' 153rd St. (continued) The Chairman described the rezone application and stated that the applicant has voluntarily filed restrictive covenants on this property. The- Planning Director stated that copies of the declaration of restrictive covenants. filed by the. applicant on the property have been furnished for review; such covenants are incompliance with previous discussions with the applicant. The plan at this time shows. the proposed development of , the entire parcel of land under consideration rather than the.. smaller section previously submitted by the applicant. The applicant . has presented a plan for two pro- posed- buildings with setbacks as indicated often and twenty feet and landscaping strips. The parking plan exceeds ordinance require- ments. The Planning Director stated further he felt the- covenants comply with the desires of the Commission for this area. As there were no comments from. the- audience, it was moved by Denzer, . seconded by Racanello, . that the hearing be closed. Motion carried unanimously. Stredicke inquired as to why. this applicant was allowed a . ten foot setback in .one area when another applicant in the vicinity was re- quired to set back twenty feet. . Discussion followed concerning differences between the two properties with reference to location, proposed use, proximity to the freeway, and the fact that the applicant' s ten- foot, setback is along the interior lot line, rendering it. less critical than if it; abutted public right of way, as :the property directly south of the applicant' s property is presently zoned L-1. ACTION: • Moved by. Racanello, seconded. by Denzer, that the ,Walter L. Cook property be rezoned from G-6000 to L-1 with restrictive covenants as it, agrees -with the Comprehensive Plan. The Commission was further concerned with the protection of the existing single family residences in the area and felt that the special permit would give the Commission better control over the development of the area. The request for rezone was, therefore, denied. Mr. Pain stated the Commission could grant approval . of the use with other City Ordinances taking over in the ,matter -of . setbacks., parking, etc. The, Planning Director stated the development .of . the property as pro- posed- would involve the granting of certain.. variances for - setbacks and parking, but -he felt this- was a, matter - for the , Board of Adjust- ment; the Planning Commission being concerned only with the proposed use. While- the Planning Commission could act, on the variances, it _ was his- opinion this was., primarily the concern- of- the Board- of Adjustment. Existing Zoning--R-2 Existing Use--single family ,residential Principal Access--91st Ave. S. Proposed Use--multi-family residential Comprehensive Plan--multi-family residential , medium density Staff Comments: The property in question is a small area located between two existing R-3 zones . The adjacent properties are presently developed for single family and duplex purposes with a church further to the south and a nursing home on the north side of S. 133rd St. The property in question is presently zoned R-2 and apartments could be constructed by special permit. It is recommended that the Commission consider the rezoning of the over-all area rather than the one parcel . Commission Comments: The proposed rezone of the applicant's property to R-3 would • have some detrimental effects on adjacent properties. It is recommended that the applicant be advised of the possibility of the use of the R-2 zone with special permit for apartment units. (d) Hogan, Thomas J. , Appl .
