E. Lawrence Application No. R-472-68 Cent l emen: We the undersigned, property owners of the City of Renton, wish to oppose the application of F. E. Lawrence to rezone the property located at the S. W. corner. of S. E. 94th Street and 104th Avenue S. E. from G-6000 to R-3. This request is in opposition to the revised comprehensive plan which calls for R-1 zoning in this area. • Any such rezoning before the installation of sanitary sewers in the area would increase an already dangerous health hazard of which you gentlemen are fully aware. Mr. Lawrence states that the person with whom he is dealing will not • start building until the .sewers are in, Not only is this promise not binding on the city, but, in addition, the buyer could sell to another not so committed, In short, this area cannot support-more people on the existing drainage. We respectfully ask the members.of the council to, concur with the decision of the Planning Commission and refuse this rezoning. Shellan, City Attorneya Date of Publication: JUL 2 8 b Minutes - Renton City Council Meeting (Cont.) 7/15/68 PUBLIC HEARING: Six-Year Comprehensive Street Improvement Program Councilman Shane inquired as to when the local streets are to be improved and Mayor Custer noted recent work completed on streets in North Renton, South Renton, the Kennydale area and $17,000.00 allocation of last week for Talbot Hill area and 12th Avenue North, among others. The pending motion to close the hearing carried. The hearing was closed and council action invited. MOVED by Delaurenti, seconded by Perry, to adopt the Six Year Comprehensive Street Improvement Program as revised and presented by the City Engineer. The motion carried. MOVED by Perry, and seconded by Delaurenti, to refer the matter to the Law and Ordinance Committee for proper Ordinance. The motion carried. `UBLIC HEARING: FLOYD 'E. LAWRENCE APPEAL OF PLANNING COMMISSION DECISION (Denial of rezone from G-6000 to R-3) Corner S.E. 94th Street and 104th Avenue S.E., Kennydale area. This being the date set, the hearing was declared open. Petition containing 23 signatures was read opposing the rezone prior to installation of sewers. Letter from real estate Representative, Mrs. Josephine Peterson, advised that the zoning is in agreement with the; existing Comprehensive Plan and the purchaser, whose offer expires on July 17th, acknowledges that building permit cannot be obtained until sewers are available. It was felt the rezone would enhance and upgrade the area rather than being detrimental, serving as a buffer between business and residential areas and possible helping to get the sewers. Kennydale Community Club letter favored the rezone noting proximity of existing business and that replacement of present structure would constitute definite improvement. Planning Director Ericksen's letter outlined Planning Commission action and recommendation of R-2 as highest and best use to allow adequate regulatory controls. Audience comment was invited. Mrs. Peterson, 1458 Hillcrest Drive, reviewed the contents of her letter urging the rezone. Mr. Walt Tracey, 10227 S.E. 94th Street, opposed the rezone because of population density without adequate sewer facilities. Mr. F. E. Lawrence, applicant, advised that statement had teen prepared to the effect that no building will commence until sewers are available and requested approval to allow planning to proceed between now and such time. Mr. Chauncey W. Betts, 10046 S.E. 94th noted residency of some 21 years in the area and objected to apartments in the residential district anticipating problems of population and parking. MOVED by Shane, seconded by Edwards, the hearing be closed. After considerable discussion regarding covenant attachment, prior zoning of properties when in the County, review of sewer needs, proximity of single family areas with regard to view restriction, established business locations and proposed Comprehensive Plan revision, the pending motion carried. The hearing was declared closed and further council action invited. MOVED by Shane, seconded by Edwards, that the request for R-3 zo,ning. be granted with the reservation that no building permit be granted up to five years hence unless sewers are available within that period or by that time. PUBLIC HEARING: CAYFORD-HUSELAND APPEAL OF REZONE DENIAL BY PLANNING COMMISSION ( G and G-6000 to R-3)Lake Wn. Blvd. between S.E . 91st Pl. and S .E . 91st. Street in the Kennydale area This being the date set, the hearing was declared open. Communications opposing the rezone were read from Mr. and Mrs. Lloyd McGill, Mr. and Mrs. P. M. Everett, Mr. and Mrs. Graham Bell and Elda and James Fawcett, due to loss of desirable residential district and view. Mr. Amos Huseland, 1041Q - 116th Ave. S.E., spoke on behalf of the rezone stating he owned two of the five lots involved which were zoned Business while in the County and he had worked avidly for annexation being assured by City Officials at that time that his zoning would remain unchanged. His annexation object was to get sewers and he has not taken action to develop as he was not aware it would be changed. He read Section D of Ordinance #1869 in part which provides - - no change shall be effected with regard to existing status, uses, rights and limitations established in such area respectively, at the time of such annexation - - -. He felt the apartment would upgrade the area by eliminating old buildings now existing, acknowledging some view restriction which would°result even with construction of a single family residence . Members of the Renton City Council Gentlemen: The reasons given by the Planning Commission for rejecting the R3 zoning on the Floyd and Della Lawrence property on the S.W. corner of S. E. 94th and 104th S. E. I believe were not valid. They were: Not in agreement. with the intent of Comprehensive Plan. Answer: We are dealing with the present Comprehensive Plan which. is Multi family, medium density or R3:::. zoning. Sewers not presently available. Answer: Sewers are not an issue in zoning bu.t th.e purchaser of the Lawrence property acknowledges that he cannot obtain a building permit until the sewer is available. A covenant to this effect could be attached to the R3 zoning. I believe R3 zoning at this corner would expedite getting sewers in this top of the hill area in Kennydale. Such zoning would be detrimental to the area. Answer: Starting at the freeway on the south side of S. E. 94th heading west there is a• gas station, a fire station and business zoned property on th.e S E. corner of l04th S. E. On the north side of S. E. 9Lth heading west there is an apartment and a gas station on the N.E. corner of l04th S. E. The Lawrence property is on the S. W. corner of S. E. 94th and l04th 2. E. A three story apartment to replace the old house there would enh'.nce the area and not in any way be detrimental. No view would be obstructed. It would upgrade the business and residential area and provide a buffer between the business and residential area. The purch.aser agrees to provide a shrub or fence screening on the west line of the property. This too could be a covenant attached to the R cop 3 zoning. The purchaser is interested �_n R3 zoning.The Lawrences are 'nt getting any younger and if they are to enjoy the proceeds from their property it must be now when I have a buyer for it. The buyer plans to build as soon as sewers are available and this certainly woull add to the to x roll here. The only complaints regarding th.e Lawrence proper-.,? from the people of Kennydale was regarding lack of sewers,and this has no bearing on the rezone request. Opponents to the proposed zoning as well as any alternate zoning spoke at length on the subject matters the question of sewers being the predominate con- sideration: The Planning Commission, on conclusion of the hearing on the subject matter voted to deny the rezone request for the following reasons: 1. The request is not in agreement with the intent of. the Comprehensive .:Plan 2. Sewers are not now presently available. 3. Such rezone would have a very definite detrimental effect on adjacent properties. At the Planning Commission Administrative meeting of July 10, 1968 the matter of the F. E. Lawrence rezone denial . appeal was discussed in view of communicating to.. the City Council the basis ,for the Planning Commission decision. The Commission at this time voted to recommend to the City Council that the highest and..best use for the property, in question •would be' that allowed under'the R-2 zone.. It was the feeling of the majority of the Commission members that the R-2 zone would allow the Commission adequate controls to alle- viate some of the problems and the detrimental effects on the ad jacent properties. Stredicke stated that granting this rezone request would be opening the door for multiple use in this area, and he felt the Commission had already reviewed this area many times and felt it was suitable for single family rather than for multiple use. Ross stated he felt that granting this high a density on the prop- erty would subject the adjacent property owners to the east to possible depreciation of their properties . He stated further that perhaps the applicants would be willing to accept R-2 zoning on the property which would permit the Commission to exercise some control over its development as well as limit the height of buildings which most of the people in the audience seemed to object most to. Mr. Huseland stated he would not amend his application to R-2 ; that he felt the best use of the property was R-3 inasmuch as he had busi- ness use in the county for many years . As there were no further comments , it was moved by Stredicke, seconded by Ross, that the hearing be closed. Motion carried unani- mously. ACTION: MOVED BY STREDICKE, SECONDED BY ROSS , THAT THE REZONE REQUEST OF CAYFORD-HUSELAND FOR R-3 ZONING BE DENIED FOR THE FOLLOWING REASONS : (1) THE REQUEST IS NOT IN AGREEMENT WITH THE INTENT OF' THE COMPRE- HENSIVE PLAN; (2) SEWERS ARE NOT NOW PRESENTLY AVAILABLE ; AND (3) SUCH REZONE WOULD HAVE A VERY DEFINITE DETRIMENTAL EFFECT ON AD- JACENT PROPERTY. Racanello stated he did not agree with the motion; that he felt the property was suitable for R-3 use. Ross stated he felt the Comprehensive Plan indicated low density multiple use for the property, not the medium density applied for; that R-2 would allow the applicant reasonable use of the property, but the applicant had refused to consider R-2. THE PENDING MOTION TO DENY THE REZONE REQUEST CARRIED; DENZER AND RACANELLO DISSENTING. The Chairman advised the applicant of his right to appeal the decision of the Planning Commission in writing to the City Council within ten days. (f) LAWRENCE, F. The Planning Director pointed out the location of the property on the zoning map. Slides of the property were shown. Comments from the audience were invited. Mrs. Josephine Peterson, .1458 Hillcrest Lane, representing the applicant, spoke on behalf of the rezone request. She presented a contract purchase agreement to the Commission which read that the owner would not develop the property for multiple use until sewers were available. Mrs . Peterson described surrounding uses including those presently in the county just to the east of the Renton Planning Commission Meeting June 26 , 1968 Minutes Page 7 property under consideration. These .uses, .Mrs . Peterson claimed, justified her client' s request for . R-3 zoning and stated further that a lesser zoning would not be acceptable to her client. Mrs. F. E. Lawrence, the applicant, also spoke on behalf of the rezone request. The following people in the audience spoke in opposition to the proposed rezone, citing the deplorable sewage disposal situation in the area: Mr. Walter Tracy, . 10227 . S.E. 94th St. ; Mr. Alexander, 10205 S.E. 94th St. ; Mr. Chauncey Betts, 10046 S.E. 94th St. ; Mr. Vernon Jarvis, 10023 S.E. 94th St. ; together with several uniden- tified ladies. After considerable further discussion regarding the sewage disposal . problem in the area, it was moved by Stredicke, seconded by Denzer, that the hearing be closed. Motion carried unanimously.
