W. Custer, Mayor, in the Council Chambers, City Hall, and the Pledge of Allegiance to the Flag was recited in unison by the assembly. ROLL CALL OF COUNCIL MEMBERS: Garrett, Morris, Schellert, Delaurenti, Trimm, Edwards, Maxin, Bruce, Grant, Shane and Barei. Moved by Trimm, seconded by Edwards, that the absent.Councilman be excused. Carried. CITY OFFICIALS AND DEPARTMENT HEADS PRESENT: Helmie Nelson, City Clerk, Dorothea uossett, City Treasurer, G. M. Shellan, City Attorney, John Pain, Asst. City Attorney, Clarence Williams, Chief of Police, M. C. Walls, Fire Chief, Jack Wilson, City Engineer; Vern Church, Purchasing Agent, Gordon Ericksen, Planning Director, Sven Johnson, Building Director, Vic TeGantvoort, Street Commissioner, Ted Bennett, Utility Accountant, Gene Coulon, Park Director, Jan Klippert, Administrative Asst. to the Mayor, and Del Bennett, Traffic Engineer. Moved by Garrett, seconded by Edwards, that the Minutes of the previous meeting of March llth be approved as printed and mailed out. Carried. PUBLIC HEARING: Lyle Barger appeal of Planning Commission R-3 Rezone Denial Property at 2502 - 04, 9th Place North presently zoned R-1. This being the date set,the .hearing was declared open. Letter from Planning Director "ricksen outlined Planning Commission/actions to date, noting applicant's intent to �truct a triplex behind existing duplex with proposed access being 9th P1. North. It was noted the duplex is an existing non-conforming use and the present Comprehensive Plan indicates medium density multi-family use, however a low density multi-family use has been proposed for the Comprehensive Plan now under consideration by the Commission. Audience comment was invited and Mr. Barger, 2820 - 8th Place North, pointed out the proposed construction on drawing exhibited on the wall and stated he would like an R-2 if the R-3 is not acceptable. He noted there have been no objections from. the residents of the area during the five months the matter has been pending and upon inquiry, advised he did plan to remove the existing duplex.Mr, Stredicke noted 7-1 vote to reject by the Commissiofi.Mo'ved by Bruce, 'second by Grant to closethe hearing.Carried. Shane noted therewas no objection and that further delay results in additional increased interest costs to the applicant and moved that the property be zoned R-3. The motion was seconded by Bruce. Discussion ensued regarding Planning Commission study and the Comprehensive Plan, it being noted that this is on a fringe area and the Commission had felt that 9th Place North should be the breaking line between the medium and low density multiple use, and that the proposed use is considered to be premature for this area at present. Moved by Barei, seconded by Bruce, to.grant R-2 zoning, bringing the property into legal and current reflection of use, the petitioner having agreed to amend his appli- cation to R-2. The motion carried. Moved by Garrett, seconded by Grant, to refer the rezone, to the Law and Ordinance Committee for the necessary Ordinance. Carried. ,, Mayor Custer submitted a communication he received from the City Attorney,with regard to the North Renton Interchange and costs in sum of $1,256.40 which the State has requested be reimburses to it as being the City of Renton's share of the project, and it was passed to the Council President. He submitted another communication regarding proposal for a secondary water supply for the Renton Boeing Plant, received from the Attorney, which item is on the Agenda. COMMUNICATIONS: Letter from Park Director Coulon submitted and recommended for payment, statement in sum of $3,500.00 due Architects, Olson-Richert, Bignold & Co. for services on Phase I development plans for Lake Washington Beach Park. No. R-433-67 , request for rezone from R-1 to R-3; property located at 2502-04 9th Place N. • Gentlemen: • The application of Lyle L. Barger for rezone. from R-1 to R-3 was presented to the Planning Commission at its public hear- ing meeting of November 22 , 1967 . The property in question has the following general characteristics : • Total Area--app. 10,000 sq. ft. • Existing Zoning--R-1 Existing Use--duplex family dwelling Principal Access--9th Pl. N. Proposed Use--multi-family residential Comprehensive Plan--Existing: Medium density multi-family • • Revised: Low density multi-family On his application for rezoning the applicant indicated that it was his intention to construct a triplex unit behind the ex- • isting duplex presently on the property. The proposed access to the apartment units would be from 9th Place N. The area surrounding the applicant' s property, with the exception - of one duplex, is developed for single family residential use and is, for the most part, a relatively stable neighborhood area. There are, however, existing apartment units in the vicinity on E Street and adjacent to Sunset Blvd. in the existing R-3 zones. • Various questions were raised by members of the Planning Commis- sion, and since the applicant was not present to answer these questions, the application was continued to the December public hearing meeting. The applicant was advised by letter that his • application had been continued and it was requested that he or • his representative be present at the public hearing meeting of December 27, 1967 . At the December public hearing meeting, questions were raised as to the suitability of R-3 zoning for the area under study. The Mayor and City Council March 18, 1968 Page 2 • Planning Commission, with the permission of the applicant, con- tinued the hearing for 60 days to allow additional time for . study in order to determine the most suitable zoning for the over-all area including the applicant' s property. After completion of detailed study of the Comprehensive Plan and field trips to the area, the Planning Commission again con sidered the Barger application at its meeting of February 28 , 1968. It was the deteLmination of the Planning Commission that the proposed rezone request to R-3 zoning- was premature for the area and that the property, if developed to .R-3 stand ards, would have some detrimental effects on the adjacent single family residential properties. The Commission was of the opinion that a low density multi-family zoning would be feasible at a • future time (approximately three to five years) , but that the area should be rezoned on a comprehensive basis rather than parcel-by-parcel. The Commission, therefore, could not recom- mend the rezoning of the applicant' s property for R-3 at this time and recommended that the zoning not be changed from the existing R-l. The Chairman described the rezone application and indicated that it had been continued from the meeting of November 22 , 1967 . The Plan- ning Director pointed out the location of the property on the zoning map and stated it was presently the site of a. duplex dwelling which would probably :have to be, removed before additional units could be constructed; that the existing duplex was a non-conforming use in an R-1 area. Slides of the property in question were shown. The applicant, Mr. .Lyle.. L. Barger. of 2820 - 8th Pl. N. , spoke on behalf of the rezone application, stating there were other apart- ments in the area and. that' access to his property was good. Discussion ensued regarding possible removal of existing structures , setbacks required from existing structures,. The Chairman indicated the prime consideration of the. Commission was to determine the best zoning for the property; that .once- zoning was granted, other City ordinances would control development of the property relative to setbacks , land coverage, etc. . , Teegarden stated the property was located, in an area of nice single family homes , and in his opinion it would be .a mistake. to ' allow an apartment to be developed there. Brower stated he felt the whole area was suitable for apartments, but not just a single piece. NEW BUSINESS REZONE APPLICATIONS (a) Singer, Dean A. , Appl. No. R-434-67 , rezone from R-2 to R-4 ; property located on H St. between llth and 12th Aves. N. The rezone application was described by, the Chairman; the Planning Director pointed out the location of the property on the zoning map. Slides of the property were shown. Teegarden stated in his opinion R-3 was the best zoning for the property and that he would be interested in knowing if the appli- cant planned to remove the existing duplexes before developing the proposed apartment complex. Teegarden stated further he felt the existing structures should be removed prior to other construction. Brower indicated his agreement with Teegarden' s opinions on the matter. Mr. Dean Singer, 1915 Monterey Drive, the applicant, stated his plans for development of the property include the removal` of the existing duplexes. He displayed a sketch of the proposed devel- opment. . Racanello stated he felt this matter should be continued for 30 days in order to consider the matter of removal of existing structures , and so moved. Stredicke stated that before any action is taken, it should be decided whether or not the. Commission is discussing R-3 or R-4 zoning. Some discussion followed concerning the number of units that could be built under R-3 and R-4 zoning and how many units could be constructed between the existing duplexes if they were not removed. The Chairman asked the applicant if he would be willing to accept R-3 zoning. Mr. Singer replied that his studies concerning ground use and costs had been predi4cated .on R-4 zoning; that R-3 zoning would limit his development to about- 5 units and could be economically unfeasible. Stredicke stated the Commission has been granting R-3 in. the area; that he was opposed. to R-4 zoning for this property but would be willing to go along with R-3 zoning and would second Racanello' s motion for continuance to allow for- the preparation of restrictive covenants covering the removal of existing structures. Racanello stated he felt the area was ideal for R-4 zoning. Forgaard asked if other property owners in the area were present in the audience.
