of the facts and circumstances, is not arbitrary or capricious(Northern Pacific Transport Co.v Washington Utilities and Transportation Commission, 69 Wn. 2d 472,478 (1966). 3. An action is likewise clearly erroneous when, although there is evidence to support it,the reviewing body,on the entire evidence, is left with the definite and firm conviction that a mistake has been committed. (Ancheta v Daly, 77 Wn.2d 255,259 (1969). 4. The appellant has failed to demonstrate that the decision was founded upon anything but a fair review of facts and requirements of code as it pertains to the proposed use. The appellant has failed to demonstrate with cogent evidence that a mistake was made. 5. There are sidewalks in the neighborhood. There are even sidewalks directly across the street from this corner lot. These sidewalks are west and north of the subject site. While those walks may not meet current standards,they are present. 7. Code requires the frontage to be improved when a plat is created. The appellant proposes dividing the subject site into two lots. There will be additional traffic generated even if it is not very much. There may be new students since each single family home generally generates additional students for the local school district. 8. Staff noted a recent shift in policy to requiring sidewalks and the other frontage improvements with subdivision rather than deferring those items into an uncertain future. Staff also believes it is improper to pass those costs on to new residents when they are supposed to be borne by the subdivider of the property. The City also has adopted a "missing link" policy to provide sidewalks in areas where they are absent. Deferring the improvements for the appellant's property would be contrary to that policy. The City noted that it now generally denies deferrals and approving the current request would create a new precedent also contrary to that new policy. 10. If the appellant is not required to install the sidewalks,there would be nothing that would trigger their subsequent installation since after subdivision, single family areas are exempt from triggering events. If the City were to want sidewalks,the City would have to absorb the costs and pass them on to the general public rather than on the current development. 11. Since the burden of demonstrating error is on the appellant,this office can reach no other conclusion but that the board made the correct determination. The decision below must be affirmed. Any aggrieved person feeling that the decision of the Examiner is ambiguous or based on erroneous procedure, errors of law or fact, error in judgment, or the discovery of new evidence which could not be reasonably available at the prior hearing may make a written request for a review by the Examiner within fourteen(14)days from the date of the Examiner's decision. This request shall set forth the specific ambiguities or errors discovered by such appellant, and the Examiner may, after review of the record,take further action as he deems proper. An appeal to the City Council is governed by Title IV, Chapter 8, Section 16,which requires that such appeal be filed with the City Clerk, accompanying a filing fee of$75.00 and meeting other specified requirements. Copies of this ordinance are available for inspection or purchase in the Finance Department, first floor of City Hall. If the Examiner's Recommendation or Decision contains the requirement for Restrictive Covenants,the executed Covenants will be required prior to approval by City Council or final processing of the file. You may contact this office for information on formatting covenants. The Appearance of Fairness Doctrine provides that no ex parte(private one-on-one) communications may occur concerning pending land use decisions. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council. All communications concerning the proposal must be made in public. This public communication permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. The reason for appeal is the board denied the request because it was stated at the appeal meeting there are existing sidewalks in the immediate area of the subject property. Several other short plat off site deferral requests have been approved recently with the same type of existing sidewalks. One example is the Stimach Short Plat LUA-98-124 (1308 Harrington AVE.N.E.). I understand affordable housing is of great concern. A granting of this deferral will make it possible to continue with the project,the final product will be a single family home which will provide affordable housing in the the City. The Stimach property division produced a small home with a market value of approximately$180,000. My plan is to put a single family home on the market priced under$150,000. I need this deferral in order to proceed with this small home plan. MOTION • CARRIED. : .. : { Board of Public Works March 29,2000 Page 2 • ON-SITE DEFERRAL, OAKESDALE BUSINESS BUILDING A&B, 4100 and 4101 Oakesdalel Ave. S.W. - Applicant requests a deferral for the installation of required trash rack on a box culvert in Springbrook until the City of Renton Drainage District and the Department of Fish and Wildlife approve the design. Discussion: Neil Watts,Plan Review Supervisor. In order to make the driveway work and line up with 41 st St., a private bridge was built to cross Springbrook Creek. This bridge was not designed or planned for a trash rack. Structurally, it cannot accommodate the trash rack. It will have to be built separate. This new design work has not been submitted as yet for review and approval. If a flood were to occur,they could not get there to remove logs,etc. The trash rack is a condition of the construction permit. The Drainage District needs a separate easement for the bridge. Woody debris was not placed according to the Fisheries permit on high banks and this condition must also be met before release of the security device. All construction site work has been completed and approved per the plans and specifications with the exception of the trash rack. The applicant is asking that the trash rack be covered by a security device so that the Certificate of Occupancy can be issued for the project. The trash rack is currently being redesigned and will be resubmitted to the City Drainage District and the Department of Fish and Wildlife for approval.
