BETZ REZONE APPEAL Fife 'R- 400-79 The applicant ' s appeal letter to the City Council does not delineate any errors in fact or law. It discusses arguments which were included in the Hearing Examiner ' s public hearing. The single family residences adjacent to the proposed site on both the west and south are generally well maintained. There have been recent major remodeling projects completed on several of the homes in the area to the south of the subject site, which suggests continuing stability of the area. The apartment complex to the east of the subject site is generally constructed to height and density standards of an R-2 classification. The two-story structure is not as imposing as a three-story, poten- tially 40 foot high structure immediately adjacent to single family would be. The R-2 designation would be compatible with the existing developed intensity and would also tend to buffer the impact of the four-story Cortina Apartments to the north. Other approaches, such as height and bulk limitations by cove- nant or similar means, could achieve the desired .result , but would in effect reduce the development potential to essentially that allowed in R-2. Applicant requests that the whole of the parcel of property be rezoned to R 3 . In support thereof applicant submits the following: 1. The parcel in question is per the comprehensive plan R 3 . 2 . No objections were filed by any property owners within the neighborhood. 3 . No objection was filed by the Police Department, Fire Department, Building Division, Engineering Division, Traffic Division, or the Utilities Division. 4 . The Planning Department' s analysis on their preliminary report, Paragraph L3 , says : "The single family homes to the west and south .sug.gest that a lower density on a portion of the site, such as R 2 may be appropriate to "prevent blight by protecting residential/districts from unwarranted infliltration of incompatible uses which 'would contribute to premature decay (of adjoining single family uses) " . Emphasis my own. The Department indicates that it may be appropriate to provide a buffer zone. It is well known that buffer zones, can be provided in the form of fencing and/or plantings . 5. There has be substantial development in the area since the passage of the comprehensive plan. 6. That the Cortina Apartments immediately north of the applicant's property was developed without any buffer zone being provided. - 1 - 7 . That the homes south of applicant's property are across the street all are minimal cost houses . The back yards face the applicant's property. 8 . The property immediately west of applicant's property contains five houses of which only two abutt applicant's property. Four of the houses back yards face applicant's property, and one rental house has a side yard which faces applicant' s property. 9 . Hearing Examiner:, Approval to R-3 for the easternmost lot and to R-2 for the westernmost lot subject to conditions, PLANNING DEPARTMENT The Planning Department preliminary report was received by the REPORT: . Examiner. on September 5, 1979. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field . checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on September 11, 1979 at 9:00 a.m. in the Council Chambers Of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. • It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. Roger Blaylock, Associate' Planner, reviewed Exhibit #1, and entered the following ' additional exhibits into- the record: Exhibit #2: Vicinity Map - Exhibit #3: ' King County Assessor's Map The Examiner requested testimony by the applicant. Responding was: . Wyman Dobson P.O. Box 59 Renton, WA 98055, Mr. Dobson, legal counsel for the applicant, objected to the Planning Department . recommendation for division of the property into R-2 and R-3 zoning categories. He advised that the subject site originally contained two single family residences which have since been removed, and at-the time of rezoning of the properties in 1958 and 1966 to R-3, a buffer zone, recommended as a' condition of development of the subject site, was not required. . He stated that the Comprehensive Plan, adopted in 1965, designates. the subject, site as R-3, medium density multifamily residential property, and advised his opinion that the timing is proper for approval of the request. Referencing Section L.,4 of Exhibit #1, which states that access from the Cortina Apartments located north of the site is directly onto Edmonds Avenue N.E. , and Section L.6 regarding improvement of ;,4I N.E..:, 9th Place upon development of the site, Mr. Dobson advised that the access for the "{' 20-unit Cortina Apartments is a limited, substandard 20-foot wide roadway. He indicated that buffering from five single family homes could be 'accomplished on the westerly boundary V. by retention of a large stand of existing trees. To demonstrate' compatibility of the request with surrounding uses, Mr. Dobson advised that an apartment building which has A',. been converted from an old church, a four-plex and six-plex exist west of the subject site on the west side of Edmonds Avenue N.E. 'The Examiner noted that single family '!'•.' residences exist: south of the proposal. Mr. Dobson advised that backyards of those 'q homes to the south face the subject site, and frOnt yard views would not be affected. ., Mr. Dobson asked the Planning Department representative if objection to the proposal had 10s' been received from residents to the south or west of the site or from city departments. Mr. Blaylock 'advised that although.departmental comments have not yet, been received from the Public Works bepartment, no objections were received from either the residents, the Fire or Police Departments. Mr. Dobson inquired if the declaration of non-significance fi r R-400-79 Page Two • issued by the responsible official, Gordon Y. Ericksen, Planning Director, had been based upon the rezone proposal of the entire site to R-3 zoning or in accordance with the revised Planning Department recommendation for rezone to R-2 and R-3. The Examiner advised that the declaration had been based upon .the proposal for R-2 zoning for the western 75 feet of the site and R-3 zoning on the easterly portion. Mr. Dobson reported that the Planning Department review of impacts on the natural or human environment contained in Section I. of Exhibit #1 is in error, therefore, because the allowable density would be reduced from 19 units, and traffic and other impacts upon the environment would thereby be decreased. The Examiner clarified that three units would be allowed on the R-2 property and. 11 units on 'the R-3 portion for a total of 14 units. Mr. Dobson advised the applicant's concurrence with requirements for improvement of N.E. 9th Place and preservation of large existing trees on the site, but requested the Examiner to grant the requested rezone to R-3 with provision of buffering on the western boundary with large trees and fencing. The Examiner requested testimony in support of the application. Responding was: Clinton Betz • 6618 Southwest Admiral Way • Seattle, WA Mr. Betz, owner of the property, advised that following adoption of the Comprehensive Plan in 1965 he had purchased the subject site and the 10-unit apartment building located to the east in 1966 and 1969, although the apartments had recently been sold. He indicated that the rezone request had been delayed because of high apartment vacancy rate in past years due to Boeing layoffs. He noted that the site is surrounded by rental units which are either apartments or small homes, and he objected to division of the property into two zoning categories because of the difficulty created for development. Mr. Betz indicated his concurrence in the recommendation for dedication of right-of-way and • retention of existing trees on the site. The Examiner inquired regarding side yard setback requirements for structures the R-3 zone. David Clemens, Senior Planner, reported that a 10-foot setback would be required for a structure containing 20 feet in height, and one additional foot would be required for each additional 10 feet in height. Mr. Blaylock advised that the 10-unit apartment structure located east of the subject site. was rezoned to R-3 in 1958 prior to adoption of the Comprehensive Plan in 1965 and is adjacent to the Cortina Apartments located to the north, also zoned R-3. He noted that the subject site is located on the boundary of the designated medium density residential property, and in view of proximity of single family residential uses, the western portion of the property should be utilized as a buffer area. Mr. Blaylock advised that regardless of whether or not the existing homes are utilized as rentals, the existing character of the neighborhood is single family residential ald should be buffered on the western 75 fe'et from the more intensive multifamily residential use. The Examiner. requested .further comments in support of the application. Mr. Dobson reported the designation on the Comprehensive Plan of an already existing buffer zone consisting of low density multifamily, R-2, property to the south and west of the subject site. The Examiner advised that the Comprehensive Plan is an element to be considered as a general guide for rezone approval, and does not contain'specific boundaries such as the zoning map of the city. The Examiner requested further comments in' support or opposition to the application. There was no response. He then requested further comments from the Planning Department. S=nce there was no additional testimony, the hearing regarding File No. R-400-79 was closed by the Examiner at 9:35 a.m. FINDINGS,. CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: ' FINDINGS: • 1. The request is for approval of, a rezone of +.63 acres of land from R-1 (single family residence) to R-3 (medium density multifamily residence) . The property is located on the north side of N.E. 9th Place between Edmonds Avenue N.E. and Sunset Boulevard N.E. • 2. The Planning Department report sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, R.C.W. 43.21.C. , as amended, a Declaration of Non-Significance (DNS) : has been issued for the subject proposal by Gordon Y. Ericksen, responsible offici 1. The DNS was based. on the Planning Department's recommended reclassification of the 4' western lot to R-2 (duplex residence) ,and the eastern lot to R-3. R-400-79 Page Three 4. All existing utilities are available and in close proximity. 5. The subject parcel is part of the original plat of the City of Renton. The present classification, R-1, was established in 1953 when the original zoning ordinance was enacted. • 6. The site is vacant and slopes slightly downward from the north to the south. The subject property was previously developed with single family homes. The western perimeter of the property is developed with some large deciduous and Douglas fir trees. 7. The area contains a mixture of zoning classifications and land use types. North and east of the subject site the zoning is R-3. The twenty-unit Cortina Apartment is developed to the north and a 10-unit apartment is developed to the east. Directly • to the west of the subject parcel the property is zoned R-1, as is the property to the southwest and south. Single family uses are developed in both of these R-1 zones. Directly south of the subject property across N.E. 9th Place is a duplex located on a single parcel which was rezoned in 1967 from R-1 to R-2 to reflect the then current use. 8. N.E. 9th Place forms the dividing line for the Comprehensive Plan's delineation of of medium density multifamily north of N.E. 9th Place and low density multifamily south of N.E. 9th Place. 9. The Planning Department recommended that the western lot of the subject parcel be rezoned to R-2 to provide a buffer between the single family uses to the south and west of the subject property and the remaining portion of the subject parcel which they recommended be rezoned to R-3 to match the zoning east of the subject parcel. 10. The requested zoning for the subject parcel would permit 19 units apportioned between the two lots. The zoning recommended by the Planning Department would permit two units on the western portion of the site without a special permit and eleven units on the eastern portion of the subject site for a total of 13 units. With a special permit the applicant could establish one additional unit on the western portion of the property. 11. N.E. 9th Place is a 40-foot wide substandard street. The Planning Department recommended that the applicant dedicate the southernmost 10 feet of the subject parcel for street right-of-way to help accommodate the extra traffic use the development of the subject property will generate. CONCLUSIONS: 1. The applicant for a rezone must demonstrate compliance with the criteria of Section 4-3014, which provides in part that: a. The site has not been considered in a previous area rezone; b. The subject site is potentially zoned for the new classification per the Comprehensive Plan and conditions indicate that the change is appropriate; or c. There have been significant changes in the area since the last rezone in the area. The applicant has failed to justify that the zoning requested for the entire parcel is appropriate for the area. The Planning Department recommendation is more in keeping with the character of the surrounding property. 2. The area is a mixture of zoning types but the area to the south and west of the subject site is still predominantly in single family usage, and except for one parcel, is still zoned R-1. The requested change would impose a greater intensity of development on the adjoining property than is presently warranted. ' The amenities of single family residences should not yield to multifamily apartments without some buffering by a less intense use. The Comprehensive Plan is no more than a guide to the type of development which may be suitable for an area. "It is not a final blueprint, but rather a general design for future growth. " (Page 2, Renton Urban Area Comprehensive Plan, 1965) The area must be currently suitable for the designated development before actual zoning is implemented to permit more intense development. The western lot shares a long side yard with a single family residence. In addition, another single family home shares a portion of its rear yard line with the western lot. It is inap propriate to permit the use of this property for more than duplex type development. 3. The Comprehensive Plan recognizes this principle of buffering by generally separating {!: residential densities differing in scale by more than one zoning category with a %' transitional density type development. t f. R-400-79 Page Four In the Comprehensive Plan N.E. 9th Place appears to separate levels of development and designate the area to the north for medium density development, but this fact must be looked at in terms of• the actual useage. On page 18 of the Comprehensive • Plan: "Adopt zoning maps which reflect the guidelines established by the Land Use Plan and which are realistic in terms of current needs. " (Emphasis supplied) The western lot under the facts presented should be reclassified at an intensity of no more than R-2. As such it would serve to buffer the single family. uses to the west and south from the apartment uses to the north and east. Rezoning the western lot to R-3 would lead to the premature decay of the remaining single family residences in the area and is therefore contrary to the goals and objectives of the Comprehensive Plan (Comprehensive Plan Land Use Report, 1965, Objective No. 1) . • 4. Similarly; the eastern lot shares both its northern and eastern borders with R-3 zoning and these properties are developed with apartments. This lot cannot be considered potentially desirable for single family development, and the applicant has demonstrated that, circumstances surrounding this portion of the subject property suggest that a more appropriate designation would be R-3, but separated from the R-1 zone to the .west by the western portion's recommended R-2 classification. .5• The property abuts N.E. 9th Place, a substandard 40-foot wide street, which would not adequately serve further development along the right-of-way. The applicant's reference to access for the Cortina Apartments has no bearing on the present question since that access is privately developed and is not a public street on which the potential for conflicts and safety problems is greater. The applicant indicated willingness to dedicate an additional 10 feet of right-of-way to the city for development and such dedication shall be a condition of approval of the rezone since the applicant's future. proposal will increase the traffic on N.E. 9th Place. 6. To further buffer the single family uses to the west, the trees along the western property line should be preserved. RECOMMENDATION: • The City Council should approve the rezone of the eastern-most lot to R-3 as requested by the applicant and approve the rezone of the western-most lot to R-2; both actions subject to the dedication of the southernmost ten feet of the entire parcel to the city for the development of right-of-way for N.E. 9th Place and subject to the preservation of the trees on the western property line for the purpose of buffering the. single family uses to the west. The Cortina Apartments have been constructed on this site with direct access onto Edmonds Avenue NE. The property immediately to the east was rezoned from R-1 to R-3 by Ordinance #1707 of November 25 , 1958 and Ordinance #1673 of March 11 , 1958. 5. The subject site has remained zoned R-1 since the implementation of the rite-wide zoning ordinance in 1953. This would seem to demonstrate that the subject reclassification appears not to have been specifically considered at the time of the last area land use analysis in 1965 and therefore, the requirements of Section 4-3014(A)1 have been met . The Administration was asked to obtain the details of sponsoring agency, as no city expense can be involved. Planning and Planning and Development Committee Chairman Perry requested Development delay in presentation of report due to letter received from Committee Dobson, Houser and Dobson, Attorney for Clinton Betz re appeal Betz Rezone Appeal of Hearing Examiner's decision Rezone 400-79. Attorney requested Extended matter be extended to agenda of 10/22/79 as he could not be present due to illness. Request granted. Utilities Utilities Committee Chairman Trimm presented committee report Committee that recommended acceptance of the low bid for water project #456 = © Watermain Meadow Ave. N. watermain, submitted by DiOrio Construction Co. Meadow Ave. N. in the amount of $345,524.05. The report concurred in the Contract Award recommendation of the Public Works Department for acceptance of the low bid and award of contract and also recommended the Mayor and City Clerk be authorized to execute the contracts. Renton Hill The Utilities Committee report explained request for installation Water System of water system improvements in the Renton Hill area to provide Improvements fire flows sufficient for multiple residential developments on Mill Ave. S. and the city to provide financing. The Utilities Committee recommended that the program not be financed. by the city but that the developers explore the possibilities of creating an LID for the desired system improvements. A Renton City Council 10/15/79 Page 2 Old Business - Continued - Utilities Committee Report - Continued Honey Creek and The Utilities Committee report recommended that the city not Kennydale Trunk sell additional revenue bonds for the purpose of constructing Sewer Lines and the Kennydale and Honey Creek trunk sewer systems and noted co - Proposed Bonds cern of the committee than an increase in sewer rates would be required with this financing method. The report stated committee recommendation that all properties developed within the Honey Creek and Kennydale trunk line service areas be charged an area trunk change in the amount of 3 per sq.ft. to provide the trunkage program; that a special fund be established for that purpose. The committee also recommended that the system development charge of 1C per sq. ft. likewise be put into a separate fund to finance the Honey Creek and Kennydale trunk sewer lines. The report further recommended referral to the Ways and Means Committee for legislation to create said fund that provision be made for inflation and the systems develop =nt charge and special percentage of 3 per sq. ft. for trunkage charge be increased annually in accordance with the CPI to of 'set the effects of inflation. ORDINANCES AND RESOLUTIONS Ways and Means The Ways and Means Committee Chairman Clymer presented report Committee recommending second and final readings for the condominium Ordinance #3366 conversion ordinance which had been on first reading 10/8/79. Condominium City Clerk Mead read the ordinance regulating conversion of Conversion residential rental units to condominiums or cooperatives; Regulations providing protections for tenants and purchasers and providin• penalties for violations. MOVED BY CLYMER, SECOND PERRY, ADOPT THE ORDINANCE AS READ. MOVED BY STREDICKE, SECOND TRIMM, amend motion to include $200 relocation fee. Councilwoman Shinpoch spoke against the amendment. LID 314 Letter from Public Works Director Gonnason requested a temporary Loan Request loan from Street Forward Thrust to Design Engineering in the amount of $140,089.75 for purpose of paying Jones Associates , Inc. , consulting engineers for preliminary survey and design services in connection with creation of LID 314. The letter anticipated loan would be repaid prior to 12/31/79 from the interim financing to be obtained for LID 314; hearing scheduled 11/5/79 advanced from earlier date of 10/15/79.
