Exhibit No. 3: Proposed Site Plan Map Exhibit No. 4: Elevation Map Proiect Description The applicant, Calvary Baptist Church, is requesting approval of a variance from the Sign Regulations in order to reduce the required 10-foot setback from a street right-of-way to 4 feet, 6- inches. The proposal is for a 16 square foot (4-foot by 4-foot) sign to be mounted between two 2 square foot brick columns placed on a 6-inch thick concrete slab. The monument sign would be 2 feet in width, 8 feet in length, and 5 feet, 10-inches in height. The signage is intended to add a sense of identity for the existing church facility, as well as aid those visiting the site with site identification. The subject site is located in the Residential Multi-Family Suburban Center (RM-C) zoning designation. The Sign Regulations identify specific development standards for church signs located within residential and mixed-use zones. RMC section 4-4-100.E.4.a limits church developments to two identifying signs of no more than 32 square feet in size and not to exceed 6 feet in height. The regulations also require that all freestanding signs maintain a minimum 10- Board of Adjustment Minutes October 25,2000 Page 2 foot setback from street rights-of-way and/or a 5-foot setback from any side property line. With the exception of the required street setback, the proposed sign complies with all requirements of the City's Sign Regulations and the development standards of the RM-C zone. The subject property currently contains one freestanding pole sign in the northeast corner of the site. In addition to this sign, the applicant is proposing a monument sign to be located adjacent to the site's western boundary adjacent to Edmonds Avenue NE. The sign would be placed at a perpendicular angle to the street within an elevated landscape area directly in front of the church building. A rockery wall that is approximately 2 feet in height above street level and sets on the site's property line supports this landscape area. The proposed location of the site would be between the entrances to the north parking area and the vehicle drop off area to the south. A distance of approximately 170 feet would be provided from the Edmonds Avenue and Sunset Boulevard intersection. In the event the requested variance is approved,the applicant would be required to obtain approval of a separate sign permit from the Building Department prior to the installation of the sign. Variance Criteria City Code section 4-7-22.G.3 states the conditions under which a variance may be granted. Those conditions are listed below with discussion following each of the variance criteria. 1. That the applicant suffers undue hardship and the variance is necessary because of special circumstances applicable to subject property, including size, shape, topography, location or surroundings of the subject property, and the strict application of the Zoning Code is found to deprive subject property owner of rights and privileges enjoyed by other property owners in the vicinity and under identical zone classification: The subject property is currently developed with two connected buildings, as well as with associated parking areas, landscaping, and utility improvements. The main church building was constructed with a setback of approximately 15 feet from the site's west property line. The setback area is landscaped with grass and shrubbery. The applicant contends that due to the location of the existing building, the required sign setback would preclude the ability to install signage necessary for identifying the church facility from Edmonds Avenue. Under the strict interpretation of the code provision, a sign totaling only 5 feet in width would be possible when complying with the required 10-foot setback. The required setback would force the sign to be constructed immediately adjacent to the building and would create difficulties for future maintenance of the building. In order to provide an appropriate setback from the existing building (5 feet), the applicant has proposed a reduced setback of 4 feet, 6-inches from the west property line. The limited amount of area between the site's west property line (Edmonds Avenue NE) and the location of the existing building substantially limits the area for potential signage and can be considered special circumstances or characteristics of the site that pose an undue hardship on the applicant. Furthermore, the site is bounded by two arterials on the north and west sides, such that the lot results in an irregular shape. There are no points of access to the site via Sunset Boulevard with the only entrances to the property provided by Edmonds Avenue. Centrally placed signage that is visible from Edmonds Avenue is essential for the identification of the church facility. That the granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which subject property is situated: The sign code prohibits signage between the height of 3 to 10 feet within 20 feet of intersections or driveways in order to prevent obscuring vision (a.k.a., "clear vision area"). Due to the proposed sign's distance from the north and south entrances to the site (approximately 75 feet and 30 feet, respectively), the applicant contends the proposed sign would not create a hazard to automotive or pedestrian traffic. The placement of the sign in the proposed location would remain outside of the clear vision area and would not impair visibility to the existing driveway entrances to the facility. The sign would actually serve to improve site identification for church visitors, potentially reducing traffic safety issues along Edmonds Avenue. The proposed sign location would also comply with all other sign code and RM-C development standards, with the exception of the reduced setback requested with this variance application. The location and size of the sign would not have a detrimental affect on public welfare nor would it have negative affects on the subject property or properties in the vicinity. Furthermore,the proposed sign would be beneficial to the public and visitors to the church facility in terms of identifying the site before passing the two parking entrances and distinguishing it from adjacent properties. Therefore, the granting of the variance from the setback requirement would not have an adverse visual affect on adjacent property improvements and would not be materially detrimental to the public welfare or injurious to property or improvements in the vicinity or zone. 3. That approval shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity and zone in which the subject property is situated: The requested variance would allow for a freestanding monument sign on the west side of an existing church facility development. Adjacent properties in the vicinity of the subject site are designated with commercial zones. These zones are permitted to locate signage within the required setbacks, provided the clear vision area is not obscured. The approval of the variance would allow signage that would be comparable to that which is permitted on adjacent properties. It is an unusual circumstance or condition for a developed property to lack adequate street frontage required for a freestanding sign, especially when the sign is necessary for identifying the property. Special circumstances apply to the subject site due to the irregular shape of the parcel and its orientation and topographic relationship to two arterial roadways. Therefore, the approval of the variance would not constitute a grant of special privilege over other properties in the vicinity and zone. 4. That the approval as determined by the Board of Adjustment is a minimum variance that will accomplish the desired purpose: The applicant has considered the feasibility of alternative locations for the necessary signage. Specifically, the placement of a sign within the landscaped street setback Board of Adjustment Minutes October 25, 2000 Page 4 area located north of the existing building was considered. However, the presence of a very large tree(a western red cedar of 40 feet in height and 12-inches in caliper) would preclude the placement of a monument sign outside of the required 10-foot setback. Although current regulations do not prohibit the removal of the tree, the cost associated with the removal of such a large tree would pose an undue burden on the applicant. In addition, the proximity of this area to the existing pole sign on the site would not serve the applicant's intent and need for the proposed signage. Furthermore, the applicant contends the approval of the proposed sign would serve to improve the sense of identity for the church, as well as assist visitors with locating the site. Due to the limited amount of space between the existing building and the right-of-way, the only area sufficient for signage to be visible from the street is within the required setback area. The proposed sign is of the minimal size (area and height) to provide for clear identification of the church facility and is proposed at a location that would result in minimal impacts to the property. The proposal may be considered the minimum variance necessary to accomplish the objectives of the applicant. AUDIENCE COMMENT/TESTIMONY: Acting Chairperson Wallace asked for testimony from the applicant: Representative for Applicant Mr. Ed Schumer Calvary Baptist Church 17828 SE 137th Street Renton WA 98059 Mr. Schumer stated that the sign the church has been planning for a sign for approximately three years. They have local and out-of-town visitors asking why they do not have a sign to make it easier to find the church. General discussion between Boardmembers and Mr. Schumer ensued. Acting Chairperson Wallace asked for any further testimony in favor of the proposed applicant. None was stated. Chairperson Wallace asked for testimony in objection to the variance. There being none,the Acting Chairperson closed the public hearing. The main church building was constructed with a setback of approximately 15 feet from the site's west property line. The setback area is landscaped with grass and shrubbery. The applicant contends that due to the location of the existing building, the required sign setback would preclude the ability to install signage necessary for identifying the church facility from Edmonds Avenue. Under the strict interpretation of the code provision, a sign totaling only 5 feet in width would be possible when complying with the required 10-foot setback. The required setback would force the sign to be constructed immediately adjacent to the building and would create difficulties for future maintenance of the building. In order to provide an appropriate setback from the existing building (5 feet), the applicant has proposed a reduced setback of 4 feet, 6-inches from the west property line. The limited amount of area between the site's west property line (Edmonds Avenue NE) and the location of the existing building substantially limits the area for potential signage and can be considered special circumstances or characteristics of the site that pose an undue hardship on the applicant. The location and size of the sign would not have a detrimental affect on public welfare nor would it have negative affects on the subject property or properties in the vicinity. Furthermore, the proposed sign would be beneficial to the public and visitors to the church facility in terms of identifying the site before passing the two parking entrances and distinguishing it from adjacent properties. Therefore we are requesting a variance. 1032 Edmonds Ave. NE Renton, WA 98056-2920 A. Renton has a minimum setback from the property line of eleven (425) 255-3273 feet. We do not have enough room to fit our sign within that distance. Approaching Calvary Baptist Church on Edmonds Ave NE from the www.calvaryrenton.com south, there is not anything to identify our building. People pass us by before they realize that they are beyond the church. There is only one other option for placement of the sign, but it would involve cutting down a 61-year-old cedar tree. Our church has been in Renton for fifty years and most of that has been on this site. That cedar has been with us all that time. Besides, cutting down the cedar and placing the sign on that site north of the church would not address the problem of having a sign visible to motorists approaching from the south. Other property owners in our area have similar circumstances and have obtained variances in order to have their signs up. B. Granting of the variance would have no negative impact upon traffic using Edmonds Ave NE or auto traffic in and out of our church property. We have placed a similar object where we are asking the sign to be located and have discovered that traffic exiting our parking lot has an unimpeded view at least 100 yards down Edmonds Ave to the south, and to traffic lights to the north. DeBerry the church would have a positive impact upon traffic by those who are Pastor to the Deaf Thomas Carmichael Music and Youth looking for our church. It would give more time for proper signals and safer entry into our parking lots. It would also have a positive effect upon the environment. In keeping with Renton's efforts to upgrade and beautify the area of Highlands, we feel that this sign would be a major step forward for the city and for us. The sign is made of large block letters that are easy to read, colorful, and have an attractive appeal to the neighborhood. We are also concerned about how our neighbors would view the variance. These neighbors include business, condominiums, apartments, some homes, a convalescent center and vacant property. We have talked to many of them and the ones we talked to had no problem with a variance. This variance will have no effect on wetland or run off because the soil is very sandy in this area. C. Granting of a variance is not a special privilege to Calvary Baptist Church. We have observed that many of our neighbors in Renton Highlands have signs that required a variance. Granting Calvary Baptist Church a variance would not be inconsistent with the limitations upon our property based upon what we have observed in our neighborhood. The public needs to know where the church is located. We have had several inquiries as to why we do not have a visible sign outside where the public can see it. D. The granting of a variance by the City of Renton would allow us to install the sign as proposed in the original request. The variance of 4 feet 6 inches would allow us to accomplish that purpose.
