Staff Review Comments Representatives from various city departments have reviewed the application materials to identify and address issues raised by the proposed development. These comments are contained in the official file, and the essence of the comments has been incorporated into the appropriate sections of this report and the Departmental Recommendation at the end of the report. 5. Consistency Short Plat Criteria Approval of a plat is based upon several factors. The following short plat criteria have been established to assist decision-makers in the review of the plat: a) Compliance with the Comprehensive Plan Designation The site is designated Residential Options (RO)on the Comprehensive Plan Land Use Map. The RO designation is intended to provide a variety of unit types designed to incorporate features from both single family and multi-family residences and to support infill development. The proposal is consistent with the RO designation in that it would provide for future construction of single family homes and would promote goals of infill development. The proposal is consistent with the following Comprehensive Plan Land Use and Housing Elements policies: Policy LU-51. The net development densities should be 10 dwelling units per acre. If 100% of the dwelling units are detached, a density bonus may be allowed to a maximum of 13 dwelling units per acre. The proposal for four units on a .36-acre site would result in a density of approximately 11.1 dwelling units per acre, which complies with the allowed density bonus. Policy LU-53. Detached single family housing, townhouses, and small-scale multi-family units should be allowed in Residential Options. The subject site is currently developed with a duplex residential structure. Encourage infill development as a means to increase capacity. The proposal would create three additional lots, thereby increasing density within a currently developed residential area. Furthermore, the proposal is utilizing the maximum density bonus allowed in the Residential Option designation by proposing all detached units. b) Compliance with the Underlying Zoning Designation • The subject site is designated Residential - 10 Dwelling Units per Acre (R-10) on the City of . Renton Zoning Map. The proposed development would allow for the future construction of up to four new single family dwelling units. The allowed density range in the R-10 zone is a minimum of 7.0 to a maximum of 10.0 dwelling units per acre. The maximum density may be increased to 13.0 units per acre, provided all detached units are proposed. Net density is calculated after the deduction of sensitive areas and areas intended for public right-of-way from the gross acreage of the site. The property does not contain any sensitive areas or areas required for right-of-way dedication. Therefore, the proposal would arrive at a net density of 11.1 dwelling units per acre, which is within the allowed density bonus range. The minimum lot size and dwelling unit mix requirements of the R-10 zone do not apply to parcels less than one-half acre in size. The proposal, at .36 acre in size, would create four lots ranging in size from 3,480 square feet (lot 1) to 4,876 square feet (lot 2). The proposed lot sizes are compatible with other existing lots in this area under the same R-10 zoning classification. As indicated in the applicant's project narrative, the proposal would demolish the existing structures on the property, including the 1,728 square foot duplex and 576 square foot detached garage. As a condition of approval, staff will recommend the applicant be required to obtain demolition permits (issued, inspected, and finaled) prior to the recording of the short plat. , c) Compliance with Subdivision Regulations Streets: No new public streets would be created as part of the proposed short plat. All street frontage improvements are currently existing. The proposed subdivision is anticipated to generate additional traffic on the City's street system. In order to mitigate transportation impacts, a Transportation Mitigation Fee based on $75.00 per net new average daily trip attributed to the project will be required. The additional lots are expected to generate approximately 19.1 (2 new lots x 9.55 trips = 19.1) new average weekday trips. The fee for the proposed short plat is estimated at$1,432.50 (19.1 trips x$75.00 = $1,432.50)and is payable prior to the recording of the short plat. Blocks: No new blocks would be created as part of the proposed short plat. Lots: The proposal will create four lots—lot 1 at 3,480 square feet, lot 2 at 4,876 square feet, lot 3 at 3,717 square feet, and lot 4 at 3,645 square feet. The R-10 zone does not require a minimum lot size when the subject parcel is less than one-half acre in size. In such instances, the density requirements shall determine the development potential of the site. The proposed lots comply with the R-10 requirement for minimum lot width for interior lots (30 feet). Minimum lot depth, 55 feet, is also satisfied. Lot 2, proposed as a corner lot, averages 50 feet in width (40 feet required), but provides a street frontage width of 32.15 feet—less than 80% of the required minimum width. Therefore, lot 2 is considered a pipestem lot and is not permitted to use the pipestem portion for purposes of lot area and setback calculations. After the deduction of the pipestem portion (approximately 360 square feet), lot 2 would be approximately 4,516 square feet in size. The applicant should note, however, that the required 20-foot front yard setback for lot 2 must be measured from the point where the lot reaches a minimum width of 40 feet(approximately 10 feet from property line,for a total setback of 30 feet). The short plat plan includes setback lines showing the potential building envelopes for the lots. As proposed, the lots appear to have sufficient building area for the development of detached single family homes when providing the required 20-foot front yard, 5-foot interior side yard, 10-foot side yard along a street, and 15-foot rear yard setbacks. When taking the required pipestem setback for lot 2 into consideration, lot 2 would still have sufficient building area. The increased setback would include the 10-foot wide portion of the access easement to lot 4 and an additional 10-foot wide usable yard area for a total distance of 20 feet from the property line to proposed structures. The size, shape, orientation, and arrangement of the proposed lots comply with the requirements of the Subdivision Regulations and the development standards of the R-10 zone. In addition, all lots have access to a public street. d) Reasonableness of Proposed Boundaries Access: Each lot would have direct access to a public right-of-way(lot 1 and 2 from Harrington Place NE, lot 3 from Harrington Circle NE, and lot 4 via 20-foot wide easement from Harrington Place NE). Topography: The topography of the site is relatively flat with no perceptible slope orientation. The property is vegetated with grass lawn and two trees, which are proposed to be retained. In order to ensure the trees intended for retention are properly protected, the applicant will be required to comply with RMC section 4-4-130K7 in regards to tree protection. Relationship to Existing Uses: The properties surrounding the subject site are designated R-10 on the City's zoning map, with the exception of R-8 zoning on the north side of the site. The proposal is similar to existing development patterns in the area and is consistent with the Comprehensive Plan and Zoning Code, which encourage residential infill development. e) Availability and Impact on Public Services(Timeliness) Police and Fire: Police and Fire Prevention staff indicate that sufficient resources exist to furnish services to the proposed development, subject to the condition that the applicant provide Code required improvements and fees. A Fire Mitigation Fee, based on $488 per new single family home, will be required in order to mitigate the proposal's potential impacts to emergency services. The fee is estimated at $976.00 (2 new residences x $488.00 = $976.00) and is payable prior to the recording of the short plat. Recreation: The proposal does not provide on-site recreation areas for future residents of the proposed short plat. There are existing recreational facilities in the area of the subject property and it is anticipated that new residents would use existing and future City parks and recreational facilities. A Parks Mitigation Fee of$530.76 per new single family home will be required. The fee is estimated at $1,061.52 (2 new residences x $530.76 = $1,061.52) and is payable prior to the recording of the short plat. Schools: According to the Draft Environmental Impact Statement for the City of Renton Land Use Element (January 16, 1992), the City of Renton has a student generation factor of 0.44 students per new single family residential dwelling. It is anticipated that the proposed short plat would result in 0.88 new children to the local schools. Correspondence received from the Renton School District indicates children living in residences at the subject site would attend Sierra Heights Elementary School, McKnight Middle School and Hazen High School. The district has noted that the proposal is not anticipated to generate students above those that can be accommodated by the Renton School District. Storm Water. A storm drainage narrative was provided with the application. The existing soil is a fine sandy loam with rapid permeability. According to the narrative, the permeability of the soil and the low amount of impervious lot coverage created by the proposal would allow for acceptable infiltration on each lot. A Surface Water System Development Charge of $385 per new single family lot will be collected as part of the construction permit for the project. In order to mitigate potential erosion and sedimentation impacts from the development of the site, staff will recommend as a condition of approval that the applicant implement temporary erosion control measures for the duration of any onsite construction. • Water and Sanitary Sewer Utilities: The site is located in the Aquifer Protection Area#2. No extensions would be required for this project. The applicant will, however, be required to make the necessary connections to serve future development on the site. A Water System Development Charge of$850 per new single family lot, as well as a Sewer System Development Charge of $585 per new single family lot, will be collected as part of the construction permit for the short plat. H. DECISION: The Circle Short Plat, File No. LUA-00-024, SHPL-A, is approved subject to the following conditions: 1. The applicant shall obtain demolition permits (issued, inspected, and finaled)for the existing structures on the subject site prior to the recording of the short plat. The satisfaction of this requirement will be subject to the review and approval of the Development Services Division. 2. The applicant shall maintain a minimum building setback of 20 feet from the rear property line of lot 2. The project is zoned R-10. The neighborhood surrounding the site is zoned R-10 or R-8. Most of the immediate surroundings are older duplex units or fairly new single family homes. The Circle Short Plat is a total of approximately 15,618 square feet. The proposal is to create four (4) lots. I plan to construct a 1,400 SF single family home on each lot. Lot coverages will be less that 35%. However, the construction will be phased and at this point the proposal is only to short plat the lot. The following comments on development and permitting issues are based on the pre-application submittals made to the City of Renton by the applicant and the codes in effect on the date of review. The applicant is cautioned that information contained in this summary may be subject to modification and/or concurrence by official decision makers (e.g., Hearing Examiner, Zoning Administrator, Board of Adjustment, Board of Public Works, and City Council). Review comments may also need to be revised based on site planning and other design changes required by City staff or made by the applicant. The applicant is encouraged to review all applicable sections of the Renton Municipal Code. The Development Regulations are available for purchase for$50, plus tax, from the Finance Division on the first floor of City Hall. Project Proposal: The subject property is addressed as 2005 Harrington Circle NE. The proposal is to subdivide a 15,618 square foot site (.36 acre) into two lots. The site is currently developed with an existing duplex (proposed to remain on lot 1)and an accessory structure (proposed to be demolished). A single family home is proposed to be constructed on lot 2. Zoning/Density Requirements: The subject property is located within the Residential - 10 dwelling units per acre (R-10) zoning designation. The density range required in the R-10 zone is a minimum of 7 to a maximum of 10 dwelling units per acre (du/ac). A density bonus of up to 13 du/ac is permitted if all detached units are proposed. The proposal for 3 units on the subject site (15,618 square feet based on King County records)arrives at a density of 8.4 du/ac, which is within the required range. Please see the attached density worksheets. However, the zone would allow up to a maximum of 4 detached units (arriving at 11.1 du/ac)with the R-10 density bonus. The bonus would require a four-lot short plat with all units as detached single family structures. Development Standards: The proposal is a short plat, therefore, the R-10 dwelling unit mix requirements do not apply. The R-10 allows only one residential structure per lot with a maximum of 4 units per structure provided the density requirements are satisfied. Detached accessory structures are permitted at a maximum number of two per lot at 720 square feet each, or one per lot at 1,000 square feet in size. Minimum Lot Size—The R-10 zone requires a minimum lot size of 3,000 square feet per unit for detached dwellings and 2,000 square feet per unit for attached dwellings. The proposal appears to satisfy this requirement for each of the lots. The area of the site also appears to support four lots at the minimum size required for detached dwellings if the applicant pursues the density bonus. Lot Width and Depth—For detached dwellings, the R-10 zone requires a minimum lot width of 30 feet for interior lots and 40 feet for corner lots. Townhouse dwellings require a 20-foot width for each unit. A minimum lot depth of 55 feet is also required. The proposed lots appear to comply with these requirements. Pre99112\ Setbacks—Setbacks are measured from the property lines to the nearest point of the structure and must be landscaped. The required setbacks in the R-10 zone are 20 feet in the front, 15 feet in the rear, 10 feet on the side for detached units, and 5 feet on the side for attached units. A minimum setback of 25 feet is required from property lines abutting an R-8 zone when the structure contains 3 or more units. This requirement would only apply to the north property line if the applicant proposed a three or four unit structure on the site. Although the site plan submitted did not include a scale, the proposal appears to satisfy these requirements based on the information provided. The existing detached garage is intended to be removed as part of the proposal. As a condition of approval for the short plat, staff will recommend the applicant be required to have a demolition permit for the garage issued, inspected, and finaled prior to the recording of the short plat. Building Standards—The R-10 zone restricts building height to 30 feet and 2-stories. For attached units, lot coverage by buildings is limited to 50% and total impervious area is limited to 60%. Detached units are limited to 70% lot coverage by buildings and 75% impervious surface areas. When formal application is made, the plans will need to indicate areas that are landscaped and those that are impervious, as well as include percentages for building lot coverage and total impervious area. Access/Parking: As proposed each lot would have direct access to public rights-of-way. Driveways are required to maintain a 5-foot distance from property lines and are not permitted to exceed a maximum width of 20 feet. A minimum apron length of 20 feet must be provided for vehicle back out distances. Detached dwelling units are required to provide a minimum of 2 off-street parking spaces for each unit. Duplex units, or multi-family developments, must provide a minimum of 1.5 parking spaces per unit or 2 spaces per unit for tandem parking. In addition, one guest space must be provided for every four units.' Permit Requirements: Short plats of four or less lots are processed administratively within an estimated time frame of 6 to 8 weeks for preliminary approval. The application fee is $1,000, plus $0.33 per mailing label required for notification to surrounding property owners within 300 feet of the site. The applicant will be required to install a public information sign on the property. Detailed information regarding the land use application submittal is provided in the attached handouts. Once preliminary approval is received, the applicant must complete the required improvements and satisfy any conditions of the preliminary approval before the plat can be recorded. Fees: In addition to the applicable building and construction fees, the following mitigation fees would be required prior to the issuance of building permits. Credit for existing development would be given. • A Transportation Mitigation Fee based on $75 per each new average daily trip attributable to the project; • A Parks Mitigation Fee based on $530.76 per new single family residence or $354.51 per each new multi-family unit; and • A Fire Mitigation Fee based on $488 per new single family residence or$388 per each new multi-family unit. Notwithstanding anything contained in said Policy to the contrary, the amount of insurance provided by said Policy, as stated in Schedule A thereof, is subject to cumulative annual upward adjustments in the manner and to the extent hereinafter specified. 2. ■Adjustment Date■ is defined, for the purpose of this Endorsement, to be 12:01 a.m. on the first January 1'which occurs more than six months after the Date of Policy, as shown in Schedule A of the Policy to which this Endorsement is attached, and on each succeeding January 1. 3.
