Honorable Mayo Custer: I wish to make a protest regarding Richard Stredicke 's and Dayle E, Garrison 's action as members of the Planning Commission at their open meeting on June 26th and also their action at a City Council meeting earlier' when the new comprehensive plan was discussed. Mr. Stredicke and Mr. Garrison did everything possible to influence the other members of the Planning Commission with Mr. Stredicke 's facts of questionable validity and Mr. Garrison 's straying from Robert 's Rules of Order to reject the R3 zoning of the Lawrence and Huseland property in Kennydale. Several members of the Planning Commission spoke in favor of the rezoning. Mr. Stredidke made a motion to reject the R3 zoning first on the Huseland, Cayford property and later on the Lawrence property for the following reasons: 1. Not in agreement with the intent .' Comprehensive plan . Answer. We are at this time dealing with the present comprehensive plan, which is multi family, medium density or R 3 zoning. 2. Sewers not presently availabe, Answer. They will be availabe shortly on the Huselan_)Cayford property and the buyer of the Lawrence property acknowledges that he cannot obtain a building permit until sewers are availdbdtee A covenant to this effect could be attached to the R3 zoni.nc, I am spelling this out even th.ough sewers are not an issue in rezoning, 3. Such zoning would be detrimental to the area, Answer. Thereare businesses and apartments in the direct vicinity of the Huseland Cayford property and across the street from the Lawrence property there is a gas station and on the opposite corner there is business zoned property. There is also a three story apartment building just beyond the gas station. These two business areas in Kennydale sh.uuld be treated as any other business corner in the city of Renton. A three story building would enhance the area and not in ant) way be detrimental. It would upgrade the business area there and provide a buffer between the business and residential area. There were no complaints from the audience regarding the Lawrence property except lack of sewers. The property is bounded by S. E. 94th on the north, 104th. S.E. on the east, a fifteen foot alley on the south and a private residence on the west. The purchaser of the Lawrence property agrees to provide for a shrub or fence' screening between the Lawrence property and the private residence on the west0This too; could be �a�. ,venant att,2ehed to th.e R3 zoning. The purchaser is interested n R3 zoning Flo d and Della Lawrence are 'nt getting any younger and if they are to enjoy the proceeds from their property it must be now when I have a sale on it. It certainly was 'nt clear to me if it passed or not and I have excellent hearing and I was sitting in the front row.The same member of the Planning Commissipn asked for a roll call vote but Mr. Garrison told h.ini it was too late to ask fora roll call vote although it was immediately after the vote. Mr. Garrison said that the rezoning' was rejected anyway as he was going to vote against the rezoning I believe Tyr. Garrison strayed from Rober-Us Rules of order by not allowing a roll call vote and as Chairman of the Planning Commission he votes if by ballot but not after the count starts and in all cases where his vote would change the result. The result here was unclear and he should not have voted unless it was a tie.Mr. Stredicke made the same motion on the Lawrence pooperty and it too was rejected for the same reasons. It appeared to me that Mr. Stredicke and Mr. Garrison showed that either they had no knowledge of what was best for the area or the property owners or they could'nt care less or that they were acting in a precjudicial manner. The decision I believe was capricious, arbitrary, unreasonable and as I will prove discrimitory. On the Holcomb property on Sunset Blv. between 132nd SE and 1385. E. the Planning Commission granted R3 zoning ' although they could have rejected it for two of the same reasons and correctly so,that they used on the Huseland Cayford and the T,awrence property. On the present comprehensive plan it is not multi "family, medium densitywhich the Kennydale property is . .Also three story buildings could be detrimental to the area. The Holcomb speaker wants R3 zoning although he said he was going to build one and two story building5, He also said he could put many more apartments on the property with R3 zoning. He had a picture of a ona and two story building. How binding is a picture after he receives the R3 zoning My next protest regarding Mr. Stredicke and Mr. Garrison was their action at the Rental/ City Council meeting recently when the council was discussing the new comprehensive plan. The Chairman called for a vote on the green belt near the Barbee mill in Kennydale. I heard and saw Mr. Stredicke and Mr. Garrison both vote on the issue along with the councilmen. In fact because of this a roll call vote was asked and permission granted as some one in the audience was heard to vote.. They were not identified but I am sure they knew who they were. It seemed to me that Mr. Stredicke and Mr. Garrison were behaving in a very immature and irresponsible manner as the council was voting on a legislative matter. Some of the members of the Planning Commission were thoughtful and working in the best interest of the Renton area, Some I thought acted in a high handed manner typical of some of the black curtain countries . If it was ' nt for the Real Estate business, the Investers, and the Builders, Renton would be a ghost town. As Lord Samuel said, and I quote, ''Nothing is so dangerous as wrong headed effciency0I It is long past due all over the United States that we have fair dealings in zoning and all other matters for all of the people. AND HUSELAND, A. , Appl. .No. R-471-68; rezone from G and G-6000 to R-3; property located on Lake Washington Blvd. between S.E. 91st Pl. and S.E . .91st .St. The Chairman described the rezone application and stated that inasmuch as the Commission had visited the property several times and were familiar with it, they would dispense with showing of slides. Comments from the audience were invited. Mrs. Graham Bell, 9827 S.E. 91st Place, asked what the applicants intended to do with the property. She was advised that the zoning requested would permit construction of apartment buildings. She stated she was opposed to the rezone as such construction would block her view of Lake Washington. Mr. Amos Huseland, 10410 - 116th Ave. S.E. , one of the applicants , spoke on behalf of the rezone request. He stated he owned two of the lots under consideration; that while in the county these two lots were zoned for business , and such zoning was lost when the property was annexed to Renton. Mr. Huseland stated an apartment development would upgrade the 'area .and be more desirable than the modest rental dwellings now existing on the .property. Upon inquiry, Mr. Huseland stated the property was annexed to the City early in 1960 , but as sewers were not available, he did not request rezone prior to .this . time. It is his understanding that sewers will be available soon. Mr. M. Cayford, 16640 N.E. 85th, Redmond, applicant, also spoke on behalf of the rezone request. Mr. Jim Fawcett, 9003 - 100th Ave. S .E. stated he was opposed to the. rezone as he did not want a three story apartment house in close proximity to his home. He stated he realized a single family home . could be built to a height of 35 feet, just 5. feet less than an R-3 apartment house, but he said a single family home would not block the view like an apartment house could. Renton Planning Commission Meeting June 26 , 1968 Minutes Page 6 Mr. Huseland stated he would be willing to leave the area above the alley as single family or perhaps utilize this area for parking purposes. Stredicke stated that granting this rezone request would be opening the door for multiple use in this area, and he felt the Commission had already reviewed this area many times and felt it was suitable for single family rather than for multiple use. Ross stated he felt that granting this high a density on the prop- erty would subject the adjacent property owners to the east to possible depreciation of their properties . He stated further that perhaps the applicants would be willing to accept R-2 zoning on the property which would permit the Commission to exercise some control over its development as well as limit the height of buildings which most of the people in the audience seemed to object most to. Mr. Huseland stated he would not amend his application to R-2 ; that he felt the best use of the property was R-3 inasmuch as he had busi- ness use in the county for many years . As there were no further comments , it was moved by Stredicke, seconded by Ross, that the hearing be closed. Motion carried unani- mously. ACTION: MOVED BY STREDICKE, SECONDED BY ROSS , THAT THE REZONE REQUEST OF CAYFORD-HUSELAND FOR R-3 ZONING BE DENIED FOR THE FOLLOWING REASONS : (1) THE REQUEST IS NOT IN AGREEMENT WITH. THE INTENT OF THE COMPRE- HENSIVE PLAN; (2) SEWERS ARE NOT NOW PRESENTLY AVAILABLE ; AND (3) SUCH REZONE WOULD HAVE A VERY DEFINITE DETRIMENTAL EFFECT ON AD- JACENT PROPERTY. Racanello stated he did not agree with the motion; that he felt the property was suitable for R-3 use. Ross stated he felt the Comprehensive Plan indicated low density multiple use for the property, not the medium density applied for; that R-2 would allow the applicant reasonable use of the property, but the applicant had refused to consider R-2 . THE PENDING MOTION TO DENY THE REZONE REQUEST CARRIED; DENZER AND RACANELLO DISSENTING. The Chairman advised the applicant of his right to appeal the decision of the Planning Commission in writing to the City Council within ten days. (f) LAWRENCE, F.
