POLICY&PROCEDURESubject:Index:LEGISLATIVEREMOTEATTENDANCEATCOUNCILNumber:800-13MEETINGSEffectiveDate:Supersedes:Page:StaffContact:ApprovedBy:TBD12/10/20181012CAOResolution#1.0PURPOSE:ToestablishremoteattendanceguidelinesforalltypesofCityCouncilmeetings.2.0ORGANIZATIONSAFFECTED:CityCouncilmembers3.0REFERENCES:RCW42.304.0POLICY:4.1RemoteAttendanceAuthorized:TheOpenPublicMeetingsAct(OPMA)requiresthatwhensafetodoso,meetinglocationsbeataphysicallocation,butencouragespoliciesandpracticesthataccommodateremoteviewingandparticipation.TheCouncilrecognizesthebenefitsoffullattendanceofitsmembersatregular,special,andemergencymeetingsandencouragesCouncilmemberstoattendin-personwhensafetodoso.However,theCouncilalsorecognizestherearetimeswhenCouncilmembersmaybeunabletoattendmeetingsphysicallyorsafelyinperson.Toaccommodateoccasionalremoteattendance,eachCouncilmembermayremotelyattendalltypesofCouncilmeetingsbytelephonic/virtualmeansuptofour(4)timesinasinglecalendaryearwithoutseparateapprovaloftheCouncil.4.2NoticetoCouncilLiaison:CouncilmembersshallprovidenoticeoftheirintenttoattendaCityCouncilmeetingremotelytotheCouncilLiaison,ordesignee,atleastfifteen(15)minutespriortothemeeting.4.3LimitsonAuthorizationforRemoteAttendance:IftheirattendancecanbetechnologicallyaccommodatedbyCitystaff,Councilmemberswhohavepreviouslyremotelyattendedlessthanfour(4)Councilmeetingswithinthe REMOTEATTENDANCEATCOUNCILMEETINGSp.2calendaryearwillbeallowedtofullyparticipateinthemeetingwithoutseparateCouncilauthorization.Exceptinthecaseofemergencymeetingsorasrequiredtocommenceameetingwithaquorum,Councilmemberswhohavealreadyattendedfour(4)CouncilmeetingsremotelywithinthecalendaryearwillnotbeallowedtofullyparticipateinthemeetingwithoutpreapprovalbymajorityvoteoftheCouncil.NothinginthisPolicypreventsaCouncilmemberfromremotelyattendingasamemberofthepublic.4.4ExceptiontoLimitonRemoteAttendance:Remoteattendanceshallnotcountagainstthefour(4)instancesofremoteattendanceifsuchremoteattendancewas(a)priortoJanuary1,2023,(b)aresultofarequesttoattendpursuanttoSection4.8ofthisPolicy,or(c)asaresultofaremoteorhybridmeetingheldinaccordancewithSection4.11ofthisPolicy.4.5NoMinimumNumberofInPersonCouncilAttendees:ThereshallbenorestrictionsonthenumberofCouncilmembersattendinganymeetingremotely.4.6UseofStaffApprovedTechnologyRequired:RemoteattendancebyaCouncilmembershallbethroughtheCity’sapprovedonlinevideoconferencingsoftwareapplicationorotheravailabletechnologicalsolutionapprovedbyCitystaff.4.7AllAttendeesMustbeabletoHearAllParticipants:Allmeetingattendeesmustbeabletohearallauthorizedmeetingparticipantsspeakinrealtime,includingCouncilmemberswhoparticipateremotely.Councilmemberswhoattendameetingremotelybutcannotmeetthisrequirementwillbeconsideredtohavenotbeeninattendance.Whentechnologicallyfeasible,CouncilmembersandthoseinvitedtopresenttoCouncilareencouragedtokeeptheircamerason.4.8RequestsForRemoteAttendance:TheCouncilPresident,ordesignee,attheirdiscretion,mayalsorequestabsentCouncilmemberstoattendremotelytoensureaquorumoftheCouncilsothatCitybusinesscanbeconductedinatimelymanner.Remoteattendanceinresponsetosucharequestshallnotcountagainstthecalled-uponthelimitonremoteattendanceinSection4.3ofthisPolicy.4.9RecordingRemoteAttendance:ACouncilmember’sremoteattendancewillberecordedintheofficialminutesoftheCouncilmeeting.4.10RemoteAttendanceatExecutiveSessions:Councilmembersmayalsoattendexecutivesessionsremotelyiftheyhavemettherequirementsofthispolicyandtheattendancecanbetechnologicallyaccommodated.4.11RemoteMeetingsandAttendanceDuringDeclaredEmergencies:IntheeventofanemergencydeclaredbythePresidentoftheUnitedStates,theGovernorof REMOTEATTENDANCEATCOUNCILMEETINGSp.3WashingtonState,theMayor,oranotherauthorizedofficial,andadeterminationbyeithertheMayor,CouncilPresident,ortheirdesigneethatanin-personmeetingcannotbeheldwithreasonablesafetyduetotheemergency,theCouncilmayholdremotemeetingswithoutaphysicallocation,ormaylimitthephysicalattendanceofsomeorallmembersofthepublicandCitystaffatameeting.AmeetingheldinaccordancewiththissubsectionshallcomplywiththeOpenPublicMeetingsAct—RCW42.30,asnowenactedorhereafteramended,andaslawfullysuspendedoralteredinaccordancewithadeclaredemergency.5.0DEFINITIONS:5.1Quorum:TheminimumnumberofCouncilmemberswhomustbepresentatameetingtotransactCouncilbusiness.Generally,aquorumconsistsoffourormoreCouncilmembers.5.2RemoteAttendance:Theuseoftelephonic,electronic,orothertypeofaudio/videoequipmenttoattendameetingwithpeoplewhoareindifferentlocations.
