4479CITYOFRENTON,WASHINGTONRESOLUTIONNO.4479ARESOLUTIONOFTHECITYOFRENTON,WASHINGTON,AMENDINGTHE2021-2022CITYOFRENTONFEESCHEDULETOADDBASEPENALTIESFORINFRACTIONS.WHEREAS,theRentonMunicipalCodeauthorizesfeeswithoutestablishingaspecificamount,theCityCouncilspecifiesfeeamountswithinaconsolidatedfeeschedulethatisadoptedinconjunctionwithitsbiennialbudgetandthereafteramendedfromtimetotime;andWHEREAS,onNovember9,2020,theCityCouncilpassedResolutionNo.4422,adoptinganamendedfeeschedulefor2021and2022;andWHEREAS,theCityofRentonFeeSchedulefor2021and2022wassubsequentlyamendedbyResolutionNo.4433,ResolutionNo.4441,ResolutionNo.4453,andResolutionNo.4467,andResolution4473;andWHEREAS,theRentonMunicipalCodecontemplatesthatinfractionshavebasepenaltiesofupto$250inaccordancewithRCW7.80RCW;andWHEREAS,theactualpenaltiesimposedforsaidinfractionshavebeensetlowerthanthemaximumamount,baseduponschedulespublishedforusebypoliceofficerstoensureconsistencyintheamountchargedtoviolators;andWHEREAS,currently,penaltiesarelistedwithinacomputersystemcontrolledbyWashington’sAdministrativeOfficeoftheCourt;andWHEREAS,toprovidegreaterpublictransparencyastothebasisoftheamountofpenaltieschargedforviolationsdeemedtobeinfractionsundertheRentonMunicipalCode,theCityCouncilhaselectedtoaddapenaltystructureforinfractionstotheCityofRentonFee1 RESOLUTIONNO.4479SchedulewithbasepenaltyamountsestablishedconsistentwithapplicablerulesestablishedbythestatesupremecourtandtheamountshistoricallyimposedbytheCity;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DORESOLVEASFOLLOWS:SECTIONI.TheCityofRentonFeeScheduleisamendedtoaddanewsection(SectionXIV)governingbasepenaltiesforviolationsoftheRentonMunicipalCodethataredeemedtobeinfractions,asfollows:SECTIONXIV.MONETARYPENALTYSCHEDULEFORINFRACTIONS20232024ISSUEDUNDERTHEAUTHORITYOFCHAPTER7.80RCW1.EffectofSchedule.ThisscheduleestablishesdefaultbasepenaltiesforviolationsoftheRentonMunicipalCodethatareissuedasinfractionsundertheauthorityofRCW7.80RCW,butthesepenaltiesdonotincludeanystate-imposedstatutoryassessments.Exceptasotherwiseprohibitedbylaworcourtrule,acourtwithjurisdictionovertheinfractionmayimposeonadefendantalesserpenaltyinanindividualcase.Providedthat,wheneverthebasepenaltyplusmandatorystatutoryassessmentsresultsinatotalpaymentthatisnotanevendollaramount,thebasepenaltyisdeemedtobeamendedtoahigheramountwhichproducesthenextgreatestevendollartotal.2.PenaltiesEstablishedbyCourtRuleorSpecificPenaltyEstablishedbyLaw.Thisscheduledoesnotapplytopenaltiesestablishedbystateorlocalcourtruleortoapenaltythatisestablishedbylawwithaspecificamount(i.e.ordinanceorstatutesettingapenaltyequaltoaspecifiedamountratherthanapenaltyuptoamaximumamount).Totheextentapenaltyscheduledhereinconflictswithastateorlocalcourtruleorapenaltythatisestablishedinlaw,thisscheduleshallbedeemedpreemptedbythecourtruleorpenaltyestablishedbylaw.3.PenaltySchedule.Thefollowinginfractionsshallcarrythefollowinglisteddefaultbasepenalty,notincludingstatutoryassessments:a.ViolationofParkRules(CivilInfraction)RMC2-9-8.C$73$73ActivitiesProhibitedinaParkRMC2-9-8.C.1$73$73ii.DisregardParkTrailSignRMC2-9-8.C.2$73$73iii.UnauthorizedVehicleinaParkRMC2-9-8.C.3$73$73iv.OperatingMotorizedVehicleonRMC2-9-8.C.4$73$73ParkTrailv.DismountZoneViolationRMC2-9-$.C.5$73$73vi.SpeedingonTrailsRMC2-9-8.C.6$73$73vii.Vehicle/BoatRepairinParkRMC2-9-8.C.7$73$73viii.RacinginParkRMC2-9-8.C.8$73$732
