No change of use Is anticipated as a consequence of this proposed rezone. Under the R-1 zoning existing non-conforming uses such as the two existing restaurants within the park would become conforming uses and the P-Suffix would ensure that nearby residents are notified in advance of any proposed change in tenants, use, or ownership at Gene Coulon Park. SUMMARY OF ACTION: In June 1994, City Council directed Planning/Building/Public Works to proceed with assimilation of the P-1 zone into the other zones adopted in June 1993. The other zones do accommodate most, if not all of the uses that were typically allowed in the P-1 zone. e, The recommendation of the Hearing Examiner for approval of the City-sponsored rezone was published July 17,2000. No requests for reconsideration or appeals were received during the appeal period which ended July 31, 2000. Neither the Environmental Review Committee(ERC) or Hearing Examiner imposed conditions on this rezone. The Examiner recommends that City Council approve reclassification of the subject property from P-1 to R-1. STAFF RECOMMENDATION: Approve. July 17,2000 OFFICE OF THE HEARING EXAMINER CITY OF RENTON REPORT AND RECOMMENDATION APPLICANT: City of Renton Gene Coulon Park Rezone File No.: LUA00-057,R LOCATION: 1323 Lake Washington Boulevard • SUMMARY OF REQUEST: City initiated rezone of a 55.33 acre site along Lake Washington from Public Use(P-1)Zone to the Residential-1 DU/AC(R-1)Zone with a"P" suffix attached. SUMMARY OF ACTION: Development Services Recommendation: Approve DEVELOPMENT SERVICES REPORT: The Development Services Report was received by the Examiner on July 5,2000 PUBLIC HEARING: In accordance with Section 4-8-14(C)(2),the Hearing Examiner shall determine if a change of zone classification is advisable, in the public interest, tends to further the preservation and enjoyment of any substantial property rights of the petitioner, is not materially detrimental to the public welfare or the properties of other persons located in the vicinity thereof, and is in harmony with the purposes and effect of the Comprehensive Plan. In such event, the Hearing Examiner may recommend that the City Council approve the change of the zone classification. EXHIBITS: Exhibit No. 1: Yellow file containing application, proof of posting and publication and other documentation pertinent to this request. Exhibit No.2: Site map Exhibit No.3: Zoning map MINUTES The following minutes are a summary of the July 11, 2000 hearing. The legal record is recorded on tape. The hearing opened on Tuesday,July 11,2000,at 9:45 a.m. in the Council Chambers on the seventh floor of the Renton City Hall. Parties wishing to testify were affirmed by the Examiner. • City of Renton Gene Coulon Park Rezone File No.: LUA00-057,R July 17,2000 Page 2 City project manager, DONALD ERICKSON,Economic Development, City of Renton, 1055 S Grady Way, Renton,Washington 98055, presented the staff report. He explained that when the City prepared its Comprehensive Plan in 1993 it deferred making changes to the Public Use(P-1)zone to allow more time to study existing P-1 uses. Originally, the P-1 zone was intended to recognize public ownership and to provide a process that would expedite development. The study found that the City's new zoning allows the same public uses in virtually every zone. It was also found that a relatively high percentage of actual public uses are not located in the P-1 zones. For example,City Hall and the Fire Station are in the commercial zone and schools and parks are generally located in single family zones. Staff proposed to the City Council's Planning and Development Committee that the City should either assimilate all public uses in P-1 zones or allow for public uses in all other zones. The City Council chose the latter recommendation since there are adequate provisions in other zones to accommodate public uses and it would be more consistent with the Growth Management Act. Therefore, the current proposal is part of a series of 50 proposed rezones of publicly held properties. An ordinance adopted in June 1995 and referred to as "P" suffix zoning, was incorporated to protect the public interest by identifying publicly-held properties. It also requires public notification if there is to be a change in tenancy, use, or ownership of any of these properties. All of these P-1 rezones will be identified with a"P" suffix. The property which is the subject of this rezone is approximately 55.33 acres in size and is located at 1323 Lake Washington Boulevard between NE 12th Street(if extended) on the south and NE 25th Street(if extended)on the north. The applicant has requested the site be rezoned from P-1 to Residential-1 DU/AC(R-1) Zone with the public use"P" suffix attached. In conclusion,Mr.Erickson recommended that Gene Coulon Park be rezoned from P-1 to R-1 Zone with a"P" suffix attached for the following reasons: that the rezone is consistent with the Comprehensive Lane Use Map designation for this parcel,as Residential Rural, which endeavors to preserve open space and natural resources, protect environmentally sensitive areas by limiting residential development in critical areas as well as areas identified as part of a city-wide or regional open space network. This rezone is also consistent with the existing use of the subject property since existing neighborhood, community and regional parks are a permitted primary use in this zone. The Examiner called for further testimony regarding this project. There was no one else wishing to speak, and no further comments from staff. The hearing closed at 10:00 a.m. FINDINGS,CONCLUSIONS &RECOMMENDATION Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicant, City of Renton, filed a request to reclassify the subject site from P-1 (Public/Quasi- public)to R-1 (Single Family Residential; 1 dwelling unit per acre). 2. The City of Renton filed requests for approval of a series of more than fifty(50) separate rezones involving a series of separate properties generally owned by public agencies including the City,King County and the Renton School District. The City proposes phasing out its P-1 Zone,a zone that in the City of Renton Gene Coulon Park Rezone File No.: LUA00-057,R July 17,2000 Page 3 past was designed to accommodate public and quasi-public uses. Each of the proposals requests that the new zoning be changed to closely, if not exactly match, surrounding zoning districts and the goals of the Comprehensive Plan. 3. The yellow file containing the staff report, the State Environmental Policy Act(SEPA)documentation and other pertinent materials was entered into the record as Exhibit#1. 4. The Environmental Review Committee(ERC),the City's responsible official, issued a Declaration of Non-Significance'(DNS)for the subject proposal. 5. The subject proposal was reviewed by all departments with an interest in the matter. 6. While the background information on the study and proposed abolition of the P-1 zone will be the same for each report, each site will receive separate attention and a separate decision. 7. The P-1 (Public/QuasiPublic)Zone was established in the early 1950's to accommodate governmental facilities as well as certain private uses such as private medical clinics and private hospitals,as well as private schools, museums and the like that accommodated the public. The permitted uses were expanded over the years to accommodate an even wider range of uses while other zoning districts also broadened their range of respective uses, in effect duplicating the permitted uses in the P-1 zone. The current zoning categorization generally appears to accommodate most, although not all,of the uses the current P-1 zone permits. The City Council directed staff to make a recommendation as to the continued need for a distinct P-1 zone. A result of that study was presented to the Planning Commission(May 4, 1994 Report). The Planning Commission recommended the assimilation of the P-1 zone. The City Council then directed that individual parcels be assimilated into nearby, compatible zones after appropriate public hearings. The current action is the result of those decisions. 8. The subject site is commonly known as Gene Coulon Park. The site is located at the north end of the City along the east shore of Lake Washington. The site is immediately west of Lake Washington Boulevard. Staff noted that the most north portion of the park is already zoned R-8 (Single Family;Lot size-4,500 sq ft)and proposes no change to that classification. 9. The subject site is approximately 55.33 acres. The parcel is irregularly shaped. 10. The City proposes designating the site R-1. The City has attached a special designation to any public property which carries so-called "normal" zoning designations. This special designation is a"P" or P- suffix, permitting those who view the Zoning Map to determine that the property is publicly owned. This designation also carries with it a requirement for public notice of any further change of use or zoning. The City did not recommend RC(Resource Conservation)because they felt RC was too restrictive and the areas adjacent to it too urban. 11. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of single family residential uses, but does not mandate such development without consideration of other policies of the Plan. 12. The site is developed as an urban beach park with some low-key amenities including stream course and • • City of Renton Gene Coulon Park Rezone File No.: LUA00-057,R July 17,2000 Page 4 wetland areas and meandering trail. 13. Zoning in the area consists of R-8 zoning for the existing portion of the park and areas north of the park, and RM-I (Multiple Family)Zoning east of the park across Lake Washington Boulevard. There is also Heavy Industrial(IH)uses, the Boeing Plant, south of the site. 14. The City recently allowed restaurants in parks in residential zones which will allow those developed within the park to remain legal conforming uses. CONCLUSIONS: 1. The proponent of a rezone must demonstrate that the request is in the public interest, that it will not impair the public health, safety and welfare, and in addition complies with at least one of the criteria found in Section 4-9-180(f),which provides in part that: a. The subject site has not been considered in a previous area-wide rezone or land use analysis;or b. The subject site is potentially designated for the new classification per the Comprehensive Plan; or c. There has been a material and substantial change in the area in which the subject site is located since the last rezoning of the property or area. The requested classification is justified and should be approved. 2. The P-1 district and its associated properties were removed from the city-wide reclassification effort to study the basis for the zone itself. This site as well as the other P-1 properties were segregated for special review. The public hearing that preceded this recommendation is the first analysis since that study demonstrated that there is no reason to maintain the P-1 zones. 3. The Comprehensive Plan designates the area as suitable for single family uses which allows parks. The R-1 is suitable for some single family areas and appears reasonable for this large regional park. It appears that while the area is fairly urban,RC(Resource Conservation)would have been equally appropriate given the nature of this park. The proposed zoning matches the zoning proposed for most of the parks developed in residential areas as opposed to those parks along the less developed Maple Valley corridor. 4. In addition to the desire to eliminate the P-1 zone, there have been a number of substantial changes in the area. Much of the hillside east of Lake Washington Boulevard has been developed in the last few years or is being developed currently. Much of that development is multiple family. Rezoning the park accords with these changes in the area. In addition, the Comprehensive Plan and Zoning code have themselves undergone a profound change. The need for a separate holding zone for public and quasi- public uses has been questioned for a long time and the adoption of these new land use provisions just provided the impetus to review the P-1 zone. The proposed zoning is an appropriate alternative for the current P-1 zone. • City of Renton Gene Coulon Park Rezone File No.: LUA00-057,R July 17,2000 Page 5 • RECOMMENDATION: The City Council should approve the reclassification of the subject site from P-1 to R-1 with the P- suffix as proposed. July 17,2000 OFFICE OF THE HEARING EXAMINER CITY OF RENTON REPORT AND RECOMMENDATION APPLICANT: City of Renton Gene Coulon Park Rezone File No.: LUA00-057,R LOCATION: 1323 Lake Washington Boulevard SUMMARY OF REQUEST: City initiated rezone of a 55.33 acre site along Lake Washington from Public Use(P-1)Zone to the Residential-1 DU/AC(R-1)Zone with a"P" suffix attached. SUMMARY OF ACTION: Development Services Recommendation: Approve DEVELOPMENT SERVICES REPORT: The Development Services Report was received by the Examiner on July 5, 2000 PUBLIC HEARING: In accordance with Section 4-8-14(C)(2),the Hearing Examiner shall determine if a change of zone classification is advisable, in the public interest, tends to further the preservation and enjoyment of any substantial property rights of the petitioner, is not materially detrimental to the public welfare or the properties of other persons located in the vicinity thereof, and is in harmony with the purposes and effect of the Comprehensive Plan. In such event, the Hearing Examiner may recommend that the City Council approve the change of the zone classification. EXHIBITS: Exhibit No. 1: Yellow file containing application, proof of posting and publication and other documentation pertinent to this request. Exhibit No.2: Site map Exhibit No.3: Zoning map MINUTES The following minutes are a summary of the July 11,2000 hearing. The legal record is recorded on tape. The hearing opened on Tuesday,July 11,2000, at 9:45 a.m. in the Council Chambers on the seventh floor of the Renton City Hall. Parties wishing to testify were affirmed by the Examiner. City of Renton Gene Coulon Park Rezone File No.: LUA00-057,R July 17,2000 Page 2 City project manager,DONALD ERICKSON,Economic Development,City of Renton, 1055 S Grady Way, Renton,Washington 98055,presented the staff report. It also requires public notification if there is to be a.change in tenancy, use, or ownership of any of these properties. All of these P-1 rezones will be identified with a"P" suffix. The property which is the subject of this rezone is approximately 55.33 acres in size and is located at 1323 Lake Washington Boulevard between NE 12th Street(if extended)on the south and NE 25th Street(if extended)on the north. The applicant has requested the site be rezoned from P-1 to Residential-1 DU/AC (R-1) Zone with the public use"P" suffix attached. In conclusion,Mr. Erickson recommended that Gene Coulon Park be rezoned from P-1 to R-1 Zone with a"P" suffix attached for the following reasons: that the rezone is consistent with the Comprehensive Lane Use Map designation for this parcel,as Residential Rural, which endeavors to preserve open space and natural resources, protect environmentally sensitive areas by limiting residential development in critical areas as well as areas identified as part of a city-wide or regional open space network. The City proposes phasing out its P-1 Zone, a zone that in the City of Renton Gene Coulon Park Rezone File No.: LUA00-057,R July 17,2000 Page 3 past was designed to accommodate public and quasi-public uses. Each of the proposals requests that the new zoning be changed to closely, if not exactly match, surrounding zoning districts and the goals of the Comprehensive Plan. 3. The yellow file containing the staff report, the State Environmental Policy Act(SEPA)documentation and other pertinent materials was entered into the record as Exhibit#1. 4. The Environmental Review Committee(ERC),the City's responsible official, issued a Declaration of Non-Significance(DNS)for the subject proposal. 5. The subject proposal was reviewed by all departments with an interest in the matter. 6. While the background information on the study and proposed abolition of the P-1 zone will be the same for each report, each site will receive separate attention and a separate decision. 7. The P-1 (Public/QuasiPublic)Zone was established in the early 1950's to accommodate governmental facilities as well as certain private uses such as private medical clinics and private hospitals, as well as . . private schools, museums and the like that accommodated the public. The permitted uses were expanded over the years to accommodate an even wider range of uses while other zoning districts also broadened their range of respective uses, in effect duplicating the permitted uses in the P-1 zone. The current zoning categorization generally appears to accommodate most, although not all, of the uses the current P-1 zone permits. 9. The subject site is approximately 55.33 acres: The parcel is irregularly shaped. 10. The City proposes designating the site R-1. The City has attached a special designation to any public property which carries so-called "normal" zoning designations. This special designation is a "P" or P- suffix, permitting those who view the Zoning Map to determine that the property is publicly owned. 12. The site is developed as an urban beach park with some low-key amenities including stream course and City of Renton Gene Coulon Park Rezone File No.: LUA00-057,R July 17,2000 Page 4 wetland areas and meandering trail. 13. Zoning in the area consists of R-8 zoning for the existing portion of the park and areas north of the park, and RM-I(Multiple Family)Zoning east of the park across Lake Washington Boulevard. There is also Heavy Industrial(IH)uses, the Boeing Plant, south of the site. 14. The City recently allowed restaurants in parks in residential zones which will allow those developed within the park to remain legal conforming uses. - CONCLUSIONS: 1. The proponent of a rezone must demonstrate that the request is in the public interest, that it will not impair the public health, safety and welfare, and in addition complies with at least one of the criteria found in Section 4-9-180(f),which provides in part that: a. The subject site has not been considered in a previous area-wide rezone or land use analysis; or b. City of Renton - Gene Coulon Park Rezone File No.: LUA00-057,R July 17,2000 Page 5 RECOMMENDATION: The City Council should approve the reclassification of the subject site from P-1 to R-1 with the P- suffix as proposed. PROJECT NAME: Gene Coulon Park Rezone PROJECT NUMBER: LUA-00-057,ECF,R DESCRIPTION: The applicant, the City of Renton, has requested an Environmental Review for a proposed rezone of 55.3 acres of city park along Lake Washington, from the Public Use (P-1)Zone, to the Residential— 1 du/ac(R-1)Zone,with a P-Suffix designation attached. This proposed rezone is of a series of approximately 44 public rezones of the former P-1 Zone to the City's other underlying zones, pursuant to Council's 1994 directive to phase this zone out of existence. Under the R-1 zoning, existing non-conforming uses such as the existing restaurants within the park would become conforming use and the P-Suffix would ensure that nearby residents are notified in advance of any proposed change in tenants, use, or ownership at Gene Coulon Park. It is part of a series of 44 public rezones of the former Public Use (P-1) Zone that is being phased out pursuant to Council's 1994 direction to do so. No change of use is anticipated as a consequence of this proposed rezone. Under the R-1 zoning existing non-conforming uses such as the two existing restaurants within the park would become conforming uses and the P- Suffix would ensure that nearby residents are notified in advance of any proposed change in tenants, use, or ownership at Gene Coulon Park. Existing parks should be more intensely developed to provide needed recreation facilities where feasible. F. .DEPARTMENT ANALYSIS:_. 1. PROJECT DESCRIPTION/BACKGROUND The current proposal is part of a series of approximately forty-four (44) rezones of publicly held properties the majority of which have already been changed from the Public Use (P-1) Zone to other more traditional zones that reflect the characteristics of the use and the surrounding area, whenever possible. In addition to these public sponsored rezones of public owned properties nine P-1 rezones of privately held P-1 zoned properties were previously completed. This consolidation of the City's zoning is based in part upon an extensive staff report that was prepared in 1993 and reviewed by the Planning Commission. In June 1994 the Council directed staff to proceed with the assimilation of the P-1 Zone into other zones that had been adopted in June 1993 with the City's new Interim Zoning Code. 2. ENVIRONMENTAL REVIEW Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C, 1971 as amended), on May 30, 2000 the Environmental Review Committee issued a Determination of Non-significance for this non-project legislative action. 3 COMPLIANCE WITH ERC MITIGATION MEASURES Because no mitigation measures were imposed on this non-project action, there were no ERC conditions that the applicant was required to comply with. STAFF REVIEW COMMENTS Representatives from various city departments have reviewed the application materials to identify and address site plan issues from the proposed development. These comments are contained in the official file, and the essence of the comments has been incorporated into the appropriate sections of this report and the Departmental Recommendation at the end of the report. 5. CONSISTENCY WITH REZONE APPROVAL CRITERIA. Section 4-9-170F.2 Criteria for Rezones Not Requiring Plan Amendment: "The Reviewing Official shall make the following findings:" a. The rezone is in the public interest, and The proposed rezone is in the public interest since it will allow the continuation of the existing use as well as ensure public notification of changes of use, ownership or tenancy of the subject property, because of the P-Suffix. b. The rezone tends to further the preservation and enjoyment of any substantial property rights of the petitioner, and The proposed rezone would further the preservation of Gene Coulon Park since the R-1 Zone is much more restrictive than the current P-1 Zone in terms of the types of public uses that would be allowed on the property. Whereas the P-1 Zone allows a broad array of public uses the R-1 Zone restricts outright permitted new uses to parks, golf courses and small utilities. Other public uses such as schools and hospitals are allowed but only as secondary or conditional uses. c. The rezone is not materially detrimental to the public welfare or the properties of other persons located in the vicinity thereof, and The proposed rezone is not detrimental to the public welfare or properties of other persons located in the vicinity since it significantly limits the range of public uses that potentially could be placed on the site and establishes a public notification process that would ensure that those living in the vicinity were notified prior to any change of ownership, use, or major tenancy. d. The rezone meets the review criteria in subsections F1 b and F1 c of this Section. F1 b: The property is potentially classified for the proposed zone being requested pursuant to the policies set forth in the Comprehensive Plan; and The subject site has been determined to be potentially classified for the proposed R-1 Zone based upon the fact that it is designated on the City's Comprehensive Plan Land Use Map as Residential Rural, which encourages lower density single- family residential near and/or within environmentally sensitive areas. The recommended R-1 zoning would be consistent with the City's Comprehensive Plan. F1 c: At least one of the following circumstances applies: i. The subject reclassification was not specifically considered at the time of the last area land use analysis and area zoning; Hexreport.doc City of Renton EDNSP Department reliminary Report to the Hearing Examiner PROJECT NAME: Gene Coulon Park P-1 Rezone LUA-00-057,R;ECF PUBLIC HEARING DATE:July 11,2000 Page 5 of 5 The subject site was not specifically considered at the time of last area- wide land use analysis and area-wide rezoning in 1995 since it was understood that Staff were studying the P-1 Zone and were preparing recommendations to the Planning Commission and City Council on whether this special zoning should be retained or assimilated into the City's other zoning classifications. Nearby uses abutting the subject site to the north, east and south were rezoned in June 1993 to the R-1, R-8, RM-1, CC and IH zones. This and a number of other P-1 zoned sites were not rezoned at this time awaiting recommendations from planning staff for future zoning. ii. Since the most recent land use analysis or the area zoning of the subject property, authorized public improvements, permitted private development or other circumstances affecting the subject property have undergone significant and material change. There have been no significant or material changes affecting the subject property since the most recent land use analysis of the area. G. RECOMMENDATION: Staff recommends approval of the Gene Coulon Park P-1 Rezone, Project File No. LUA-00-057, R, ECF from the Public Use(P-1)Zone to the Residential—1 du/ac(R-1)Zone with a P-Suffix attached for the following reasons: (1) The rezone is consistent with the Comprehensive Plan Land Use Map designation for this parcel, as Residential Rural, which endeavors to preserve open space and natural resources, protect environmentally sensitive areas by limiting residential development in critical areas as well as areas identified as part of a city-wide or regional open space network. Gene Coulon Park is part of the edge of Lake Washington, which is a regional open space/resource. (2) The rezone would be consistent with earlier citywide rezones of other properties in the area that were zoned R-1 in 1993 and/or 1995. This rezone is also consistent with the existing use of the subject property since existing neighborhood, community and regional parks are a permitted primary use in this zone; (3) The subject rezone is a non-project action under SEPA and is a legislative act that is not expected to actually reduce the development potential of the site. It would reduce the scope of uses that might otherwise be allowed under the P-1 Zone which includes a broad array of governmental uses ranging from hospitals and health clinics to airports and wastewater treatment facilities. ENVIRONMENTAL CHECKLIST PURPOSE OF CHECKLIST: The State Environmental Policy Act (SEPA), Chapter 43.21C RCW, requires all governmental agencies to consider the environmental impacts of a proposal before making decisions. An Environmental Impact Statement (EIS) must be prepared for all proposals with probable significant adverse impacts on the quality of the environment. . The purpose of this checklist is to provide information to help you and the agency identify impacts from your proposal (and to reduce or avoid impacts from the proposal, if it can be done) and to help the agency decide whether an EIS is required. INSTRUCTIONS FOR APPLICANTS: This environmental checklist asks you to describe some basic information about your proposal. Governmental agencies use this checklist to determine whether the environmental impacts of your proposal are significant, requiring preparation of an EIS. Answer the questions briefly, with the most precise information known, or give the best description you can. You must answer each question accurately and carefully, to the best of your knowledge. In most cases, you should be able to answer the questions from your own observations or project plans without the need to hire experts. If you really do not know the answer, or if a question does not apply to your proposal, write "do not know"or "does not apply". Complete answers to the questions now may avoid unnecessary delays later. Some questions ask about governmental regulations, such as zoning, shoreline, and landmark designations. Answer these questions if you can. If you have problems, the governmental agencies can assist you. The checklist questions apply to all parts of your proposal, even if you plan to do them over a period of time or on different parcels of land. Attach any additional information that will help describe your proposal or its environmental effects. The agency to which you submit this checklist may ask you to explain your answers or provide additional information reasonably related to determining if there may be significant adverse impact. USE OF CHECKLIST FOR NONPROJECT PROPOSALS: Complete this checklist for nonproject proposals, even though questions may be answered "does not apply." IN ADDITION, complete the SUPPLEMENTAL SHEET FOR NONPROJECT ACTIONS (part D). For nonproject actions (actions involving decisions on policies, plans and programs), the references in the checklist to the words "project,""applicant,"and "property or site"should be read as "proposal," "proposer,"and "affected geographic area,"respectively. When answering these questions, be aware of the extent the proposal, or the types of activities likely to result from the proposal, would affect the item at a greater intensity or at a faster rate than if the proposal were not implemented. Respond briefly and in general terms. 1. How would the proposal be likely to increase discharge to water; emissions to air; production, storage, or release of toxic or hazardous substances; or production of noise? This is a legislative non-project action that will not result in any new construction on the subject site. Proposed measures to avoid or reduce such increases are: Not applicable. This non-proiect legislative action should have no impact on .energy or natural resources. Proposed measures to protect or conserve energy and natural resources are: Not applicable. 4. How would the proposal be likely to use or affect environmentally sensitive areas or areas designated (or eligible or under study) for governmental protection; such as parks, wilderness, wild and scenic rivers, threatened or endangered species habitat, historic or cultural sites, wetlands, floodplains, or prime farmlands? The subject non-project proposal to down zone the subject site would help retain an existing water-oriented regional park by reducing its development potential from what it is under current P-1 zoning. Also, existing code provisions restrict the selling of the subject site without a public input process. It should be noted that the City has no plans to change the use of this regional park, which is the "jewel in the crown"of the City's park system. Not applicable. 5. How would the proposal be likely to affect land and shoreline use, including whether it would allow or encourage land or shoreline uses incompatible with existing plans? This proposed non-proiect legislative action should in no way affect or alter existing land and shoreline use since parks area permitted principal use in the R-1 Zone. Proposed measures to avoid or reduce shoreline and land use impacts are: Not applicable. 6. How would the proposal be likely to increase demands on transportation or public services and utilities? I told her that we had decided on rezoning the 55 acre site to R-1 with a P-suffix attached but that we were not moving ahead at this time because you felt we needed to amend the R-1 Zone first, to ensure that restaurants were included as an accessory use for regional parks in this zone. Leslie supports this, not wanting to take the risk that as a "non- conforming use"the restaurants might not be replaceable if a major fire or other event occurred and destroyed them. I told her I would like to move ahead this year on this P-1 rezone but was waiting further direction from you. It seems to me that a minor amendment to the R-1 Zone could be made so that regional parks such as Gene Coulon Park could be treated similarly to how golf courses are now treated in this zone. Accessory uses such as restaurants are now allowed as a permitted use for "Public and private golf courses" under note #222. I would recommend treating "regional parks" (existing) the same as we do golf courses in the R-1 Zone. Under the new Title 4 format this would look some like the following: CI TURAL;ENTERTAINMENT AND s: RECREATIONAL Parks and Open Space Parks, regional(new) S #2 Parks, regional(existing) P#222 A. SUBJECT TO THE FOLLOWING CONDITIONS: 2. Subject to site plan review and consistency with the City Comprehensive Parks, Recreation and Open Space Master Plan and Trails Master Plan. 222. Including accessory restaurants and accessory buildings. If these suggested minor code modifications seem reasonable to you I would like to go ahead and schedule a meeting with you and Leslie to see if we can get their concurrence before proceeding with the text amendment and P-1 rezone to R-5. This proposed rezone is a part of our implementation of the policy decision made by Council in 1996 to phase out the P-1 Zone since it was not a traditional zone with multiple ownerships where it was applied, but rather, it had characteristics similar to those associated with"spot"zoning. However, prior to rezoning Coulon Park we need to first amend the R-1 Zone to allow accessory restaurants and accessory buildings in existing, and possibly new regional parks. As you know Gene Coulon Park houses two food service operators (Ivar's and Kidd Valley) and it would not be in the City's interest if these uses were deemed legal non-conforming uses. By adding "restaurants and accessory buildings" as an accessory use in the use tables in chapter 4-2-060E under "Parks, regional", the two existing restaurants at Gene Coulon Park would become legal conforming uses, subject to the other provisions of the code. Precedence already exists for such uses in the R-1 Zone as accessory uses to other regional recreational facilities. "Restaurants and accessory buildings", for example, are currently permitted as accessory uses to existing and new public or private golf courses. Your comments, if any, would be appreciated on the scope of this non-project proposal. We would appreciate receiving comments before 5:00 PM on December 6, 1999. If this presents a problem please let me know. Thanks in advance for your prompt attention to this matter. Attachment: Project Summary cc: Sue Carlson Rebecca Lind \\TS_SERVER\SYS2:\COMMON\-C:\WINNTVProfiles\derickson\Recent\Coulon Circulation Memo.doc\d R-1 Zone Use Table Amendment and P-1 Rezone Project Summary This amendment is being propagated in order to make the Ivar's and Kidd Valley restaurants at Gene Coulon Park permitted accessory uses in the R-1 Zone. The proposal would amend the Use Table in Section 4-2-060E to allow restaurants and accessory buildings as an accessory use in the R-1 Zone. They are currently only allowed as accessory uses to public and private golf courses in this zone. This would allow minor modifications to these restaurants without having to go through a conditional use permit approval process once the park site is rezoned. R-1 is the preferred zone for Gene Coulon Park since it is consistent with the Comprehensive Plan's Residential Rural land use designation and reflects the sites environmental sensitivity because of seismic instability of underlying soils. Currently restaurants are a permitted accessory use in the P-1 Zone when they are associated with public parks and recommended by the Renton Parks Board. Restaurants and accessory buildings are allowed as an accessory use to public and private golf courses in the R-1 Zone, but are not allowed as an accessory use to public parks. Staff believe, given the similarity between golf courses (regional facilities) and regional parks such as Gene Coulon Park, there is a justification to allow similar accessory uses in both. This proposal would amend Section E of the use tables in Subsection 4-2-060 for the R-1 Zone by listing "restaurants and accessory buildings", whether existing or new, as an"accessory"use to regional public parks. This change would result in their being treated the same as public or private golf courses. Coulon Prk Summary.doc\ • CITY OF RENTON ECONOMIC DEVELOPMENT, NEIGHBORHOODS, AND STRATEGIC PLANNING • MEMORANDUM DATE: November 17, 1998 TO: Leslie Betlach • FROM: Mike Kattermann • SUBJECT: Gene Coulon Park P-1 Rezone We are trying to complete our remaining P-1 rezones and in reviewing our files it came to our attention that we have never preceded with the rezoning of Gene Coulon Park. The last correspondence we found in our files was a memo I sent you a year ago regarding the three zones (RC, R-1 and R-5) that would fit the Residential Rural land use designation on the park. In that memo (attached) we concluded that the R-1 Zone would be the best since R-1 zoning already exists kitty- corner to the park (its northeast corner). Also, in the R-1 Zone public and private golf courses and associated buildings, including restaurants, are allowed. Since the impacts of a regional park are not unlike those of a regional golf course it is conceivable that an argument might be made that restaurants should be considered"associated buildings"in regional parks. Many such parks, such as Washington • Park in Portland, Oregon and Stanley Park in Vancouver, B.C. have restaurants associated with them. Attached is a copy of our memorandum from a year ago. If you concur please let me know so that we can move ahead with this rezone. Thanks. • Attachment: 11-18-97 Memorandum . • cc: Don Erickson • • • \\TS_SERVER\SYS2:\COMMON\-Documents\lrp CITY OF RENTON PLANNINGBUILDING/PUBLIC WORKS ' MEMORANDUM DATE: November 18, 1997 TO: Leslie Betlach FROM: Mike Kattermann SUBJECT: Gene Coulon Park Rezone Thank for your E-mail of November 13, 1997 regarding future zoning classifications to replace the P-1 zoning on Gene Coulon Park and allowed uses under the Resource Conservation (RC) zoning at the Maplewood Golf Course. Because Gene Coulon Park currently has a Residential Rural land use designation on the Comp Plan Land Use Map we are restricted to possible zoning classifications for this site. These are the RC, R-1, and the R-5 zones. Attached is a matrix that shows where existing and new parks and golf courses are allowed in the RC,R-1 and R-5 zones. Parks: What is apparent from this matrix is that existing and new neighborhood, community and regional parks are allowed in all three zones. New parks however, must show that they are consistent with the City's Comprehensive Park, Recreation and Open Space Master Plan and Trails Master Plan and comply with site plan review. In regards to restaurants within existing parks there is no provision for this ancillary use in any of the zones except when provided with a golf course. However, existing uses including restaurants, would be grandfathered in and allowed to continue but typically not expand. Golf Courses: In terms of public and private golf courses the code is more permissive, allowing "associated buildings including restaurants" in both the RC and R-1 zones. In the RC Zone existing public and private golf courses not only are allowed as a Permitted Primary Use, but can also be expanded as can "associated buildings including restaurants". In the R-1 Zone public and private golf courses and associated buildings including accessory buildings, whether existing or new, are allowed as a permitted primary use. The R-5 Zone allows existing and new public and private golf courses but is silent regarding"associated buildings including restaurants". I don't recall the multi-family proposal for Gene Coulon Park, but it is clear that the existing park would be permitted in all three zones currently under consideration, the RC Zone, the R-1 Zone, and the R-5 Zone. We are recommending the R-1 Zone since this is the only one of the three zones currently in the area (kitty-corner to the northeast corner of Gene Coulon Park). As far as I know the R-5 Zone has not yet been applied to existing areas within the City and is primarily intended to be applied to areas within 1/2 mile of the King County Urban Growth Area Line. However, it can also be applied to residential rural (RR) designated areas with no significant environmental constraints. As an urban park abutting an Urban designated shoreline on one side and multi-family infill across the street a RC zoning classification seems inappropriate since this zone is primarily intended to be a low density residential zone which: provides separation between areas of more intense urban uses; encourages or preserves semi-rural residential uses; allows limited commercial fanning uses; and/or protects environmentally sensitive areas such as flood plains, wetlands, streams and aquifers, etc.,none of which really apply to the site. I hope this clarification is helpful. Please let me know whether you concur with the proposed R-1 zoning for Gene Coulon Park. Thanks. However, I have a "Land Use and Zoning Map Amendments" i form that was dated in January 1994 and prepared by you, that indicated Coulon would be rezoned to MF. Regional Parks are listed as a Primary Permitted use although there is no mention of restaurants. But this brings up another issue. The golf course is zoned as RC and we have a business and restaurant there as well. I have a " Land Use and Zoning Map Amendments" form from you dated January, 1994 that we received on March 31, 1994 that indicates that the golf course was going to be rezoned to SFL. The reason for this was because public and private golf courses and assocaited buildings, including accessory restaurants, are listed as a Primary Permitted use. I would very much appreciate clarification on these because it may impact what happens in the future when, and if, changes/improvements are proposed. Thank you, Leslie From: Michael Kattermann To: Leslie Betlach Cc: Donald K. Erickson; Rebecca H. I'm not convinced that R-1 is necessarily better than RC, but I'm also not convinced it's any worse either so here's my bottom line. As long as you are comfortable that the R-1 zone will meet your needs in terms of current and future uses of the park, and not run afoul the shoreline program or other codes, we will proceed with the rezone to R-1. The reasons for this conclusion follows: 1. The RC Zone has a very strong correlation to the Conservancy and/or Natural shoreline designations under the City's SMP. Other than the Blackriver River Wetlands which have a Natural designation all other parks areas having RC zoning are given a Conservancy designation under our shoreline management program. Typically, the RC Zone has been reserved for environmentally sensitive areas such as our wetland bank, areas with steep slopes, natural stream corridors, and wildlife habitats. Its application on this site could call into question the much more permissive Urban shoreline designation this site now enjoys. 2. The RC Zone does acknowledge existing neighborhood, community and regional parks but is silent on the question of accessory uses and buildings such as restaurants within parks. 3. The R 1 Zone also acknowledges existing neighborhood, community and regional parks and likewise is silent on the question of accessory uses and buildings such as restaurants within parks. However, this zone allows public and private golf courses and associated buildings including accessory restaurants. This is relevant because within this same zone under"Prohibited and Unclassified Uses"the Zoning Administrator is authorized to allow unlisted uses found to be: 1) in keeping with the intent of the Zone; and 2) similar in nature to a specifically listed primary, secondary, accessory, or conditional use. One could argue that a regional park such as Gene Coulon is similar in nature to a regional golf course and its accessory uses, including restaurants, and that uses such as restaurants or boat rental facilities should be permitted in this zone. 4. The R-5 Zone is also permitted in areas with a Residential Rural land use designation on the City's Land Use Map. It typically applies to areas with either Residential Single Family land use designation within 1/2 mile of the King County Urban Growth Area line, or to residential rural(RR)areas with no significant environmental constraints. 5. The R-5 Zone also permits existing neighborhood, community and regional parks as a primary permitted use. And, it allows new parks, golf courses and trails as a permitted secondary use. However, unlike the R-1 Zone it is silent regarding accessory uses such as restaurants for golf courses. */; s City of Renton Economic Development/Ivewgnborhoods/Strategic Planning Department 'Preliminary Report to the Hearing Examiner GENE COULON PARK REZONE LUA-97-115,R,ECF PUBLIC HEARING DATE: Page 1 of 5 City of Renton PUBLIC Department of Planning/Building/Public Works HEARING PRELIMINARY REPORT TO THE HEARING EXAMINER • A. PROJECT DESCRIPTION/BACKGROUND The current proposal is part a series of forty-four (44) proposed rezones of publicly held properties that would change the Public Use (P-1) zoning designation to zoning already in the area that allow the proposed use or most accurately reflects the characteristics of the use in terms of its scale, lot coverage, and bulk. In addition to these forty proposed P-1 rezones, the City has already rezoned nine (9) private P-1 properties and thirty-two (32) public P-1 properties. There are approximately twelve (12) publicly held P-1 properties to be rezoned in the near future, for a total of 53 P-1 rezones. This consolidation of the City's zoning is based in part upon a detailed analysis that was done in November, 1993 that was summarized in a Staff Report to the Planning and Development Committee in May 4, 1994. Because of major inconsistencies in the application of the P-1 Zone over the years and new zoning in 1993 that provides for broad array of uses, the Council directed staff in 1994 to assimilate the small P-1 Zones into the City's then new and comprehensive Zoning Code. 2. ENVIRONMENTAL REVIEW Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21 C, 1971 as amended), on May 23, 1995 the Environmental Review Committee issued a Determination of Non-significance for the five rezones identified in the checklist reviewed. 3 COMPLIANCE WITH ERC MITIGATION MEASURES Because no mitigation measures were imposed on this non-project action, there were no ERC conditions that the applicant was required to comply with. 4. STAFF REVIEW COMMENTS Because this and the other four P-1 rezones considered at the same time were considered to be non-project actions under SEPA, and because there were being sponsored by the City rather than private individuals, comments from other reviewers were not individually solicited. This item and the four rezones were, however, discussed at the Environmental Review Committee meeting on September 23, 1997. "In any case where a change of the zone classification of property is recommended, at least one of the following circumstances shall be found to apply:" (5A) GENERAL CRITERIA: (1) PREVIOUSLY NOT CONSIDERED ZONING RECLASSIFICATION: That substantial evidence was presented demonstrating the subject reclassification appears not to have been specifically considered at the time of the last area land use analysis and area zoning; or The subject site was not specifically considered at the time of the last area land use analysis and area rezoning since it was understood that Staff were studying the P-1 Zone and were preparing recommendations to the Planning Commission and City Council on whether this special zoning should be retained or assimilated into the City's other new zoning classifications. Nearby uses abutting the subject site to the north, east and south were rezoned in June, 1993 to the R-1, R-8, RM-I, CC and IH Zones. This and a number of other P-1 zoned sites were not rezoned at this time awaiting recommendations from planning staff for future zoning. As noted above in June, 1994 Council directed staff to proceed with the assimilation of the P-1 Zone into the City's other new zoning categories (see Exhibit B). (2) CONFORMANCE WITH THE COMPREHENSIVE PLAN, ITS ELEMENTS & POLICIES: That the property is potentially classified for the proposed zone being requested pursuant to the policies set forth in the Comprehensive Plan and conditions have been met which would indicate the change is appropriate; or The subject site has been determined to be potentially classified for the proposed R-1 Zone based upon the fact that it is designated on the City's Comprehensive Land Use Map as Residential Rural, which encourages lower density single-family residential near and/or within environmentally sensitive areas. The recommended R-1 zoning would be consistent with the City's Comprehensive Plan. • The existing use is also consistent with a number of the Plans objectives and/or policies including Objective LU-XX pertaining to providing open space and preserving land to meet the recreational needs of present and future generations. Likewise, it is consistent with Objective LU-ZZ pertaining to developing a maintaining a system of high quality parks and recreation facilities to serve Renton residents. Clearly, the existing park is an important regional amenity that serves not only residents of Renton, but also of the greater region. The existing facility also meets a number of the other objectives including being part of an approved comprehensive parks and trails master plan, being part of a coordinated development where architecture of various buildings and shelters have coordinated through the use of similar materials and design elements, and where significant natural features (Lake Washington) have been utilized to create focal points. The proposed rezone is also appropriate because the new "P" suffix designation on the rezone ensures early public notification whenever there is a change in the use, ownership, or tenancy of a public owned facility, including parks. This is intended to provide an increased opportunity for public input to decision makers before any action is taken. Therefore, it would appear that Policies LU-229, LU-230, and LU-231 (pertaining to preserving public lands for public uses), are met as well. COULONHX.DOC City of Renton Economic Development A,.;,y,,aorhoods/Strategic Planning Department Preliminary Report to the Hearing Examiner iy GENE COULON PARK REZONE LUA-97-115, R, ECF PUBLIC HEARING DATE: Page 5 of 5 (3) TIMELINESS OF PROPOSED REZONE: That since the last previous land use analysis of the area zoning of the subject property, authorized public improvements, permitted private development or other circumstances affecting the subject property have undergone significant and material change. As noted above, the proposed rezone is timely because in June, 1995 the City adopted new zoning provisions to protect the public trust that implement Public Facilities policies LU-229, LU- 230, and LU-231. These provisions ensure early notification of nearby residents and property owners whenever there is a change of use, ownership, or tenancy (where it is likely to affect surrounding uses) of any publicly owned property have a "P" suffix designation. It was important to have these provisions in place before proceeding with these rezones so that the public trust would be protected. This broad protection of the public trust was not available back in 1993. H. RECOMMENDATION: Staff recommends approval of the Gene Coulon Park Rezone, Project File No. LUA-97-115, R, ECF, from the Public Use (P-1) Zone to the Residential - 1 du/ac (R-1) Zone with a "P" suffix attached for the following reasons: (1) The rezone is consistent with the Comprehensive Plan Land Use Map designation for this parcel, as Residential Rural, which endeavors to preserve open space and natural resources, protect environmentally sensitive areas by limiting residential development in critical areas as well as areas identified as part of a city-wide or regional open space network. Gene Coulon park is part of the edge of Lake Washington which a regional open space/resource; (2) The rezone would be consistent with earlier city-wide rezones of other properties in the area that were zoned R-1 in 1993 and/or 1995. This rezones is also consistent with the existing use of the subject property since existing neighborhood, community and regional parks are a permitted primary use in this zone; and, . (3) The subject rezone is a non-project action under SEPA and is a legislative act which is not expected to actually reduce the development potential of the site. It would reduce the scope of uses that might otherwise be allowed under the P-1 Zone which includes a broad list of governmental uses ranging from hospitals and health clinics to airports and waste treatment facilities. NOTE: The applicant was not required to comply with any mitigation measures since the Environmental Review Committee issued a straight DNS for this and the other four rezones in considered on September 23, 1997. Mac Onie REZONES FILE# GR`-41 FROM P 1 TO R— 1(P) 0 600 1200 REZONE SITE 1 :7200 — — CITY LIMITS CITY OF RENTON PLANNING/BUILDING/PUBLIC WORKS MEMORANDUM DATE: November 14, 1997 TO: Leslie Betlach FROM: Mike Kattermann SUBJECT: Gene Coulon Park Rezone Thank for your E-mail of November 13, 1997 regarding future zoning classifications to replace the P- 1 zoning on Gene Coulon Park and allowed uses under the Resource Conservation(RC) zoning at the Maplewood Golf Course. N Parks: What is apparent from this matrix is that existing and new neighborhood, community and regional parks are allowed in all three zones. New parks however, must show that they are consistent with the City's Comprehensive Park,Recreation and Open Space Master Plan and Trails Master Plan and comply with site plan review. In regards to restaurants within existing parks there is no provision for this ancillary use in either the RC, R-1, or R-5 zones. However, existing uses including restaurants, would be grandfathered in and allowed to continue but typically not expand. Golf Courses: In terms of public and private golf courses the code is more permissive, allowing `associated buildings including restaurants"in both the RC and R-1 zones. In the RC Zone existing public and private golf courses not only are allowed as a Permitted Primary Use, but can also be expanded as can"associated buildings including restaurants". We are recommending the R-1 Zone since this is the only one of the three zones currently in the area(kitty-comer to the northeast corner of Gene Coulon Park). As far as I know the R-5 Zone has not yet been applied to existing areas within the City and is primarily intended to be applied to areas within 1/2 mile of the King County Urban Growth Area Line. However, it can also be applied to residential rural(RR)designated areas with no significant environmental constraints. As an urban park abutting an Urban designated shoreline on one side and multi-family infill across the street a RC zoning classification seems inappropriate since this zone is primarily intended to be a low density residential zone which: provides separation between areas of more intense urban uses; encourages or preserves semi-rural residential uses; allows limited commercial farming uses; and/or protects environmentally sensitive areas such as flood plains, wetlands, streams and aquifers, etc., none of which really apply to the site. Thank you. cc: Don Erickson • ALTERNATIVE REZONE CLASSIFICATIONS FOR GENE-COULON PARK P-1 REZONE ii2OISIENEEMMEERNMEN !PERMITTEDTRIMARIVITSESNO TVIEWITTEBSECOMAREETSESI RESOURCE CONSERVATION g.Existing and expansion of existing d.New neighborhood, community, and (RC) public and private golf courses and regional parks and trails, open spaces associated buildings including subject to the following conditions: restaurants. 1) Site plan review is required. j.Neighborhood, community and 2)Consistent with City Master Parks regional parks, trails and open space and Trails Plan. existing at the effective date hereof. k.Public or commercial botanical gardens with an accessory restaurant and/or gift shop. Where the code for individual zones did not specifically address the use, HEX was entered. This explains the HEX (if defined as a park) qualifier under the Trails heading. Since Open Spaces are differentiated from Parks, NA was entered when these were not specifically permitted. Do Open Spaces need to be a permitted use? Additionally (if we're picking nits), in the CD code section, Parks, Trails and Open Space are under the Retail Sales heading. In IL, they are under the Services section. Also in the IL, Community Parks are referred to as Commercial Parks. permprkl.doc Permitted Park Uses by Zone Old Zone Existing Existing Existing Existing Existing New New New New Trails New Open Name Neighbor- Community Regional Trails Open Space Neighbor- Community Regional Space (New Name) hood hood T HEX* HEX* HEX* HEX* NA HEX* HEX* HEX* HEX* NA (RM11) (if def.as park) (if def.as park) } ,' RC P P P P.
