The Act also requires that an EIS be prepared for all major actions significantly affecting the quality of the environment. The purpose of this checklist is to help the agencies involved determine whether or not a proposal is such a major action. Please answer the following questions as completely as you can with the information presently available to you. Where explanations of your answers are required, or where you believe an explanation would be helpful to government decision makers , include your explanation in the space provided, or use additional pages if necessary. You should include references to any reports or studies of .which you are aware and which are rele- vant to the answers you provide. Complete answers to these questions now will help all agencies involved with your proposal to undertake the required environmental review with- out unnecessary delay. The following questions apply to your total proposal , not just to the license for which • you are currently applying or the proposal for which approval is sought. The subject property is located on the south side of S. 15th Street between Davis Avenue S. and Shattuck Avenue S. The parcel currently contains three single family residences, two on the southern portion of the parcel and one on the northern quarter of the parcel. There is area available for the establishment of one additional single family home on the subject site if the zoning were changed to the SR-1 requested. 8. The applicant proposes to subdivide the subject property into four lots if. the rezone is approved, and an application for a short plat is pending (File No. Short Plat 414-79) . 9. The subject site was annexed into the city in 1956 and the current GS-1 zoning was applied at that time. The Comprehensive Plan designates the area in which the subject property is located as suitable for single family development. 10. The area in which the subject site sits, south of I-405 and east of the Valley Highway, is predominantly zoned GS-1. There are some multi-lot parcels both north and northwest of the subject site which are zoned SR-1. 11. SR-1 zoning is the classification which is applied to the fringe urban areas of the city. Most of the lots in the GS-1 zone in which the subject property is located are non-conforming. These lots are all vastly undersized conforming more closely with the SR-1 category requested for the subject property.. 12. The GS-1 designation requires lots to be a minimum of 35,000 square feet while the SR-1 zone would require lots of 7,500 square feet. The subject parcel is approximately 35,000 square feet and contains three single family dwellings. 13. The area is almost exclusively developed with single family residences. CONCLUSIONS: 1. The proponent of a rezone must demonstrate that the request fulfills at least one of the criteria cited in Section 4-3014 which provides in part that: a. The subject site has not been considered in a previous area wide rezone; b. The subject site is potentially designated for the new classification per the Comprehensive Plan; or c. The area in which the subject property is located has undergone significant and material change since the last analysis of the subject site. The applicant has demonstrated that the criteria enumerated above have been met. 2. The area in which the subject property is located is designated in the Comprehensive Plan for single family development. The area is currently developed with single family dwellings. The predominant lot size in the area in which the subject property is located trends towards about 7,500 square feet, the lot size of the SR-1 zone and the zoning which the applicant has requested for the subject property. 3. Approval of the rezone would permit the applicant to divide the subject property, into four lots which would be in character with the surrounding lot size and would also permit the applicant to convey each of the lots into separate ownership as legal size lots of record. 4. The property was annexed into the city over twenty years ago and except for the Comprehensive Plan designation of the area as suitable for single family development, the area has not undergone any other land use analysis. 5. The current request is justified in light of surrounding development. patterns. It would permit the separate ownership of the current dwellings on the site, and would permit the establishment of an additional single family home on the subject property without burdening the existing public services in the area.
