HomeMy WebLinkAboutORD 6081CITYOFRENTON,WASHINGTONORDINANCENO.6081ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,AMENDINGSUBSECTION4-2-060.0OFTHERENTONMUNICIPALCODE,ADDINGADEFINITIONOF“BATTERYENERGYSTORAGESYSTEMFACILITY”TOSECTION4-11-020OFTHERENTONMUNICIPALCODE,LIFTINGTHEMORATORIUMESTABLISHEDBYORDINANCENO.6061,AUTHORIZINGCORRECTIONS,PROVIDINGFORSEVERABILITY,ANDESTABLISHINGANEFFECTIVEDATE.WHEREAS,theCityofRentonhasadoptedaComprehensivePlanandzoningregulationspursuanttotheGrowthManagementActthatauthorizeslandusesandactivitieswithintheCity;andWHEREAS,theCityreceivedaBatteryEnergyStorageSystem(“BESS”)pre-applicationmeetingrequest;andWHEREAS,BESSisnotanauthorizedorpermittedusepursuanttotheCity’sComprehensivePlanandzoningregulations;andWHEREAS,theCityCouncilhaddeterminedtherewasaneedforamoratoriumonacceptinganylanduseapplication,buildingpermitapplication,orbusinesslicenseapplicationforBESS;andWHEREAS,themoratoriumwasestablishedonApril18,2022byOrdinanceNo.6061;andWHEREAS,onceineffect,thisordinanceshallsupersedeOrdinanceNo.6061;andWHEREAS,inaccordancewithRCW35A.63.220,apublichearingwasscheduledandheldonJune6,2022;andWHEREAS,themoratoriumisscheduledtobeineffectuntilOctober18,2022,unlessendedearlierbysubsequentCityCouncilaction,orunlessextendedbytheCityCouncilpursuanttostatelaw;and1
ORDINANCENO.6081WHEREAS,theCityCouncilsoughttounderstandanyimpactsanddetermineappropriatezoninganddevelopmentstandardsforsuchsystems;andWHEREAS,theCity’sCommunityandEconomicDevelopmentDepartment(CED)regularlyundertakesworkprogramstoproposeamendmentstoTitleIVoftheRentonMunicipalCode(RMC);andWHEREAS,thismatterwasdulyreferredtothePlanningCommissionforinvestigationandstudy,andthematterwasconsideredbythePlanningCommission;andWHEREAS,pursuanttoRCW36.70A.106,onJuly1,2022,theCitynotifiedtheStateofWashingtonofitsintenttoadoptamendmentstoitsdevelopmentregulations;andWHEREAS,thePlanningCommissionheldapublichearingonJuly20,2022,consideredallrelevantmatters,andheardallpartiesinsupportoropposition,andsubsequentlyforwardedarecommendationtotheCityCouncil;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.AllportionsoftheRentonMunicipalCodeinthisordinancenotshowninstrikethroughandunderlineeditsorarenotexplicitlyrepealedhereinremainineffectandunchanged.SECTIONII.Subsection4-2-060.0oftheRentonMunicipalCodeisamendedbyaddingarowforBatteryEnergyStorageSystemFacjjjy.asshowninAttachmentA.AllotherprovisionsinSection4-2-060remainineffectandunchanged.2
ORDINANCENO.6081SECTIONIII.Section4-11-020oftheRentonMunicipalCodeisamendedtoaddadefinitionof“BatteryEnergyStorageSystemFacility”inalphabeticalordertoreadasshownbelow.Allotherdefinitionsin4-11-020remainineffectandunchanged.BATTERYENERGYSTORAGESYSTEMFACILITY:Oneormoreutility-scaleenergystoragesystemsdesignedtoreceive,store,anddischargeenergytoandfromtheelectricalgridorenergygenerationfacilityforlateruse.BatteryEnergyStorageSystemsgenerallyconsistofbatteriesassembledtogetherandmayincludeon-siteswitchyard,inverters,associatedinterconnectiontransmissionline,andsupervisorycontrolanddataacquisitionsystem.Thisdefinitionexcludesindividualresidentialandcommercialusesystemsforonsiteenergyuse,standalone12-voltcarbatteryorelectricmotorvehicles,andotherconsumerproducts.SECTIONIV.ThemoratoriumestablishedbyOrdinanceNo.6061isherebyendedonthesamedateastheeffectivedateofthisordinance.SECTIONV.UponapprovaloftheCityAttorney,theCityClerkisauthorizedtodirectthecodifiertomakenecessarycorrectionstothisordinance,includingthecorrectionsofscrivenersorclericalerrors;referencestootherlocal,state,orfederallaws,codes,rules,orregulations;orordinancenumberingandsection/subsectionnumberingandreferences.TheCityClerkisfurtherauthorizedtodirectthecodifiertoupdateanychapter,section,orsubsectiontitlesintheRentonMunicipalCodeaffectedbythisordinance.SECTIONVI.Ifanysection,subsection,sentence,clause,phrase,orwordofthisordinanceshouldbeheldtobeinvalidorunconstitutionalbyacourtorcompetentjurisdiction,3
